ccreg 02-04-1992 100 REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 4, 1992 The Schertz City Council convened in Regular Session, Tuesday, February 4, 1992 at 6:00 p.m. in the Council Chambers of the Hunicipal Complex, 1400 Schertz Parkway, Schertz, Texas. The fOllowing members were present: Mayor Earl W. Sawyer, presidingj Joe Potempaj Barbara Stanhope; Mary Marsh and Ken Greenwald. Absent: Hal Baldwin. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. After welcoming everyone to the meeting, Mayor Sawyer asked them to join him in the Pledge of Allegiance. Mayor Sawyer then called on Mr. Potempa to make some presentations. Mr. Potempa, representing the Schertz Business Club, commented that they were a little behind in aCknOWledging "Employees of the Quarter" for some very deserVing people. He added that it had been a good two years as President of the Schertz Business Club because it gave him the opportunity each quarter to recognize some of the finest people that work for the City. Each quarter a nominating committee selects a person to receive the recognition for outstanding contributions to the City. Receiving the plaque for the quarter April through June was Street Department employee Marcello Garciaj for the quarter July through September, Mark SChupp, Warrant Officer in the Police Department received the plaque and for October through December, Barbara Glenewinkel, Court Clerk was the recipient, but was unable to attend because of high water and flooding. Mayor Sawyer expressed the congratulations of the Council. Mr. Sweatt announced that each recipient would also receive from the City a day off, depending on Departmental schedules, and a meal for themselves and a guest. #1 PUBLIC HEARING: Mayor Sawyer opened the public hearing stating that the purpose was to obtain the views of the public on the proposed annexation of three tracts of land out of Guadalupe County, containing approximately 250.96 acres. Mayor Sawyer then asked if there were any citizens wishing to speak on this subject. Ms. Londa Phillips, Mr. Odo Riedel's assistant, said she had a statement Hr. Riedel wished her to read: "To the Schertz City Council from Odo J. Riedel. Even though I did not receive any type formal notification of the proposed annexation proceedings of a portion of my Pecan Grove Mobile Home Park, I fully understand the reasoning behind this move. HopefUlly, this will help make Schertz a better city in which to live and work. Thank you." ~ Mayor Sawyer thanked Ms. Phillips for coming and asked that she also thank Mr. Riedel. There being no other citizens wishing to speak either for or against this proposal, Mayor Sawyer declared the Public Hearing closed at 7:04 p.m. #2 APPROVAL OF MINUTES: A. Regular meeting 1-7-92 B. Special Meeting 1-15-92 Mrs. Marsh asked that the spelling of Retired General Robert T. Harres be corrected, under item #9 (c) of the minutes of January 15, 1992. Mrs. Marsh moved to approve the minutes of the Regular Meeting of January 7th and the Special Meeting of January 15th, 1992 as corrected. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Stanhope, Marsh and Greenwald. NAYS: None #3 HEARING OF RESIDENTS: A. Mr. Gus Escobar, 4405 Crown Oak, wished to express his opinion about the City's investigator. On December 22, 1991, they made a report about some stolen property that was seen by both he and his wife. He said he had called several times and the investigator has not returned his call. He talked to the investigator a week after that but he also called several times later and has not had a return call. He said this involved a burglary of his home on the 3rd of June. Mayor Sawyer advised Mr. Escobar to rest assured that staff will look into this and so advise him. Mr. Escobar said it always seems to be the same routine. When there is a burglary in Schertz a couple of weeks later the people get a call by investigator that he had seen some jewelry and asked them to go look at it in Marion. Mr. Sweatt said he would look into the case and call him the next day. B. Chris Cabanski of 3701 William Scarbrough in Savannah Square advised that at the meeting of their Home Owner's Association, it was overwhelmingly agreed that they would like to see the speed limit on Savannah Drive reduced from 30 miles per hour to 20. She reported that they had the Chief of Police at their meeting and he was wonderful and they really appreciated him being there. They have the problem where the school bus lets children off and they have to cross the street, which is hazardous. 102 Mayor Sawyer asked that this item be placed on the next workshop agenda for discussion. Cabanski also said her group would like to sign at Habersham and Ogelthorpe changed to see a the Stop Mayor Sawyer Caban ski coming discussed. explained that he would appreciate to the next workshop, where this would Ms. be #4 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY ADDING TO CHAPTER 5, ARTICLE IV, PLUMBING, SECTIONS 5-47 ADOPTION OF THE MANUAL OF CROSS-CONNECTION CONTROL, 5-48 BACKFLOW AND CROSS-CONNECTION GENERAL POLICY, 5-49 BACKFLOW PROTECTION FOR WATER HAULING EQUIPMENT AND/OR MIXING TANKS, 5050 INDOOR PLUMBING FIXTURES AND INSULATION OF EXPOSED HOT WATER PIPING; AND PROVIDING A REPEALING CLAUSE. Mr. Greenwald moved to approve the first reading of an ordinance amending the Plumbing Code regarding backflow protection and water saving fixtures. Mrs. Stanhope seconded the motion, which carried as follows: AYES: Councilmembers Potempa, Stanhope, Marsh and Greenwald NAYS: None #5 BID AWARD: Consider and take action on awarding bid for Community Center roof project. Mr. Sweatt remarked that in accordance with the Charter requirements, we have solicited bids for roof repair at the Community Center. The building is gOing on twenty years old and we have been having problems. We solicited bids for removal of the loose aggregate and replacement with a foam material. The company has done work for us in the past on a smaller scale and has a good reputation according to our consulting engineer. Although there are other firms that are said to be in this line of work, we have traced it down and apparently all the other firms sub from this company. He said we believe this represents a good bid and recommend awarding the bid to Foam and Coating Inc., in the amount of $5890 to replacement of the Community Center roof. f I I I ~ -~ r~ 6~ ":'-'-.,'U Mrs. Stanhope moved to accept the bid of Foam and Coating Inc. in the amount of $5890 to replace the roof on the Community Center. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Stanhope, Marsh and Greenwald NAYS: None #6 RESOLUTION: Mayor Sawyer introduced a resolution and read the caption as follows: RESOLUTION NO. 92-R-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CONTINUING THE CITY'S OPPOSITION TO THE STORAGE AND BURNING OF HAZARDOUS WASTE AS FUEL BY THE LAFARGE CORPORATION AND/OR THE SYSTECH ENVIRONMENTAL CORPORATION AT ITS CEMENT MANUFACTURING FACILITY LOCATED IN COMAL COUNTY. Mayor Sawyer advised he would like to remove the paragraph dealing with expenditure of funds. Mr. Sweatt handed the Mayor another resolution with this portion removed. Mr. Potempa moved to approve the resolution storage and burning of hazardous waste Corporation. Mrs. Marsh seconded the motion, with the following vote: opposing the by LaFarge which carried AYES: Councilmembers Potempa, Stanhope, Marsh and Greenwald NAYS: None #7 CITY MANAGER'S REPORT: None at this time. #8 ITEMS BY COUNCIL: Mrs. Marsh announced the 30th Annual Trail Riders dinner/dance was taking place at this time at the VFW and invited everyone to attend. #9 ITEMS BY MAYOR: He had received a letter from a citizen complimentary to the police department and would have the City Manager make copies for Council. He also received a letter from Cindi Krier saying she supports the Council's position that we would not want to be split as far as our senatorial districts go. She has offered us her support. 10;1 #10 ADJOURNMENT; On a motion by Mr. Potempa, seconded by Mrs. Marsh and unanimously carried, the meeting was declared adjourned at 7:17 p.m. by Mayor awyer.
