ccreg 12-03-1991 REGULAR MEETING OF THE CITY COUNCIL DECEMBER 3, 1991 The Schertz City Council convened in Regular Session, Tuesday, December 3, 1991 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Joe Potempa; Hal Baldwin; Barbara Stanhope; Mary Marsh; and Ken Greenwald. Staff present were City Manager Kerry Sweatt and Deputy City Secretary Alice Austin. The Mayor opened the meeting and asked everyone to join him in the Pledge of Allegiance. Mayor Sawyer welcomed Boy Scout Troop 18 and their leader Mr. Larry White to the meeting. The members of the troop introduced themselves as Andrew Barnes, Jesse Booker, Mathew Reed, Patrick Green and John Santos and advised that they were working toward their Citizenship in Community badges. Mayor Sawyer advised them that he was proud to see them attending the meeting. #1 APPROVAL OF MINUTES: A. Regular Meeting of 11-5-91; B. Special Meeting of 11-13-91. Mr. Baldwin moved to approve the minutes of the Regular Meeting of 11-5-91 and the Special Meeting of 11-13-91. Mr. Greenwald seconded the motion, which carried as follows: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #2 HEARING OF RESIDENTS: Mr. George Mower of 501 Brooks Avenue said that on Friday at 10:30 p.m. he had heard noises in front of his residence and when he looked out he had seen a police officer talking to approximatelY 8 juveniles. He advised that the officer was attempting to get the juveniles to stand on the curb and that the juveniles were taunting the officer. He said that all of the youngsters were smoking and throwing cigarette butts into the street. He said that his questions were did an officer make less than a meter reader, at what age could a juvenile smoke and is it not littering to throw cigarette butts into the street. He said his force have respect. interest is that he would like to see respect and if trained adequately they the police would get 64 Mr. Sweatt advised that an officer's salary is not less than a meter readers. He further advised that he was unsure if there was a law concerning the age a juvenile could smoke. He advised that our officers were trained quite well and that whether to charge someone with littering would be a judgement call on the part of the officer. Mrs. Marsh made the motion to approve the ordinance as read. Mr. Potempa seconded the motion which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None #4 ORDINANCE: Mayor Sawyer introduced an ordinance for final consideration and read the caption as follows: ORDINANCE NO. 91-S-16 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE, NO. 87-S-1, ARTICLE 11, DISTRICTS, BOUNDARIES, OFFICIAL ZONING MAP, NEW AND UNSCHEDULED USES, AND COMPLIANCE REQUIRED; APPENDIX B, DEFINITIONS; AND PROVIDING A REPEALING CLAUSE. ~)ZJ Mr. Baldwin made the motion to approve the ordinance as read. Mr. Greenwald seconded the motion which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None #5 ORDINANCE: Mayor Sawyer introduced an ordinance for final consideration and read the caption as follows: ORDINANCE NO. 91-F-17 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 7-1/2-54, EXHIBIT 2 GARBAGE RATE SCHEDULE; PROVIDING AN EFFECTIVE DATE; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT. Mrs. Mrs. vote: Stanhope made the motion to approve the ordinance as read. Marsh seconded the motion which carried with the following AYES: Councilmember Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None #6 RESOLUTION: Mayor Sawyer introduced for consideration a resolution and read the caption as follows: A RESOLUTION ENDORSING THE EFFORTS OF THE ALAMO AREA COUNCIL OF GOVERNMENTS TO HAVE THE AACOG PLANNING REGION REDESIGNATED AS A REGIONAL WATER QUALITY PLANNING AGENCY. Mrs. Stanhope said that she thought they would be getting more information before voting on this item. Mr. Sweatt advised that since the workshop meeting where they would have discussed this item had been cancelled, he had set it for discussion tonight. He said that approximately 13 years ago AACOG was serving as the planning agency. The government had decertified the COGS in this area. Many other organizations are now certified as water quality planning agencies. There are no longer funds available on the Federal level but with the new charges being assessed by the State there would probably be funds available in the near future. i^~I':'" (';:(.i Mr. Potempa made the motion to table this item and reschedule for next workshop. Mr. Greenwald seconded the motion which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope, Marsh and Greenwald NAYS: None #7 CITY MANAGER'S REPORT: Mr. Sweatt advised that workshop was scheduled for January 1 and asked if Council would like to reschedule to January 2. Consensus was to reschedule. #8 ITEMS BY COUNCIL: Joe Potempa: Advised that, at the last meeting of the Business Club, Lori Flowers had been selected as Officer of the Year and Harvey Seiler had been selected as Fire Fighter of the Year. Mary Marsh: 1. Advised that the Schertz VFW has been selected to host the district Voice of Democracy. 2. Christmas tree lighting on December 5. Ken Greenwald: Need to have crews check decorations on Schertz Parkway as half of the lights are not working. Hal Baldwin: Advised that Susan Hartzog's mother had passed away and the funeral was scheduled for 9:30 am on December 4. #9 ITEMS BY MAYOR: Mayor Sawyer wished everyone a Merry Christmas and a Happy New Year. #10 ADJOURNMENT: On a motion by Hal Baldwin and second by Joe Potempa the meeting was adjourned at 7: 25 ' .m.
