SPECIAL MEETING OF THE CITY COUNCIL
DECEMBER 11, 1991
The Schertz City Council convened in Special Session, Wednesday,
December 11, 1991 at 7:00 p.m. in the Conference Room of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Joe Potempa; Hal Baldwin: Barbara Stanhope: Mary Marsh: and
Ken Greenwald. Staff present were City Manager Kerry Sweatt and
Deputy City Secretary Alice Austin.
#1 HEARING OF RESIDENTS: Micki Tereletsky said that at the
September 10 meeting there was a discussion concerning revamping
the pay scale. She asked if there was a time frame for this.
Mr. Sweatt advised that he was to make a study and present this
to Council during the next budget sessions.
#2 PROCLAMATION: Mayor Sawyer advised that he had a
proclamation to present and asked Mrs. Pope and the DECA group
to step forward. He than read the proclamation proclaiming the
week of December 16-20, 1991 as FREE ENTERPRISE WEEK and
presented the proclamation to Mrs. Pope and the DECA group.
Mrs. Pope advised that their next projects would be to take
fliers around to the malls. They have designed place mats with
free enterprise theme which Pat's Place South would be using for
the next week. They have designed a book mark which they will be
taking around to the public libraries and the school libraries.
She advised that Schertz Bank would be adding stuffers in their
statements that pertain to free enterprise.
Mayor Sawyer then presented Mrs. Pope and all of the eleven
students present with City of Schertz key chains.
#3 Presentation of a grant by Southwestern Bell Telephone
representative to the Schertz Development Foundation.
Mayor Sawyer advised that Mr. Ramos of Southwestern Bell was
present to present a donation to the Economic Development
Foundation. He advised that members were Mr. McDonald, Mr.
Borgfeld, Mr. Shriver, Mr. Weaver and Mr. Sweatt. He then
introduced Mr. Joe Ramos.
Mr. Ramos advised that he worked in the public relations
department at Southwestern Bell. His primary function is to act
as liaison between Southwestern Bell and suburban cities and that
is how he became involved with the City Managers and Councils of
the suburban cities in and around San Antonio. He advised that
one of the programs at Southwestern Bell has to do with economic
development. He added that Mr. Sweatt had made application last
year but our city did not make it. We reapplied this year and
were one of three Texas cities to receive a grant.
Mr. Ramos presented the check to Mr. McDonald.

#5 Discussion of a resolution endorsing the efforts of the
Alamo Area Council of Governments to have the AACOG Planning
Region redesignated as a Regional Water Quality Planning Agency.
Mayor Sawyer said that he felt this item should be tabled for
further study. Council concurred.
#6 Discussion of an ordinance amending ordinance 87-S-9,
Section 5 Duties & Powers of the P&Z by deleting the reference to
the required annual report.

#7 Discussion of an ordinance amending the Code Chapter 10,
Article III "Abandoned, junked property and property found in
violation of ordinance:, Divisions 1 and 2.
Mr. Sweatt advised that there was an original draft in
Council's packet of an ordinance making amendments to the Code;
and that since that time there had been further discussions with
the City Attorney. We have since re-prepared that draft and a
memo had been distributed that includes a draft of an ordinance
that would amend the codeiand a draft of a memorandum of a policy
and procedure statement that would go into detail advising the
code enforcement department as to how the terms of the ordinance
would be enforced. He advised that this would bring us in line
with the State law.
Mrs. Stanhope asked about vehicles used by hunters. Mr. Sweatt
advised that this would be under special interest category but
if they were unlicensed they would have to be covered.

#10 ITEMS BY COUNCIL: Mary Marsh: 1. Briefed the Council
Mrs. Marsh advised that they had a guy in their neighborhood who
was parking heavy equipment or trailers and leaving them there
for several days causing traffic problems. Mr. Sweatt advised
that if it became a traffic hazard the police could give them a
ticket. Mr. Sweatt advised that as long as they were licensed
to be on the street there might not be anything that can be done
but that he would look into it for her.
Mr. Potempa advised that they had a truck which has been parked
on the street for approximately a year. Mr. Sweatt advised that
we would have authority to deal with this vehicle under the
ordinance.
Mr. Baldwin said that on page 2 under abandoned motor vehicles
that he was not sure what 5 years has to do with an abandoned
vehicle. Mr. Sweatt advised that this is part of the State law.
Mr. Sweatt advised that we were also amending section 10-34 to
deal with abandoned property other than motor vehicles placed on
public streets for more than 48 hours.
#8 Discussion of a resolution transferring a certain water
easement to McKinney Homes.
Mr. Sweatt advised that in the original plat of the portion
of Savannah Square that faces on Drayton, we were conveyed an
easement across to Antler Drive where our water storage facility
is located. He said that our original intent was to bring a
water main and connect across to this area to tie into Savannah
Square circulation system. Since then, we have revised our water
master plan and no longer see the need for that particular
easement. He said that McKinney homes proposes to construct a
home at that locationi and the easement conflicts with our side
yard requirements, and that we see no reason to maintain the
easement at this time. We have notified them that if they will
pay for the transfer and replat of the area, we would recommend
to Council that the easement be vacated.
Mayor Sawyer asked who originally gave us the easement. Mr.
Sweatt advised that it was the oriqinal developer.
Mrs. Marsh voiced her concern at additional construction in the
area because of the drainage.
Mayor Sawyer said that we might want to delay for one more
meeting and look at where the property is and what we are talking
about so that we don't add to drainage problem.
Consensus of Council was to reschedule for the next workshop.

#9 CITY MANAGER'S REPORT: Said he would like to remind
Council of the Employee Christmas party on December 20.
'10 ITEMS BY COUNCIL: Mary Marsh: 1. Briefed the Council
on Business Club activities which included the selection of Lori
Flowers as the Police Officer of the Year and Harvey Seiler as
Firefighter of the Year. She further briefed Council on fund
raising efforts toward the fireworks display for the 4th of July
Jubilee. She advised that the Trail Riders would be here on
February 4 and that the Business Club is going to assume some of
the responsibility for promoting the trail ride.
2. She advised that the Herald Newspaper had a new publisher,
his name is Bob Jones and that she had talked to him and that he
was a very delightful person.
3. Sunday at the VFW Christmas party they will be presenting the
scholarships to the three from the Schertz contest and there will
be special recognition given to Joyce Briscoe in the form of a
plaque. The awards ceremony will be at 4:00 p.m.
4. Mrs. Ann Richards has been ill with pneumonia and is doing
better.
Joe Potempa: 1. Asked if the new exit on IH-35 next to Mobile
Villa would be a permanent exit. Mr. Sweatt advised that he
thought this would be temporary.
2. Asked if we were going to hire a new police officer. Mr.
Sweatt advised that we were in the process of interviewing one.
We received a resignation today and will be filling 2 positions.
3. Advised that a maintenance crew was needed in the Mobile
Villa Subdivision as the potholes were getting bad.
Barbara Stanhooe: Advised that she had been contacted by one of
the Scout Masters and that they would like the City to come up
with some Eagle Scout projects. She asked if anyone could think
of a project to let them know.
Mrs. Marsh said to tell them to plan what to do with the vacant
buildings along FM 78.
Mr. Greenwald advised that this must be community related.
Hal Baldwin: Asked if any of our buildings had been sprayed with
graffiti. He said that the janitors used graffiti remover and
got it off immediately. He said that the kids only put it on if
they thought it would stay and if it was removed as soon as
possible, they would quit putting it there. He said that the
graffiti should be removed from the berm wall at the Housing
Authority and the railroad tressel.
Ken Greenwald: 1. Advised that the concrete berm wall at the
Housing Authority was about to fall down.

2. Advised that he would really like to thank Bexar County for
all \~heir help with traffic during the flooding. Mr. Sweatt
advised that they were called and said that they would be out but
they never showed up.
'11 ITEMS BY MAYOR: Advised that both of our roads before
Schertz Parkway were blocked off the same day.
