REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 19, 1991
The Schertz City Council convened in Regular Meeting Tuesday
November 19, 1991 at 7:00 p.m. in the Council Chambers of
the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; Joe Potempa; Barbara Stanhope; Mary Marsh and
Ken Greenwald. Staff present were City Manager Kerry Sweatt
and City Secretary June Krause.
Mayor Sawyer welcomed everyone to the meeting and asked them
to join him in the Pledge of Allegiance.
He then introduced Mr. Lewis Borgfeld,
Economic Development Task Force. Mr.
George Barnard and Charles Sharpe forward
of appreciation to both for their efforts

#1 APPROVAL OF MINUTES: A. Special Meeting of
9-25-91; B. BOA Meeting of 10-15-91; C. Regular Meeting
of 10-15-91; and D. Special Meeting of 10-30-91.
Mr. Greenwald moved to approve the minutes of these
meetings. Mrs. Stanhope seconded the motion, which carried
with the following vote:
AYES: Councilmembers Potempa, Stanhope, Marsh and
Greenwald.
NAYS: None
ABSTAINING: Mr. Potempa for the minutes of 10-30-91.
#2 HEARING OF RESIDENTS: Mr. Al Putnam, Tom Wade,
Doug Harris, Paul Atkins and Don Young of the Randolph
Masonic Lodge #1268 AF&AM presented Mayor Sawyer with their
very first Community Builder's Award for his service to the
community.
B. Several citizens from the Schirmerville area appeared to
thank the City for their efforts made to repair the roads
and the completion of the water line to their area. They
said they were proud to be a part of the City of Schertz.
C. Mr. Borgfeld said it was so refreshing to hear citizens
come in and share their appreciation with the Council.
#3 PUBLIC HEARING: Mayor Sawyer opened
hearing at 7:10 p.m. to receive citizen input on
amendment to the Zoning Ordinance regarding
setback for accessory buildings.

Mr. Sweatt advised this ordinance was more for
clarification than change. There has been some confusion in
the requirement of placing accessory buildings three-feet
from the property line. This is especiallY so in the case
where there is an alley or an easement involved. The
~
amendment will state that a building cannot be placed in the
easement. The Planning & Zoning Commission has held a
public hearing on this and are now recommending approval.
There being no comments from either citizens or Council,
Mayor Sawyer declared the public hearing closed at 7: 12 p.m.

#5 PUBLIC HEARING: Mayor Sawyer opened the public
hearing to receive input from the citizens on amending the
Zoning Ordinance Article II, Section 6, Manufactured Homes.
Mr. Sweatt informed Council that again P&Z had held their
public hearing and were recommending approval of this
ordinance, clarifying the definitions of Mobile Homes and
Manufactured Homes in accordance with Housing and Urban
Development regulations.
There being no comments from citizens or Council, Mayor
Sawyer closed this public hearing at 7:15 p.m.

#7 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:

ORDINANCES, CITY OF SCHERTZ, TEXAS, BE
AMENDED BY REVISING SECTION 7-1/2-54,
EXHIBIT 2 GARBAGE RATE SCHEDULE; PROVIDING
AN EFFECTIVE DATE; AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT.
Mr. Sweatt explained that at the last workshop Mr.
Gutierrez of Alamo Waste had presented their request for a
rate increase under the terms of their contract with the
City. This rate increase is requested because of a mandate
by the State to landfill operators, which went into effect
last September. The rate will increase for single family
residences from $6.47 to $6.92 per month. Throughout the
schedule of rates the increase will be from five to seven
percent in residential areas. The only area that will not
increase is the dry waste roll-off containers.
Mr. Greenwald moved to approve the first reading of an
ordinance amending the Code Section 7-1/2-54, Exhibit 2
Garbage Rate Schedule. Mrs. Stanhope seconded the motion,
which carried as follows:
AYES: Councilmembers Potempa, Stanhope, Marsh and
Greenwald.
NAYS: None
Mrs. Marsh went on record as protesting yet another mandate
by the State that digs into the pockets of the citizens of
this state, specifically this community.

#8 MEMBERSHIP: Consider and take action on membership
in the Canyon Regional Water Authority.
Mr. Sweatt said this was discussed at length at the last
workshop concerning the need to participate, both in short
term and in long term in water planning. Mr. Davenport was
at the workshop and provided information about the plans of
the Canyon Regional Water Authority. This makes a good case
for combined efforts and being able to speak with one voice
in this area for water needs. He added that there are
several items that we need to explore, so he requested that
Council authorize us to express an interest in Canyon
Regional and express our appreciation for the task before us
and authorize staff to develop additional information and
come back to Council within a month.
Mrs. Marsh moved to express our interest in Canyon Regional
Water Authority and to authorize staff to develop additional
information before taking action on this subject. Mrs.
Stanhope seconded the motion, which carried as follows:
AYES: Councilmembers Potempa, Stanhope, Marsh and
Greenwald

#9 CITY MANAGER'S REPORT: A. Have now set the date
for the City's Christmas Party - it will be Friday December
20th at 6:30 p.m at the Community Center. The theme this
year is "A Pauper's Christmas". The attire should be
casual, bum or whatever would be appropriate. He then asked
for RSVP from Council.
#10 ITEMS BY COUNCIL: Joe Potempa presented a
basketball backboard to the City Manager for the Fire
Department from his family. He then issued a challenge for
the City Council to play the firemen at a future date.
Mr. Sweatt thanked him on behalf of the Fire Service,
saying it would be presented to the department head at the
meeting the next day.
Mrs. Marsh said they held the Voice of Democracy
competition the previous evening at the VFW. This year
there were eleven entries, which is many more than
previously. The winner presentation will be made at the VFW
Christmas party.
Mr. Greenwald: A. said Mrs. Vonada gave him a
promotional from TexCaps ( Texas Coronary Atherosclerosis
Prevention Study) and anyone interested in good health and
proper diet, could benefit from this program.
B. He attended the BVYA meeting on Thursday and if their
basketball program is any indication of city size - they are
drawing in excess of 100 additional children this year - 225
and still growing. He then introduced Mr. Ronnie Michalec.

Mr. Michalec said that what is a basketball backboard
without basketballs - so he, on behalf of BVYA presented Mr.
Sweatt with two basketballs for the Fire Department
personnel.
Mrs. Stanhope reminded everyone of the jamboree at the VFW
on Sunday, November 24, 1991 in support of cancer research.
Mr. Potempa announced that the Business Club at the next
meeting on Thursday at noon would announce the winners of
the "Firefighter of the Year: and the "Police Rookie of
the Year.
#11 ITEMS BY MAYOR: Mayor Sawyer announced that the
Masonic Lodge would like to have some good exposure so he
asked the official Newspaper reporter to make arrangements
to take their pictures regarding the award presented.
#12 ADJOURNMENT: On a motion duly made and seconded,
the meeting was adjourned at 7:30 p.m. by Mayor Sawyer.
