ccreg 06-16-1992 20fl REGULAR SESSION OF THE CITY COUNCIL JUNE 16, 1992 The Schertz City Council convened in Regular Session, Tuesday June 16, 1992 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Joe Potempa; Hal Baldwin; Barbara Stanhope and Ken Greenwald. Absent: Mary Marsh. Staff present were City Manager Kerry Sweatt and Deputy City Secretary Alice Austin. Mayor Sawyer called the meeting to order and lead everyone in the Pledge of Allegiance. Mayor Sawyer introduced Nolan Edwards, representing the Schertz Business Club who presented Sandra Bryant an employee of the Library with a plaque as "Employee of the Quarter". Mayor Sawyer advised that the award came with a dinner for two. Mr. Sweatt advised that although Sandra had not been with the Library very long she had proved to be a very valuable employee working as the child services area as well as other aspects of Library work. #1 APPROVAL OF MINUTES: A. Special Meeting 5-13-92 Regular Meeting 5-19-92 Special Meeting 5-27-92 Barbara Stanhope moved to approve the minutes of the Special Meeting of 5-13-92, the Regular Meeting of 5-19-92 and the Special Meeting of 5-27-92. Mr. Greenwald seconded the motion which carried with the following vote: For the Special Meeting of 5-13-92 and the Regular Meeting of 5-19-92. AYES: NAYS: Councilmember Potempa, Baldwin, Stanhope and Greenwald None For the Special Meeting of 5-27-92 AYES: Councilmember Baldwin, Stanhope and Greenwald NAYS: None ABSTAIN: Councilmember Potempa # 2 HEARING OF RESIDENTS: None # 3 CONTRACT: Mayor Sawyer introduced for renewal of the Contract with the Schertz Business Inc. for the 4th of July Jubilee activities. consideration Association, Mr. Sweatt advised that this contract was basically the same as previous years with only minor changes in Chapter 14 and a change to $300.00 for advertising. Mrs. Stanhope moved to approve renewal of the Schertz Business Association, Inc. contract for the 4th of July Jubilee. Mr. Baldwin seconded the motion which carried with the fOllowing vote: AYES: NAYS: Councilmember Potempa, Baldwin, Stanhope and Greenwald None #4 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 92-S-12 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE NO. 87-S-1, ARTICLE XX, OVERLAY DISTRICTS, SECTION 4, SPECIAL OVERLAY DISTRICT SCHERTZ PARKWAY; APPENDIX B, DEFINITIONS; AND PROVIDING A REPEALING CLAUSE. Mr. Greenwald moved to approve on final consideration an ordinance amending the Zoning Ordinance No. 87-S-1. Mrs. Stanhope seconded the motion which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope and Greenwald NAYS: None #5 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 92-S-13 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE NO. 87-S-1 BY REZONING AREAS OF LAND OUT OF BEXAR COUNTY AND REFLECTING SUCH CHANGES ON CERTAIN ZONING MAPS IN ACCORDANCE WITH THE SCHERTZ ZONING ORDINANCE. Mr. Greenwald moved to approve on final consideration an ordinance amending the Zoning Ordinance No. 87-S-1 by rezoning areas of land out of Bexar County. Mrs. Stanhope seconded the motion which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope and Greenwald NAYS: None #6 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: 2GB ORDINANCE NO. 92-L-14 AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 5, ARTICLE II BUILDING CODE, SECTION 5-17 AMENDMENTS, SUBSECTION 106.2 CONTRACTOR'S LICENSE REQUIREMENTS AND PROVIDING A REPEALING CLAUSE. Mr. Potempa moved to approve on final consideration the ordinance amending the Code of Ordinances by revising Chapter 5, Article II Building Code, Section 5-17 amendments, Subsection 106.2 Contractor's License. Mr. Baldwin seconded the motion which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope and Greenwald NAYS: None #7 BUDGET: Mayor Sawyer introduced for consideration 1991-92 mid-year budget adjustments. Mr. Baldwin moved to approve the 1991-92 adjustments as presented by Kerry Sweatt, City Stanhope seconded the motion which carried with vote: mid-year budget Manager. Mrs. the following AYES: Councilmember Potempa, Baldwin, Stanhope and Greenwald NAYS: None #8 C.R.W.A: Mayor Sawyer introduced for consideration a proposal for membership in Canyon Regional Water Authority. Mr. Sweatt advised that as discussed in previous meeting the City was looking to provide an alternative water supply to supplement our current water supply and that it seemed appropriate to join the C.R.W.A. We are currently an associate member with John Bierschwale attending meetings in that capacity. He advised that the cost to the City would be $10,000 membership dues and our share of their annual budget, which would be approximately $6,000. He further advised that the application would begin the process and that once the City was a member we would have two members on the Board of Directors. Mr. Greenwald moved to approve making application for membership in the C.R.W.A. Mrs. Stanhope seconded the motion which carried with the following vote: AYES: Councilmember Potempa, Baldwin, Stanhope and Greenwald NAYS: None #9 BID: Mayor Sawyer introduced for consideration bid for Animal Shelter. Mr. Sweatt advised that we had received only one bid from Tommy Crouch Construction Company for $223,600 which was over $100,000 more that allocated for the project. He advised that our only option was to reject the bid and readvertise for new bids with modifications to the plans. Ed Ford of Ford Engineering advised that they had been working on revising the plans without r8ducing the number and size of the runs. He advised that they had reduced the parking area, minimized the length of the fencing and done away with the brick on the outside of the building. Mr. Sweatt advised that the Water/Wastewater Department had agreed to install the water and sewer lines. Mr. Baldwin moved to reject Construction and solicit new bids. motion. the Mr. bid from Tommy Crouch Greenwald seconded the Mrs. Stanhope and Mr. Potempa said they would vote Aye to reject the bid. Both advised that the would like to have an opportunity to go over the revisions before bids were readvertised. Mr. Sweatt out we could give council Workshop in necessary. advised that even after the advertisement had gone still amend the specifications and that this would the opportunity to discuss the changes at the 1st July and give contractors 5 days to modify bids if Mayor Sawyer advised that there was a motion and second on the floor to reject the bid from Tommy Crouch Construction and solicit new bids and a vote was needed: AYES: NAYS: Councilmember Potempa, Baldwin, Stanhope and Greenwald None Mr. Sweatt ask if concensus of Council was to go ahead with the bid process. Concensus was to go ahead. #10 CITY MANAGER'S REPORT: 1. Was notified by Department of Transportation that the Doerr Lane Project Associate Drive to the railroad tracks has been bid and contract is expected to be let on June 25. Texas from the 2. Metropolitan Planning Organization will be holding a public meeting a 7:00 p.m. on June 22 at the Universal City city hall to discuss the organization's list of projects for future urban planning. He encouraged any member of Council who could to attend. 3. Advised that members of Council were invited to attend the Fire Departments Annual Drill meeting as they were honoring Chief Melton. 210 #11 ITEMS BY COUNCIL: Joe Potempa: Asked Mr. Sweatt if he had an opportunity to talk to the Highway Department concerning the traffic light on IH-35. Mr. Sweatt advised that he had talked to the engineer who had said that the setting was the best they could do. Mr. Potempa requested that Mr. Sweatt contact them again. Hal Baldwin: Advised that on Friday night they would be getting ready for Senior Citizen Day on Saturday. He advised everyone who could come over and help. Barbara Stanhope: 1.Thanked Mr. Willman and asked he pass it along to P & Z for their work on Schertz Parkway overlay. 2. Presented a check to Mr. Baldwin for the Senior Citizens from the Buffalo Valley Lions Club.
