REGULAR SESSION OF THE CITY COUNCIL OCTOBER 19, 1993 The Schertz City Council convened in Regular Session Tuesday, October 19, 1993 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Joe Potempa; Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. Mayor Sawyer welcomed everyone to the meeting and asked them to rise and join him in the Pledge of Allegiance. #1 APPROVAL OF MINUTES: A. B. C. Regular Meeting 9-7-93 Public Hearing 9-15-93 Special Meeting 9-15-93 Mrs. Marsh moved to approve the minutes of the Regular Meeting of September 7th, the Public Hearing of September 15th and the Special Meeting of September 15, 1993. Mr. Greenwald seconded the motion, which carried as follows: . AYES: Councilmembers Potempa, Baldwin, Marsh and Greenwald NAYS: None ABSTAINING: Mrs. Stanhope #2 HEARING OF RESIDENTS: A. Mr. Jim Harris said that about a year ago he noticed on his telephone bill the deductions for City and County taxes. He called Southwestern Bell and his city taxes were going to Cibolo and his county taxes were going to Guadalupe County because that is his mailing address. He got them straightened out but again is wondering if the telephone company is handling the taxes correctly. Mr. Sweatt said he recalled Mr. Harris bringing this up and at that time he had called Southwestern Bell and sent them a city map and was assured that all Schertz residents' taxes would be going to Schertz. The City cannot get individual information from them but the individuals can get their own. B. Ms. Hoover of 2813 Kline Circle asked what the rules were regarding dogs and leashes. She explained she had opened her door recently and there stood a Rottweiler dog. She indicated the animal lived across street and down a ways from her. City that huge the Mr. Sweatt advised the City has a leash law and if not they are subject to collection and fine. He suggested she call our Animal Control Department the next time she sees the dog out. 29(q #3 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 93-S-17 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE, NO. 87-S-1, APPENDIX B. DEFINITIONS; AND PROVIDING A REPEALING CLAUSE Mrs. Stanhope moved to approve the final consideration of an ordinance amending the Zoning Ordinance clarifYing the definition of side-yard setbacks. Mr. Potempa seconded the motion, which carried with the fOllowing vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None #4 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 93-T-18 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, ESTABLISHING THE TECHNOS REINVESTMENT ZONE Mr. Potempa moved to approve the final consideration of an ordinance establishing the Technos Reinvestment Zone. Mrs. Stanhope seconded the motion, which carried as follows: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None #5 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 93-T-19 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, APPROVING A TAX ABATEMENT AND A TAX ABATEMENT AGREEMENT FOR AND WITH MR. PHILLIP NEAL, A PROPERTY OWNER IN THE CITY OF SCHERTZ. Mrs. Marsh moved to approve the final consideration of an ordinance approving a Tax Abatement Agreement for Technos Corporation. Mr. Baldwin seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None ~J~ #6 APPOINTMENTS: Consider reappointing three members to Commission. and take action on the Planning & Zoning Mr. Sweatt reminded that the terms of Bob Andrews, Pia Jarman and David Richmond are expiring and they have expressed their desire to be reappointed, with Planning & Zoning Commission members concurring. Mr. Greenwald moved to reappoint Bob Andrews, Pia Jarman and David Richmond to the Planning & Zoning Commission. Mr. Potempa seconded the motion, which carried as follows: ~YES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None #7 RESOLUTION: Mayor Sawyer introduced a resolution and read the caption as follows: RESOLUTION NO. 93-R-7 A RESOLUTION ENDORSING THE EFFORTS OF THE NATIONAL LEAGUE OF CITIES AND THE TEXAS MUNICIPAL LEAGUE TO INFORM OUR CITIZENS ABOUT THE IMPACT OF FEDERAL MANDATES ON OUR CITY FINANCES. Mayor Sawyer advised that he recommended nominating Sylvia Schlather to this board. Mr. Sylvia County motion, Potempa moved to approve the resolution nominating Schlather to the Board of Directors of the Guadalupe Appraisal District. Mr. Greenwald seconded the which carried with the following vote: 300 AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #9 AGREEMENT: Consider and take action on an agreement for hazardous material incident responses. Mr. Sweatt said we have been offered an opportunity to join a number of other cities in a combined effort to deal with hazardous material incidents. He stated that as Council knows because of the two interstates and two railroads in our city, we have great potential for such an incident. These cities have banded together and through donations and other sources have put together an organization that will take care of each incident, where ever it may be. They will have well trained personnel and the equipment. Our first year's cost is $2100 and we feel this is a much less expensive way of handling than on an individual city basis. Mrs. Stanhope moved to authorize execution of an agreement for hazardous material incident responses. Mrs. marsh seconded the motion, which carried as follows: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #10 BID AWARD: Consider and take action on awarding bids for two surplus vehicles. Mr. Sweatt related that the City had solicited bids, for the second time, for the sale of a Crown Victoria and Chrysler Wagon. Three bids were received for the Crown Victoria, with Mike DuPlantis giving the high bid of $600. The high of the two bids received for the Chrysler wagon was $100 from Burch Roofing. He recommended both these bids be awarded. Mrs. Stanhope moved to sell the vehicles to the highest bidders. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #11 CITY MANAGER'S REPORT: A. The City of Helotes sent an invitation to attend their Open House and Dedication ceremonies on November 7th from 2:00 to 4:00 p.m. B. An update on the Mobile Villa Project - with all complications involved, it appears to us it would better arrangement to switch the grant funds to the project and do the sewer with city funds. the be a water ",.....-- C. Entex Gas is holding a training class at the fire station and they are cooking hamburgers and have invited the Council down right after the meeting. #12 ITEMS BY COUNCIL: Mr. Potempa - A. Announced the first meeting of the Board of Directors of the Schertz Parkway Tax Increment Financing Reinvestment Zone would be November 1, 1993 at 7:00 p.m. B. He also announced that he is the new Commander of the American Legion Buffalo Valley Post 610. Mr. Baldwin related that there was an agenda item on the next School Board meeting to put a second member on the TIF Board. #13 ITEMS BY MAYOR: Announced that, although it is a legitimate organization, he and his wife are not members or involved in taking up a collection for the Police Survivors. #14 ADJOURNMENT: Mr. Potempa moved the meeting be adjourned at 7:24 p.m., with Mr. Baldwin seconding the motion, which carried unanimously. 0,~/ Lvf~~ ~~~r.
