ccreg 10-15-1991 ~ [.J a REGULAR MEETING OF THE CITY COUNCIL OCTOBER 15, 1991 The Schertz City Council convened in Regular Session, Tuesday, October 15, 1991 at 7:12 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Pro Tem Joe Potempa, presidingi Barbara Stanhope; Mary Marsh; and Ken Greenwald. Absent: Mayor Earl W. Sawyer and Hal Baldwin. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. Mayor Pro Tem Potempa asked everyone to join him in the Pledge of Allegiance. Mayor Pro Tem Potempa then read and presented a proclamation to Mr. Gonzales and Mr. Richardson of the VFW proclaiming October 21, 1991 as "Country Music Day". #1 B. Special of of 9-17-91. APPROVAL OF MINUTES: A. Special of 8-28-91 Regular of 9-3-92. C. Special of 9-3-92. D. 9-10-91. E. Special of 9-11-91 and F. Regular Mrs. Marsh vote: Stanhope moved to approve the minutes as listed. Mrs. seconded the motion, which carried with the following AYES: Councilmembers Potempa, Stanhope, Marsh and Greenwald. NAYS: None #2 HEARING OF RESIDENTS: A. Mr. Glenn Rowland of 709 Aviation Avenue questioned why he had to live next door to grass that had not been cut but twice in seventeen years. He said he had talked to both the City Inspector and the City Manager regarding this. He had had snakes in his pool and considered the adjoining property a health hazard. He indicated the owner had died and the property is in the hands of a Realtor now and he had assumed they would want it cleaned up but it still has not been touched. Mr. Sweatt said this is situation over a number planted this cane in years way it can be removed is to a long term and continuing of years. The property owner passed as a screening. The only be dug out. Mr. Rowland said when Mrs. Deloney died the property was left to her uncle, who lives in Mathis. Mr. Sweatt said that as far as we can determine, this is not classified as grass but cane. We have contacted the Realtor and notified them it must be removed. We have not heard back from the Realtor so we will have someone go in and thin the cane and clean up the easement. Then we will file a lien against the property. #3 ORDINANCE: Mayor Pro Tem Potempa introduced an ordinance and read the caption as follows: ORDINANCE NO. 91-T-13 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS ESTABLISHING THE SCHERTZ BUSINESS PARK AS A REINVESTMENT ZONE Mrs. Marsh moved Schertz Business Stanhope seconded following vote: to approve the ordinance establishing the Park as a reinvestment zone. Mrs. the motion, which carried with the AYES: NAYS: Councilmembers Potempa, Stanhope, Marsh and Greenwald None #4 ORDINANCE: The Mayor Pro Tem introduced an ordinance and read the caption as follows: ORDINANCE NO. 91-T-14 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, APPROVING A TAX ABATEMENT AND A TAX ABATEMENT AGREEMENT FOR AND WITH ROBERT VALLANCE SR., A PROPERTY OWNER IN THE CITY OF SCHERTZ Mrs. Marsh moved to approve the ordinance granting a tax abatement to Robert Vallance, Sr. for the property located at #3 Commercial Place. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: NAYS: Councilmembers Potempa, Stanhope, Marsh and Greenwald None Mayor Pro Tem Potempa welcomed Mr. Vallance into the City, adding that he is very impressed with his work and relations with the community. #5 NOMINATION: Consider and take action on nomination to the Guadalupe County Appraisal District. Mr. Sweatt reminded that each taxing entity who is a member of the Guadalupe County Appraisal District is entitled to make nominations. Once the nominations are received, the ballot will be prepared and delivered to each entity by October 30th. Then between that date and November 15th each taxing jurisdiction is eligible to cast their vote. The City of Schertz has 195.5 votes compared with the Seguin Independent School District which has 1882 votes. Mrs. Stanhope nominated Mr. board. Mrs. Marsh seconded following votes being cast. Stewart nomination, for with this the ....t fi v....."P AYES: Councilmembers Stanhope, Marsh and Greenwald NAYS: None #6 CONTRACT: Consider and take action on awarding a Uniform Service Contract. Mr. Sweatt stated we solicited bids for furnishing uniform service for a two-year period. Our current contract had expired. Five proposals were received for this service. After review of the bids, we recommend the bid be awarded to Dickie Uniform Service for a two-year period. Mrs. Marsh moved to approve the bid of Dickie Uniform Service. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmember Potempa, Stanhope, Marsh and Greenwald. NAYS: None #7 LOT CONVEYANCE: acceptance of conveyance Subdivision by Mrs. A.D. Consider and take action on the of a lot in Live Oak Hills Mills. Mr. Sweatt said that Mrs. Mills, who is the owner of Lot 10 in Live Oak Hills Subdivision, has offered to convey this lot to the City if the City would pay the back taxes on the property. The taxes total approximately $200. We currently own four other lots in the general area and recommend acceptance of this lot. Mrs. Marsh moved to accept conveyance of this lot from Mrs. Mills. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Stanhope, Marsh and Greenwald NAYS: None #8 BVYA CONTRACT: Consider and take action on the proposed BVYA Contract. Mr. Sweatt advised that a proposed contract between the City of Schertz and Buffalo Valley Youth Association (BVYA) has been updated. The contract will take effect October 1st and run through September 30, 1992. This is somewhat different from the current contract that was for a limited period. This will provide for year-round youth activities, which would allow them to provide a second season. The contract also reduces the amount of kilowatt-hours furnished by the City. This contract has been reviewed and accepted by BVYA. Mr. Greenwald added that he had met with BVYA and the current board is in agreement with the contract. They are looking for church leagues with BVYA being hosts. If this contract does not work out, we might want to go back to the original contract in the future. I --~ 39 Mrs. Marsh moved to approve the BVYA contract with the City of Schertz as presented. Mrs. Stanhope seconded the motion. Mr. Sweatt said that the contract does require the days around the 4th of July be left available in case we may need the use of the fields. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: NAYS: Councilmembers Potempa, Stanhope, Marsh and Greenwald None #10 P&Z RECOMMENDATION: Consider and take action on rectifying recommendations of the Planning & Zoning Commission on Capital Recovery Fees. Mr. Sweatt reminded Council this item had been discussed at workshop previously. P&Z was charged to investigate and make recommendations. They did hold a hearing as stipulated in the ordinance. Their recommendation is that the capital recovery fees remain the same. Mrs. Marsh moved to ratify the recommendation of the P&Z to not make any changes to the capital recovery fees. Mr. Greenwald seconded the motion, which carried as follows: AYES: NAYS: Councilmembers Potempa, Stanhope, Marsh and Greenwald None #11 CITY MANAGER'S REPORT: Mr. Sweatt reminded Council of the Chamber of Commerce meeting in Live Oak. #12 ITEMS BY COUNCIL: Mrs. Stanhope. A. Reminded everyone of the annual Senior Citizen Bazaar on November 2nd from 9:00 am to 5:00 pm. She then asked Council to volunteer as judges for this event. B. She asked the City Secretary to check on the amount of the prizes the City had given in previous years. 40 Mrs. Marsh. A. Music Showcase at the encouraged all to attend. Reminded everyone of VFW on the 20th of the Country November and B. Reported on the Fire Works Fund, saying she had turned in over $400 in checks, with one contribution being for $200. #13 ITEMS BY MAYOR: Announced that the Mayor would be back for the next meeting. #14 ADJOURNMENT.
