SPECIAL MEETING OF THE BOARD OF ADJUSTMENT
JULY 7. 1992
The Schertz Board of Adjustment convened on July 7, 1992 at
7:00 p.m. in the Council Chambers of the Municipal Complex,
1400 Schertz Parkway, Schertz, Texas with the following
members present: Earl W. Sawyer, presiding; Joe Potempa;
Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken
Greenwald.
#1 BOA HEARING: The purpose of the hearing was to
receive citizen input on a request by the Housing Authority
for a Special Exception to the Zoning Ordinance setback line
to construct storage areas in the Roy Richard Courts.
Mr. Sawyer explained the Planning & Zoning Commission voted
unanimously in favor of this request. He then asked if
anyone in the audience or on the Board wished to speak.
Mr. Gus Rossello said he represented the firm hired by the
Housing Authority to investigate the feasibility of adding
emergency exits to the bedroom units. He added that as they
got into the project, they found there was a need for
storage as well as the emergency exits. Therefore, they are
asking for the Special Exception to the setback line to
place these storage sheds.
Mr. Sweatt advised that fifty letters were sent to
adjoining property owners within three hundred feet. We
received nine letters - five in favor of the request and
four against. No reason was given either for or against the
request.
#2 Consider and take action, if any, on the above
request for Special Exception.
Mrs. Stanhope I]loy~d the Special Exception to the Zoning
Ordinance setback line for storage areas be granted. Mr.
Potempa seconded the motion, which carried as follows:
AYES: Mr. Potempa, Mr. Baldwin, Mrs. Stanhope, Mrs. Marsh
and Mr. Greenwald.
NAYS: None
#3 ADJOURNMENT: There being no further business to
come before the Board of Adjustment, the meeting was
adjourned at 7:05 p.m. by Mr. Sawyer. /;/

REGULAR MEETING OF THE CITY COUNCIL
JULY 7, 1992
The Schertz City Council convened in Regular Session on July
7, 1992 at 7:05 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presidingj Joe Potempaj Hal Baldwinj Barbara Stanhope;
Mary Marsh and Ken Greenwald. Staff present were City
Manager Kerry R. Sweatt and City Secretary June G. Krause.
Mayor Sawyer asked everyone to join him in the Pledge of
Allegiance. He then recognized Police Chief Norman Agee.
Chief Agee said, in an effort to build their reserve force,
they are trying to get some people who will give them some
time and not be reserves in name only. He then introduced
two men and presented them for approval. Willie Villalobos,
who had been a reserve at both Converse and Pearsall, with
eight years previous service as a Reserve Police Officer.
Also Mr. Ken Rice, who has his own company and was recently
a reserve in Comal County. Chief Agee said he felt these
men would be a great help to the Department.
Mayor Sawyer welcomed these men and thanked them for their
volunteer efforts with the City.

Mr. Greenwald moved to approve the minutes of the Regular
Meetings of June 2nd and June 16th and the Special Meeting
of June 10th. Mrs. Stanhope seconded the motion, which
carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
ABSTAINING: Mr. Baldwin and Mrs. Marsh for the meeting of
June 2, 1992.
NAYS: None
#2 HEARING OF RESIDENTS: Mrs. Ruth Keller reserved
time for item #3.
#3 BID AWARD: Consider and take action on awarding
bid for the Schertz Animal Shelter.
Mr. Sweatt said that as the City Council will recall, this
was placed on the agenda and they were advised that bids
were to be received as of 10:00 a.m. this date. Two bids
were received, one in the amount of $~183,211 from Tommy
Crouch Construction Company. The second in the amount of
$~194,023 received from Wunderlich Builders Inc.. Some
seven bidders had indicated interest in biddingj however
these are the only two who actually bid. Because this
substantially exceeds our available funds, we are not

proposing to ask Council to take action tonight. He
indicated there are several alternatives that are being
considered. He added that the bids will be held for further
study and will be brought back to Council at a later
meeting. The Bid documents specify the prices will be firm
for a period of sixty days from date of receipt.
Mr. Potempa made a_motion to table this item until the City
Manager can get back to Council with further details. Mrs.
Stanhope seconded the motion, which carried with the
following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
Mrs. Keller asked that she be notified when this item would
be brought to workshop.
Mr. Sweatt advised that the items were placed on agendas on
the Friday prior to the meeting and Mrs. Keller could
either call him or stop by.
#4 ORDINANCE: Mayor Sawyer introduced an ordinance
and read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS AMENDING CITY OF SCHERTZ ORDINANCE
92-T-2, PROVIDING FOR TAX ABATEMENTS FOR
EXISTING BUSINESSES IN THE CITY OF SCHERTZ.

Mr. Sweatt said, to clarify the action, this is only a
portion of the overall abatement activity. This particular
amendment provides for the addition of a 10% credit in the
abatement process for existing businesses. This was a
result of recommendations that came through the Economic
Development Task Force.
Mayor Sawyer then called for a vote on the motion, and the
motion carried as followed:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.

#7 CITY MANAGER' REPORT: A. He will be inviting one
of our employees to attend the Council meeting on July 21.
We had an incident in our pool recently in which a near
tragedy occurred. One of our lifeguards saved the life of a
two-year old child. He would like to invite Stephanie
Billotta, her parents, the child and the child's parents to
the meeting to be recognized.
B. On July 27th at 1:30 p.m. in the Convention Center in
San Antonio, the Metropolitan Planning Organization will be
meeting and making final decisions relating to highway
projects. He urgently requested Councilmembers to attend
and lend their support. He said our FM 3009 project is in a
degree of jeopardy.
Mr. Baldwin asked if Council could get a chronological
listing of the FM 3009 project.
C. Just for information, tomorrow at 2:00 p.m. the Library
will have a children's program on anti-gang/anti-drugs. He
encouraged everyone to drop by and look at the program.
#8 ITEMS BY COUNCIL: Mr. Potempa said that,
regarding the telecommunication listing, the exchanges of
651 and 650 should be added.
Mr. Baldwin thanked everyone who took part in the Senior
Citizen Appreciation Day activities. He said they had a
wonderful turnout and he looked forward to the next year.
Mr. Greenwald relinquished his time to Ron Michalec
with Buffalo Valley Youth Association.
Mr. Michalec thanked Council for giving them the time to
talk. He said they were present because they will be having
a tournament coming up on the 25th of July. This is a
State-wide tournament for Pony Baseball, that is called the
Mustang Boys Tex-Mex Tournament. He said they are really
excited about this as this has never happened before in the
City of Schertz. He cordially invited the Council to be at
the banquet to be held at the Roundup Club. He then
presented the Mayor the first ticket - they also had tickets
for the other Councilmembers. The tournament starts Sunday,
July 26th and they really need community support. They will
be posting flyers allover and have advertised extensively.
They will have teams coming from Corpus Christi, the Valley,
Austin, Dallas, and San Antonio. Our team from here will go
to Dallas and then to the Nationals. He said we have an
outstanding team and he felt they would go to Nationals.
After assuring Mr. Michalec he had full Council support,
Mayor Sawyer thanked him for doing a good job with BVYA.
#9 ITEMS BY MAYOR: A. Several Boy Scouts from Troop
21 showed up at the park on July 3rd and helped set up the
tables. They were surely appreciated.

Mr. Bill Neller said he had not seen this month's Newsletter
and wondered if there was anything in there about the flags
being displayed on July 27th. Mr. Sweatt assured him there
was.
#10 ADJOURNMENT: Mr. Potempa moved to adjourn the
meeting at 7:45 p.m. with Mr. Baldwin seconding the
motion, which carried with a unanimous vote.
