ccswks 04-28-1993 14h SPECIAL MEETING OF THE CITY COUNCIL APRIL 28, 199Z The Schertz City Council convened in Special Workshop Session Wednesday, April 28, 1993 at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The followinq members were present: Mayor Earl W. Sawyer, presidinq; Barbara Stanhope; Mary Marsh and Ken Greenwald. Absent: Joe Potempa and Hal Baldwin. Staff present were City Manaqer Kerry Sweatt and City Secretary June Krause. Mayor Sawyer welcomed Mayor Jay Millikin from Garden Ridqe and Tom Weaver, CCMA,to our meetinq. #1 HEARING OF RESIDENTS: A. Mavor Jav Millikin expressed his appreciation for beinq allowed a few minutes. He said the Garden Ridqe Water Company requested that he discuss with Council a potential workinq aqreement between the City of Schertz and Garden Ridqe for them to be a user, under certain circumstances, of Schertz water. He related that they have one major water well and last September when the well went down, it effected about 85% to 90% of their citizens. The Garden Ridqe City Council wanted to ascertain if it was at all feasible for them to use Schertz water. Mayor Millikin went on to say their estimate to lay a line for the connection would be about $63,000 and his Council wanted him to explore the possibility of this. Mayor Sawyer requested that he qive Council the opportunity to have the City Manaqer work out some pros and cons. He said he felt the Council would be happy to approve this agreement if it does not affect our system. He indicated to Mayor Millikin that we would qet back with him in two or three weeks. B. Bill Nell~r said he had talked with Representative Kuempel and had invited him to come out for Flaq Day Ceremonies on June 14, 1993. He had been assured by Randolph AFB that they would collect the flaqs for the disposal ceremonies. He invited everyone to come out on June 14th at 7:00 p.m., sayinq that he was disappointed in the turn-out last year. #2 Discuss request to property. purchase portion of City Mr. Sweatt referred to the memo in Council packets, sayinq he had received a follow up to the oriqinal request. He pointed out the location as beinq at I-35 at the intersection of FM 482 and FM 2252. The land is trianqular in shape and has a drainaqe easement; and at present, has a pile of concrete rubble on it. The City acqUired this 146 property in settlement of a tax suit. The Advertising Company wants the property to install a large freeway type two faced sign, which does meet the ordinance requirements. We asked the company if they would be interested in a lease and they would prefer ownership. Mayor company time. Sawyer said that since the representative of the was not present, this item should be tabled at this #3 Discuss request by Rev. Perales for use of the large pavilion for youth activities. Mayor Sawyer recalled that at the last meeting Rev. Perales asked for use of the pavilion for a youth program. While he does not have many young people in his church, he would like to start a program for all youth in Schertz. Mrs. Marsh had several questions for Rev. Perales. First she asked if it would be open to everybody and was told it would be. Also the ages of the youth would be from 12 to 18 years of age and the hours from 6:00 p.m to 8:30 or 9:00 p.m. Mrs. Marsh then asked what type of program would they have. Rev. Perales said in the early part of the evening, they would have different types of games and entertainment, then some songs and about fifteen minutes of discussion on such topics as gangs, drugs, etc. Answering further questions, Rev. Perales said he planned on haVing about 35 adults to help supervise and coordinate activities. He said he had been checking with other churches in the area for help. He had contacted several businesses and they seemed excited to participate with donations of food or money. Mrs. Marsh said, while she had no objections to letting Rev. Perales try this program, she did think there should be a written agreement with Schertz. Mr. Sweatt said they would have the same agreement that everyone else has to complete, except that it would be a no fee permit. He said the only issue is security and there is no way to plan for that other than to make provisions that there will be adequate supervision. Mr. Greenwald pavilion area. spread out, at and then all get asked if they planned on using the entire Rev. Perales said they did, as they would first, in small groups with supervision back together. Mayor Sawyer advised there was Council concurrence to allow Rev. Perales to use the large pavilion on May 7th. 1 ,n #4 Discuss audit report. Mayor Sawyer advised the Audit Committee had met and Mr. Baldwin seemed to be very pleased with the audit. He added that the City has. about a 2-1/2 month hold over, which means manaqement is fantastic. He mentioned that Debbi Kline, Finance Officer for the City was present to answer questions, along with our auditor Barney Ortiz. Mr. Ortiz reminded Council that the only thing they would get from the auditors was their opinion. Everything else is from the City Manager and Finance Department. He then gave a short explanation of the changes in Fund Balances, showing we have approximately 2-1/2 months of operating funds, which is almost the goal of three months set out two years ago. Mr. Ortiz then explained a little about the Capital Projects Fund. Last year the capital recovery fund and fees were in the Water and Sewer fund. This year they were taken out and put into the Capital Projects Fund. This fund is make up of two items, first is capital recovery and the other is unspent money from previous bond issues. Mr. Ortiz then briefly described the Enterprise Fund, especially in the Water and Sewer fund, mentioning the $345,000 transferred that was owed to debt service. He said that if everything continues to track like it should, we will probably not have the reserve and our fund balance will go into a deficit. He added that somewhere along the line, we will have to look at fees. He then d~scussed the SAFES fund, saying the biggest expense was the loss of $41,374 bad debts. He said they went back about 3 or 4 years and found that the trend was that we were not collecting about 25% of everything billed. Now, of everything that is billed, twenty five cents goes to the bad debts. This year we sent bad debts to a collection agency but they have not returned any at this time. Mr. Ortiz asked Council to look through the complete report and if they have any questions at all, to contact him at his office and he will be glad to discuss their questions. Mrs. Marsh expressed her opinion that it is a pleasure to be able to read this audit report. Mayor Sawyer advised this will be formally present at the next meeting. *5 Discuss CCMA/City of Schertz Waste Water Program. Mr. Tom Weaver said that they recently met to discuss problems they now face as a result of the new permitting procedures. He showed some slides giving a Toxic Control Overview. He said that CCMA receives a permit every five years and they are now in the third stage, which is the most 148 stringent permit possible. Their big problem'is that they discharge into the Cibolo Creek and dry creek bed and the toxic level is unacceptable to aquatic life. They have to do the Biomonitoring test quarterly. He discussed the 64 toxic pollutants they have to remove. The have two choices, to remove the toxics at the source or build a new treatment plant. Their plant is an excellent plant and is good for years of the growth they expect. The have until April 25, 1995 to remove the toxants. Mr. Weaver said they took samples in Schertz, Cibolo, Garden Ridge, Universal City and Selma. The results showed Selma to be the best, Cibolo - strong, Randolph AFB moderate, the main part of Schertz - moderate to strong and the FM 3009 area of Schertz - low, Universal City moderate. He said they do not know what kind of toxants are involve. He said they need the support and public awareness for this permitting. Their Board has said they do not feel there is any reason they should charge the cities. They will cover the costs of all the tests; but one year from now, if they did have a problem, they would identify the source and charge that entity only. He said once they isolate and identify the source, they will have to have the cooperation from the City Manager and the Water/Waste Water Department people. Mr. Weaver said they do not plan any increase in fees at this time and will keep Mr. Sweatt posted. He said, at some time, they may be asked to talk to neighborhood groups and would be glad to. '6 Discuss preliminary CDSO projects applications to Sexar County. Mr. Sweatt advised staff asks Council to agree in concept with the five projects and applications they will refine and present to Bexar County. While we have petitioned the U.S. Department of Housing and Urban Development to be removed from the Bexar County CDBG program, we are not yet out and feel we should submit proposals. The five projects are: 1. Rebuild Pfeil Road - $262,000 2. Matching grant for Water and Sewer construction in Mobile Villa - City's share $180,000/CDBG $100,000. 3. Dietz Creek Drainage Area #1 from FM 3009 to Elbel Road - $470,000. 4. IH-lO water line, from FM 1518 to Scenic Lake Drive $304,000. 5. The Schertz Development Foundation will aoain request a grant of $50,000 for a Revolving Loan Fund. This was submitted last year and turned down. 149 Council consensus was to go with these projects. #7 Discuss application. endorsement of Housino Authority Mr. Sweatt referred to draft of a letter to the Housing Authority Executive Director Donna Lackey in response to her request for the City's support in their endeavor to obtain additional housing for the elderly, handicapped and disabled. He said he tried to make it clear that we would only speak to the request for senior citizens. Mrs. Stanhope said she was at a meeting where this was discussed and they will put in another project just like the one they have now. She said we have people on the Commission now who are aware of Council's desire for senior citizen housino only. She relayed to them that the Council is very proud of what we have and only want senior citizen housing. Mayor received a consensus from Council to proceed with the letter, changing the word elderly to senior citizen. #8 Discuss election canvass, Swearino in of officers and designation of Mayor Pro Tem. Mayor Sawyer mentioned that this is routine and will be like it always is, with the Mayor Pro Tern being Place 5 this year. #9 CITY MANAGER'S REPORT. A. Advised that he would have a memo in next weeks packet concerning. '.the in.formation on curfew. He said that since the ordinance was adopted, we have issued 26 warnings, with the highest age being 16, and average age of 15. That is not all that were stopped, some had valid reasons for being out and some were older. A very positive aspect is that the officers are not seeing these kids a second time. B. P&Z has approved the Master Plan for the remainder of development proposed for Woodland Oaks, containing 252 lots. We have seen more development in the last week than we did all of last year. If things continue, we will be out of platted lots by the end of the year. 150 #10 ITEMS BY COUNCIL: Mrs. Marsh - reported on the Schertz Business Club meeting of April 27th, advising that the City float received a 4th place out of 44 in our category in the Flambeau Parade in San Antonio. Mr. Sweatt gave the City Hall update, mention was made they had received three applications for scholarship and discussed the May 23 Jamboree at the VFW where they will have a silent auction. The deadline for the Schertz Sweetheart is May 21st, with selection being made in June. They had a long executive session on the JUly 4th Jubilee. They will have tIckets thIs year for everythIng. Kountry Kitchen will have food on the 3rd of July and Abel's on the 4th, Randolph Country Roundup is going to set up with hamburgers on the 4th. They plan on Nashville Sounds playIng on the 3rd wIth the Hillert Band and the cloogers on the 4th. The fireworks will start about 9:30 p.m., with the rain date being Veteran's Day. The City float will be in about 15 parades this year and is one of the best marketing tools. It had to be redone this year and there will be a request to add to the budget this year for 1/2 the cost of the float. #11 ITEMS BY MAYOR: A gentleman from the audience said he had just brought in fifty RVs to the Stone Creek RV Park and it is very dangerous trying to get out onto 1-35 access. He said there are usually cars parked and a wrecker which cuts the view of on-coming traffic. Mayor Sawyer assured him we are aware of the problem and that the City Manager was having the inspectors look into it right now. # 12 ADJOURNM61_.I.: meeting was declared Sawyer.
