ccreg 12-17-1991 72 REGULAR MEETING OF THE CITY COUNCIL DECEMBER 17, 1991 The Schertz City Council convened in Regular Session Tuesday December 17, 1991 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The follOWing members were present: Mayor Earl W. Sawyer, presidingi Joe Potempa; Hal Baldwini Barbara Stanhopei Mary Marsh and Ken Greenwald. Staff present were City Manager Kerry R. Sweatt and City Secretary June G. Krause. After opening the meeting, Mayor Sawyer asked everyone to join him in the Pledge of Allegiance. PUBLIC HEARING: Mr. Sawyer explained that the City Council and Planning & Zoning Commission were holding this joint public hearing to receive citizen input on a request by the Schertz-Cibolo-Universal City Independent School District Board to rezone an 11.281 acre tract of land, located on Elbel Road between the Malish Administration BUilding and the Sycamore Creek Apartments, from Neighborhood Services to Public Use District. Mayor Sawyer then introduced Mr. Ollie Burkett, Chairman of the Board and Dr. Byron Steele, Superintendent of Schools. He then called on Jim Shriver, Vice-Chairman of the P&Z. Mr. Shriver asked Steve Simonson for staff comments. Mr. Simonson indicated that staff had reviewed this request and there was no known detriment found. Dr. Steele then presented their request, saying the problem in the school district is one of growth. Bus transportation has increased, they are adding additional jobs and vehicles and need more warehouse storage. They are at the maximum for parking their buses and there are 141 people that park in the area. He mentioned that the gasoline tanks are near the GVEC substation, which is not a good policy. The plan is to locate the 12,000 gallon underground tanks in the center of their property and this would give another much needed entrance. Their plan would prOVide not only the additional 100 parking slots, but also additional storage facilities. This location is centrally located in the district so they would prefer not to move to another location. Dr. Steele pointed out that they would not immediately be using the area within 395 feet of the apartments and when they do, looking at their past record, anythinq they would do would be acceptable. u~ " ) Mrs. Marsh pointed out that their plans would have to be approved by the City at any rate. Mr. George Barnard, representing Guadalupe Valley Electric Cooperative, advised that they saw no detriment to GVEC or the community. He added that they like to see thinqs happen and would support the school district. Mr. Shriver then asked if any citizen would like to comment on this request - there were none. Mayor Sawyer advised that forty-five letters were mailed to property owners within the three-hundred foot area. One was returned by the Post Office, six were returned in favor of the request and three were against it. Mr. Shriver said the P&Z would move to the Conference Room immediately after adjourning the public hearing; and although they have ten days to make their recommendation to the Council, he felt they would be able to make their recommendation at this meeting. Mayor Sawyer declared the public hearing closed at 7: 15 p.m. and asked for a short recess. The Regular Meeting was reconvened at 7:25 p.m. #1 APPROVAL OF MINUTES: A. Regular Meeting of 11-19-91 and B. Regular Meeting of 12-3-91. Mrs. Marsh moved the minutes of the regular meeting of November 19, 1991 and the regular meeting of December 3, 1991 be approved. Mrs. Stanhope seconded the motion. Mr. Potempa that the eighth paragraph under item #10 of the minutes of the meeting of November 19th be corrected to show that the Business Club announced the winners of the "Police Officer of the Year" rather that the "Police Rookie" as shown. Mayor Sawyer then called for a vote on the motion and motion carried as follows: the AYES: Councilmembers Potempa, Baldwin (meeting December 2, 1991), Stanhope, Marsh and Greenwald. NAYS: None ABSTAINING: Mr. Baldwin for the minutes of meeting of November 19, 1991. of the #2 HEARING OF RESIDENTS: Mr. Lewis Street of Cedar Lane advised that he is on the Board of their Owners Association at Woodland Oaks and is a member of Schertz Police Academy. He expressed his appreciation allowing the development of the Police Academy, who has members from this area. He said this academy has done outstanding job of expanding everyone's knowledge 2604 Home the for 27 an and 74 developing community relations. This provides a means of letting everyone know, not only what the police are doing but also other things through the Hayor, Mr. Sweatt, the Assistant City Manager and others who have volunteered their time. He said they have approximatelY 400 home owners in Woodland Oaks, 1500 or 1600 residents including the children. They publish a monthly newsletter delivered in their subdivision and there is an article in this month's letter letting everyone know what an outstanding job the police and city leaders are doing to bring the city together through volunteer services. Mayor Sawyer thanked Mr. Street, adding that Council feels they have a very good staff in the city. #3 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 91-S-18 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ORDINANCE CREATING THE PLANNING AND ZONING COMMISSION NO. 87-S-9, SECTION 5 "DUTIES AND POWERS" PARAGRAPH 10i AND PROVIDING A REPEALING CLAUSE. Mr. Greenwald, moved to approve the ordinance repealing the requirement for an annual report. Mrs. Marsh seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Marsh and Greenwald. NAYS: None Baldwin, Stanhope, #4 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 91-D-19 AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 10, ARTICLE III, "ABANDONED, JUNKED PROPERTY AND PROPERTY FOUND IN VIOLATION OF ORDINANCE"; DIVISION 1 "GENERALLY" AND DIVISION 2 "MOTOR VEHICLES" OF SAID CODE AND REPEALING DIVISION 1, SECTIONS 10-51 THROUGH 10-50 AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE. Mr. Baldwin moved to adopt the ordinance amending the Code on Abandoned and Junked vehicles. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None I -~ 75 #5 REZONING REQUEST: Consider and take action on the P&Z recommendation on the request by the SCUC ISD Board to rezone property on Elbel Road. Mr. Sweatt read the recommendation from the Zoning Commission approving the request by District to rezone the property on Elbel Road. Planning & the School Mrs. Marsh moved to approve the Schertz-Cibolo-Universal City Independent rezone the property on Elbel Road. NAYS: None ABSTAINING: Mr. Baldwin #6 EXECUTIVE SESSION: Mayor Sawyer called at Executive Session at 7:17 p.m. under Article 6252-17, Section 2 (0) Vernon's Texas Civil Statutes to discuss personnel matters. The regular meeting was reconvened at 9:10 p.m. #7 Consider and take action, if any, on the above Executive Session. Mayor Sawyer advised that Council did discuss personnel matters but there was no further action to be taken. #8 CITY MANAGER'S REPORT: A. Reminded Council that the Fire Department had extended them an invitation to visit the Fire Station after this meetino for hot tamales. B. The library hours on Christmas Eve and New Year's eve will be changed to 10:00 am to 5:00 p.m instead of the noon to 9:00 pm. C. On Christmas Eve and New Year's Eve, assuming the volume of business will allow, one-half of the employees (excluding emergency services) will take half days off on alternate days. D. Announced that the next day at 10:45 a.m., the Corbett band would perform Christmas carols in the lobby. #9 ITEMS BY COUNCIL: Mr. Baldwin wished everyone a Merry Christmas and Happy New Year.
