Wednesday May 13. 1992 at 7:00 p.m. in the Conference Room of the Municipal Complex. 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Joe Potempa; Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. #1 HEARING OF RESIDENTS: Bill Neller - A. As of date he had collected 28 flags for retirement at ceremonies in June and Sgt. Tuttle at Randolph has This should be a big ceremony and he requested as much coverage as possible. this the 27. news B. The flags will be flown on Main Street on Armed Forces day. #2 SWEARING-IN-CEREMONIES: A. The City Secretary swore into office Earl W. Sawyer. Mayor; Joe Potempa, councilmember Place 1 and Hal Baldwin, Councilmember Place 2. B. Mrs. Krause then swore Barbara Stanhope in as Mayor Pro Tem. #3 Review of Animal Shelter construction plans. Mr. Sweatt presented the proposed final construction plans. He advised this plan had been reviewed by staff, it had been discussed with the Humane Society and believe it embodies all the proposed changes and improvements that have been discussed for over one year. He reminded Council that the City had bought 1.7 acres of land along Borgfeld Road and adjacent to the drainage detention basin above Dobie School. He then went over the plans in detail with Council. The fence. which encloses the property, is a six foot chain link with three strands of barb wire. This is needed to secure the property because of the remote location. The facility will have twenty two runs. including two quarantine runs. He ended by saying staff believes this was designed for ten to twenty year before any expansion would be necessary. Mrs. Marsh asked if we were ready to go out for bids and was informed that is the purpose of bringing this to Council at this time. After discussion of the plans. Mayor Sawyer asked if Council was ready for the City Manager to go out for bids. Council consensus was to press forward. .i~ .f tj Mr. Ed Ford. Enaineer. advised that it would take about fifteen days for advertisina. then the review of bids ana gettina back to Council would take another ten days so it would be about thirty days before construction could beain. Then it would take about sixty days for construction. Mr. Sweatt added that the Humane Society has volunteered and offered to assist in furnishing this facility and helping with landscaping. #4 Presentation of request by the. Civilian Police Academy Alumnus Association. Ms. Pam Harris, representing the Civilian Police Academy Alumni Association. informed Council they would like to have a bar-b-que type function at the large pavilion in the City park. It would be along the lines of the Fire Department Annual Supper. They would solicit donations for the food and funs events to try to raise some money for the Academy. This would be open to the public. Mayor Sawyer asked if they were asking for the Council tc donate the use of the oavilion for this event and they said yes they were. Mayor Sawyer then advised that they would have to make arrangements for use of the kitchen. tables and chairs with the Fire Department Volunteers. Chapter 10. Article VI Garage Sales. Mrs. Marsh had received a call saying this was really needed and that the lady had one suagestion before finalization. There are folks who only have one garage sale a year and it makes it difficult for them to have it on only two days. The lady suggested letting them have it for three davs. ML. Greenwald sugcested leavina the ordinance as is and try it for six months to see how workable it is. Mavor ana COlIne 11 ac::reed. #6 Discussion of release of Waste Discharge Permit on Dry Coma I . Mayor Sawyer advised that we would like to release this permit as we already have an agreement with New Braunfels. Mr. Baldwin asked if our New Braunfels agreement was solid so that they can not cut us off. 1.~..a. l I,? Mr. Sweatt said when we pay, we will be buying capacity so we will have twenty-five percent ownership in the plant. Mayor Sawyer said he felt the City could do away with the extra staff work involved in this renewal of permit. since he could not see any way that we would be using it. Consensus of Council was to not renew the permit as it would not be necessary for the City in the future. #7 Discussion of resolution pertaining to Lookout Road improvements. Mr. Sweatt said that several items have continued to occur as we have discussed a requested resolution regarding Lookout Road improvements. The big issues have been that there have been a change in some Federal guidelines, in which the Metropolitan Planning Organization, created by Federal statute requires planning for federal and state roadway improvement funds. has been given the authority to prioritize and designate certain projects as eligibility for federal and state highway improvement funds. The Metropolitan Planning organization has set May 15th as the deadline for 1992-95 highway construction program. So there is a big rush to get projects into them for prioritizing and funding through 1995. Bexar County in conjunction with others have proposed improvements to Lookout Road in the Retama Park area. We have discussed this requested resolution on several occasions. One of the proposals recommended was to widen and extend Lookout Road across Schertz to connect with FM 3009. We have voiced some concerns on several occasions to that; but there continues to be requests from other entities for Schertz to support that project. They have asked that we bring this issue back to you before the May 15th deadline. Staff has drafted a resolution that we believe represents the general consensus of Council's concern in the past. The resolution basically says we understand Bexar County has submitted an improvement project and we agreed that Lookout Road needs some improvements and we would like to see the Texas Department of Transportation do that. Because of a lack of funds, we expect the right of way, utility adjustments and drainage costs would be borne by others and that prior to final design the oroject would be subject to City of Schertz routing approval. Mayor Sawyer said that is what Council wanted to say - that we will support it but we will not expend tax payer monies for this project. #8 Discussion of relating to cameras. in-store security requirements Mr. Sweatt great deal ground. We have secured some information from the State of Florida, who recently enacted a statute dealing with this issue. Mr. Spain's letter says that Florida's act requires that stores must place the devise if there have been certain occurrences in that iurisdiction. Once there have been robberies in that jurisdiction. it requires all stores to take these security precautions. Camera was only one part of the regulation. The constitutional issue has not been tried in court. Florida requires cameras in any store that is open between the hours of 10:00 pm and 5:00 am - which is pretty reasonable time frames. We have about four that are twenty-four hour operations. Of the four. at least one is currently making provisions for cameras already. After Council discussion. Mayor Sawyer reminded them that if this ordinance was challenged in court, there would be some expense. Council aareed the existing businesses should be incluced in this ordinance giving them 180 days to comply. #9 CITY MANAGER'S REPORT: A. Mark your calendar and plan to attend the brief Police Memorial Ceremonies on Friday at 11:30 am. It is really going to be an impressive ceremony. B. Briefly went over our proposals to the new MPO. sayina this is tne new buzz word in highway planning and funds. We have divided our needs and wants into two different elements. For the 1992-1995 transportation improvements program. we have prioritized our projects and have furnished to them our estimated costs. As a separate element, we have prepared a long range plan for additional projects to be picked up in the end of the 1995 oeriod and extend into the year 2002. The list of proiects are: 1. FM 3009 from FM 78 to 1-35 widening and improvement - $3.987,000, the engineering and survey has already been accomplished. 2. Doerr Lane from Associate Drive to the MK&T Railroad. widen and improve - $113. 500 and the enaineering work has already been accomplished. 3. FM 78 widen and improve. including the bridge at Cibolo Creek to FM 3009 - $4.753.750. with a portion of the engineering and surveying working having already been accomplished. 4. Alternate bridge for the low water crossing at Aviation and FM 78 - $1.300.000, including engineering costs. 5. Lower Seauin Road. widening $860.000, Segment 1 from FM 1518 to Loop 1604 includes engineering and surveying costs. \ 1 '78" ,,- , Beginning in 1995-96 we submitted the following projects: 1. Second phase of Doerr Lane from the Railroad to FM 2252 - $193,000. 2. Segment 1 of Schertz Parkway Improvement from 1-35 to Lookout Road - $219,700. 3. '96-97 Segment 2 of Schertz Parkway improvements from FM 78 to FM 1518 - $2,463,000. 4. '97-98 - extension of Green Valley Road and Woodland Oaks Drive from the current city limits to FM 1103 1.300,000. 5. '97-98 - Lower Seguin Road. Segment 2 from FM 1518 to cibolo Creek, including a bridge - $1.293.000. 6. '98-99 - Segment 3 of Schertz Parkway from 1-35 to Live Oak Road, widening and improving - $921,000. 7. '99-2000. Segment 3 of Lower Seguin Road. from cibolo Creek to FM 78 - $477,000. 8. '99-2000 FM 3009 from FM 78 to Lower Seguin Road. $3,500.000. 9. '99-2000 - Woodland Oaks Drive from Cotton King to FM 1518 - $1.114,000. 10. 2000 - 2001 - Ware Seguin Road from Loop 1604 to FM 1518, $952.000. 11. three projects for year 2001-2002. Segment 4 of Parkway from Lookout Road to FM 2252 - $1,353,000; FM 1518 from 1-35 to FM 78, widening and improving finishing up our estimates today on this. Schertz improve - we are Mr. Sweatt ended by saying staff believes these are our most current master street plan needs as we see the growth of the community. It is by no means all the streets that have been recommended by P&Z and Council but the highest priority. C. The new Lion's Club has proposed a unique fund raiser - they have reserved the large pavilion from 7 am to 6 pm May 30th to hold a city-wide garage sale. D. This is a worthwhile addition in that it not only allows citizens to find out about city Government but also to find out about community affairs but most important is that citizens can call and leave a message for Council and staff. F. CPS is hosting a June 3rd Economic Development seminar at the San Antonio Airport Hilton from 8:30 am to 1:30 pm. The recent letter the city sent to residenLs of Mobile Villa mentioned something about seotic tanks. He said there are still some undeveloped lots up there and it said something about you can not put in a septic tank unless YOU have at least an acre or more land. Mr. Sweatt said the State Health Department has regulations about size of lots. If they want to get a permit, they can contact our Inspection Department who will help them with their contact with the County for the permit. Mrs. _Sti3.Dh9P~: A. Mr. Sweatt said there are some funds but they have decided to take more of those funds for their own operation. C. He received a telephone call from a gentleman who said there is a young man across the street from him has a car with these huge speakers. He turns the music on when he \ '-. Mr. Greenw~~~ asked if there had been any feedback from the Regional Solid Waste meeting held the previous night. Mr. Sweatt said Mark Marquez went to the meeting but has not reported on it yet. #11 ITEMS BY MAYOR: A. On Pfeil Road there bridge with about an eight foot drop. This is on an Central School Bus route. is a East Mr. Baldwin said this is a real dangerous situation. The East Central School bus goes there and if they had a substitute driver, who did not know the route. it could cause a very bad accident. There is no shoulder at all and a bus would rollover if it hit the drop. Mayor Sawyer said we need to take a strong look at this because it is extremely dangerous situation. Mayor Sawyer continued to report on questions raised at a meeting in the Schirmerville area he and Mr. Baldwin attended. They were concerned about drainage on Lower Seguin Road at FM 1518; they feel our crews are putting more work on water tower Road than the other roads in the area. They said there is a man in the area who is a qualified heavy equipment operator and they wonder if there was some way we could hire this guy to do some work down there; they asked if the city is still trying to catch the people who tear up the roads; they said the Fire Department personnel should know where the fire hydrants are and where the people live in the area; they wonder why we cannot do both sides of the bar ditches. These are some of the things they brought up at the meeting. Mr. Baldwin said one man said the construction of the bar ditch caused his property to flood and make a lake on his land. Mr. Sweatt said we have talked with the man and the problem is that the land is just too flat. Mayor Sawyer said that when we brought them into the City we really did not promise them anything and we have done a lot more than San Antonio ever did. However, the safety of school children is very important and we should try to do something about this. B. What they want is to box up dinners and have people drive by and pick them up and go so they want the traffic to flow. But if we closed off the 0001. what are our kids going to do. Mr. Baldwin said that a lot of their kids come down and use the pool while they are working at the supper. E. Mr. Street has indicated that he wants to volunteer for one of our organizations.
