SCHERTZ BOARD OF ADJUSTMENT OCTOBER 15, 1991 The Schertz Board of Adjustment convened in Special Meeting on Tuesday, October 15, 1991 at 7:00 p.m. in the Council Chambers, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Chairman Joe Potempa; Barbara Stanhope; Mary Marsh and Ken Greenwald. Absent: Earl W. Sawyer and Hal Baldwin. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. #1 PUBLIC HEARING: The purpose to receive input from citizens regarding a request from Thomas A. Nelson, 503 Aero Avenue for a 4' exception to the side-yard setback requirements of the Zoning Ordinance in order to construct a carport. Mr. Sweatt advised that our ordinance calls for a 7' side yard setback and Mr. Nelson is requesting a variance to place a carport 2' from his residence and 3' from the side yard property line. There were 46 letters mailed to property owners within three hundred feet of his property, with 14 answers received and none of them objected. There being no comments from citizens or Board members, Mr. Potempa declared the public hearing closed at 7:03 p.m. #2 Consider and take action on the above request from Mr. Nelson. Mrs. "Marsh moved to for a 4' exception to the Zoning Ordinance. which carried with the approve the request from Mr. Nelson the side yard setback requirements of Mr. Greenwald seconded the motion, following vote: AYES: Chairman Potempa, Mrs. Stanhope, Mrs. Marsh and Mr. Greenwald. NAYS: None #3 PUBLIC HEARING: The purpose of this hearing is to receive citizens input regarding a request from Harold Bauman, 1545 Circle Oak, for a five foot exception to the side yard setback requirements of the Zoning Ordinance to allow the construction of a pool. Mr. Sweatt said the original request from Mr. Bauman was for two exceptions. At the hearing before Planning & Zoning a portion of the request was deleted. This was for a 5' exception to construct a deck. The remaining request is for a 5' exception to the side yard setback to construct a swimming pool. Ten letters were mailed to property owners within three hundred feet of this property, with two answers being received. One did not object and the other, from the developer of the subdivision, did object. Mr. Simmons referred to the restrictions on the subdivision, saying the five foot easement was granted at the time the plat was recorded and cannot be changed without the consent of all I I I ----~ property owners. Mr. Sweatt said he felt Mr. Simmons was only concerned about the five foot easement and that was not the easement in question for this variance. There being no additional comments from any citizen or from the board members, The Chairman declared the hearing closed at 7:11 p.m. #4 Consider and take action on the above request from Mr. Bauman. Mr. Greenwald moved to approve the request by Mr. Bauman for a five foot exception to the side yard requirement, since he had withdrawn his request for the deck exception. Mrs. Stanhope seconded the motion, which carried as follows: AYES: Mr. Greenwald.
