SPECIAL MEETING OF THE CITY COUNCIL
MAY 27, 1992
The Schertz City Council convened in 50ecial WorksnoD
Meetina Wednesday, May 27. 1992 at 7:00 p.m. in the
Conference Room of the Municipal Comolex. 1400 Schert=
Parkway, Schertz. Texas. The following members were
present: Mayor Earl W. Sawyer, presiding; Hal Baldwin;
Barbara Stanhooe; Mary Marsh and Ken Greenwald. Staff
present were Kerry Sweatt. City Manager and June Krause,
City Secretary.
# 1 HEARING OF RESIDENTS: E3ill_NeU~r: A, A.dv ised
the flags will be flown on Main Street, Saturday for the
traditional Memorial Day and were flown the previous Monday
for legal holiday.
B. So far. he has received 23 American flags, 11 Texas
flags and four small flags to be destroyed on Flag Day.
Sgt. Tuttle at Randolph has about 30 flags to be retired
Mr. Neller asked if staff could contact our Senator or
Representative to see if they would attend the ceremonies.
He had contacted the Herald Newspaper but they said they had
no one on duty on Sunday so we would have to take our own
pictures. Sgt. Tuttle said he would take pictures.
C. Everyone is invited to the Audie Murnhy Veteran's Day at
the VFW the next day at 10:30 in the morning.
Mr. O~o Riedel said he and others in the neighborhood had
had problems for some time with the drainage ditch off FM
78. The last two heavy rains caused flooding of both his
property and the Freabe Mobile Home Park. He said it was
not their fault - it was put in that way by the City and
something needs to be done about it. On the last two
flooding situations, the water did not come up from the
creek but from the drainage ditch. He said they did not
expect an answer this night but do expect to hear something
positive pretty soon.
Mayor Sawyer said we will have our engineer look at it anc
will keep them informed.
Mr. Sweatt said that Mr. Riedel indicated in his letter
that there was some engineering work done three or four
years ago; but our engineer does not remember dOing
anything down there.
Mr. Riedel questioned a remark supposedly made by our Fire
Department employees about them not having anything to do
with notifYing the oeople of flooding. He said they have
older people in the park that need some advance notice of
flooding. He said that if the Beck Concrete neople would
agree, they could bank both sides of the ditch and that
would be a qood deal.

Mrs. Friesenhahn said right now she has the material to do
this free; but it would not be available too long.
#2 Presentation of curb painting project by Ms. Janet
Roberts and some youth from the Morman Church in Windcrest.
In Ms. Roberts absence, Deanna Wolf gave a brief outline of
what they intended to do. There will be about 200 youth
from Universal City, Live Oak, Seguin and Schertz involved.
On June 10. the group would be leaving door hangers
explaining they will be painting house numbers on the curbs
free of charge; and if someone does not want it done leave
the door hanger in place. Then on June 12th they will paint
the numbers on the curbs. They will be wearing T-shirts
with the church name on them for identification.
Mr. Sweatt said that based on our best calculations. the
organization could handle up to two thousand curbs
numberings. We will provide maps showing the large area of
the central city and several different subdivisions and
still stay close to the 2000 accounts. They will just
by-pass the curbs that already have numbers on them.
Mr. Danny Brown. one of the sponsors. said this is just
of the many things these youths do. He explained

groups of ten and will be supervised by two adults.

Mr. Brown said originally they had planned to repaint
someone's home that looked in need or paint some fire
hydrants but this seems to be the best project for them.
Mr. Sweatt said staff felt this is an outstanding project.
He said we have had scout projects in the past but never
have we had a group come in and say "We want to do something
for the community". After the project is completed. we
would like for Mr. Brown and Ms. Roberts to come to a
meeting to be recognized.
#3 Discussion and action regarding Vision 8 Committee
recommendations for citizen recognition program.
Mrs. Stanhope said their committee had already accomplished
the installation of the telephone mailbox and the bulletin
board out front and now have come up with a program for the
"Star of the Month". She showed the design of the star.
saying they wanted nominations from the community of persons
who have done something that makes this a better place in
which to live. The nominations will be submitted to the
City Secretary no later than the 5th of each month.
selection will be made on the 15th in order to get the
publicity out for the first of the month.

The Sele~tion Board will be made UD of at least one member
of the Visic,n 8 Committee. ,.:me member of the City Council
and one citizen; but it may have up to five members. The
nominee should be someone who has done somethinc that
benefited a single oerson or a group. The nominee does not
have to be a citizen of Schertz but the Derson s~bnittina
the name should be from Schertz.
Mrs. Stanhooe said they would like to je able to Give th3
re~ipient a button to wear everywhere. These WOUla:osr:
approximately twenty dollars a year. Some ousinesses said
they would give floral arrangements. Of the 12 monthlv
"Stars" one would be selected as thE~ "Star of the Yea,r"3.rd
that recognition could be given at the B~siness Club Annual
Appreciation Dinner. She said she needed aporoval 0: the
p~ogram from ~ouncil and approval from Council for a $100
line item ir the budoet for this. They would li~e to get
this started in June. with the first "Star" being for July.
Then we could have the Mayor Dresent a proclamation at the
4th of July Jubilee. Mayor received concensus of Council to
set aside the $100 for this pro4ect.
A~ter discussion. Council agreed this should be a five
member Selection Board comnosed of one staff member, two
Vision 8 members. one Council member and one citizen. Mayor
Sawyer suggested the Mayor Pro Tern be the Councll Member
since tney wanted the committee to rotate every six months
and that is the rotation of the Mayor Pro Tern. Mr. Sweatt
to recommend a member of staff for this board.
#4 Discussion of public hearings set for June 2nd on
the following proposals:
A. Amending the zonina ordinance regarclna Special Distric~
for Schertz Parkway from East Live Oak Road to within 750'
of IH-35 right of way.
Mr. Sweatt said this came as a recommendation from P&Z and
staff that we take a long look at the rules. covenants ana
restrictions with a view of orotecting the appearance of t.le
roadway. It was suggested that we look at a literal zorina
category that WOUld adopt a set of rules that would be
appropriate to Schertz Parkway. The same set of rules miaht
be anprClDriate to some other 2oninc[ district 2~S w8_1 ~'}lP
Planning & Zonina Commission held Their public hearina the
previous night. Mr. Greenwald said P&Z would have thei~
recommendation by our public hearino.
Mrs. M~rsh was concerned about one item under the list c:
permitted uses -Laboratory. scientific or Research. She
felt this should have an asterisk showina it to reaui~e a
Specific Use Permit. Everyone agreed.

Mr. Sweatt reminded Council they could always make changes
to the ordinance between the first and second consideration.
Mr. Greenwald said there would be another change regarding
the boundary definition.
Mr. Baldwin asked why 750' back from the 1-35 right of way.
B. Revision of the zoning map regarding property along Jack
Hays Boulevard and property along Schertz Parkway from East
Live Oak Road to the Southern Pacific Railroad.
Mr. Sweatt said this is to square off the General Business
area by Alamo Waste and rezone the rest of the business
district to Woodland Oaks to Neiqhborhood Services. There
was a proposal to rezone an arm of land that extends along
Borgfeld Road from General Business to Neighborhood
Services. However. as the City is a property owner in that
area, we proposed to cut that off at the City's property
boundary so that the City property would continue to be
General Business to accommodate the animal shelter.
C. Rezoning of the Beck Concrete property off FM 78
Predevelopment to M2 (Heavy Manufacturing) .

Mr. Greenwald said this is strictly the Beck property
does not include that strip of land belonging to
Riedel. which will remain Predevelopment.

Mr. Simonson said there were 117 letters sent to property
owners with 5 returned and only 20 people showed up at the
public hearing.
#5 Discussion regarding proposed Code amendment
establishing contractor's license.
Mayor Sawyer said staff feels this is a good idea to protect
some of our citizens from unscrupulous contractors. We feel
that if we license contractors we could control some of
them.
Mr. Sweatt added that we have included in the Dacket a set
of documents that are proposed to be used such as an
application that would provide certain types of information
to the Inspection Department to be reviewed prior to issuing
the license. This includes information about the company,
financial information and references from customers and
suppliers. We believe the real key to this is not lust the
acquiring of license but the checking up ahead of issuing
license on the company. This way, if favorable we would
issue the license; however if unfavorable. we would deny
the license and their appeal would be to the Board of
Adjustment.

#7 CITY MANAGER'S REPORT: A. In the midst of the
floods and high water Thursday morning. we had a gentleman
come to the drive-up window and left us a note, He said the
City has done an excellent iob dealing with the emergencies
and just wanted to say thank you. We also received a phone
call from a gentleman in Medina. who usee to live in
Schertz. offering his home for any displaced people because
of the flOOding.

#7 ITEMS BY COUNCIL: Mary Marsh - A. She wanted ~~
formally thank the police department. specifically Chief
Agee. They were burglarized recently and were able to
obtain the license number and Chief Agee went out and found
the truck. They are doing a super iob. This oarticular
truck has been involved in a number of San Antonio
burglaries.
B. The Schertz Business Association. Inc. - formerly
the Schertz Business Club met on the 26th of May. The
recent Jamboree was not that well attended but they did make
$315.85 on the auction. Thev still need to raise $661.25
for the fireworks fund. She made a olea for donations to
this fund as it will bring additional oecple into our city.
Mr. Sweatt gave an update on City Hall, The scholarship
was awarded to Jennifer Peel, who is attending Texas
Lutheran Collaqe takina Accountina and Business. They had a
4th of July update by Anita Clark requestina everyone to
sell raffle tickets and the Pageant selection will be he_J
at City Hall on June 22nd. They need help on Friday July
3rd to helD set up pavilion and also need parade officialS.
They recently had a ribbon-cutting for CPR Education and
will have one June 6th for the Automotive Place on Main
Street. Discussed the need to start a Membership Committee
and the list of places sellina lottery tickets.
C. She read the article in the paper about Universal City
being confronted with the problem of allowina Pot-Bellisd
Pigs in their community. She said that same thine could
happen here and we should be preparina for it,

Mrs. Stanhope: A. She mentioned that the newly completed
landscaDing at the Municipal Complex really looks nice.
Mr. Sweatt advised that the Kiwanis. along with our
Building Maintenance Service. Park Department. Street
Department and Assistant City Manager were all involved.
M:r~___BaHwlTl: A. He was asked if it would be possible to
put up signs on FM 3009 and FM 78 when the bridge on FM 78
is closed by high water. Perhaps a flip sign that could be
folded down when needed then flipped back up.
Mayor Sawyer suggested putting the sign up at 1-35 and
Schertz Parkway warning them.

Sweatt said that first. it is not our decision when to
the bridge. the State does that. Also the signs would
to be placed on State right of way so they would have
that also. We can contact them to request the signs.
Mrs. Marsh suggested also a sign should be placed on East
Live Oak at FM 3009 when that is closed.
B. He recalled the Commission saying when they were at the
Department of Transportation that there may be some bridge
money available that is not linked to highways. He asked if
we had made any effort to see if the FM 78 bridge could be
funded without tieing that to the widening of the highway.
Mr. Sweatt said we had confirmed to him our proposal in
writing but he has not responded to that. Since that time,
we now understand that most of that funding is going to be
dispensed through the MPO so we have now notified them of
our need for that as an alternate site.
Mr. Baldwin said that he believed that FM 78 should be our
first priority as this is really a problem for those going
to Randolph, school busses or people going into San Antonio.

Mr. Baldwin asked that Mr. Graham estimate a calendar.

the same for FM 78. He added that we need to get the people
who use FM 78 to support us and try to get Randolph to
support us. We could also get the School District to tell
us how many extra miles they have to drive and hours
involved by the closing of these roadways.

As some of the Council had problems with that. Mr. Sweatt
suggested maybe dedicating a petting area only - not the
bUilding - some place where the animals could be brought out

at FM 1518 and Oak Street but neither of the peoDle makina
the request showed up. P&Z is going to recommend that the
request come back so that we can find out who owns it. who
is liable and how much they plan to fix up. Thev did submit
a rough draft as to how they want to refurbish the sign

Mr. Sweatt said The people who bought Goofy Golf are of the
opinion that they bought the sign along with their property.
We have never been shown any proof of this. The request got
to P&Z because we had told them that if they ala not
renovate the sign, we were going to take it down.
Mr. Greenwald said P&Z would like the City to lease them
the sign for $1.00 a year.
