REGULAR MEETING OF THE CITY COUNCIL
JULY 2 1, 1992
The Schertz City Council convened in Regular Session, Tuesday
July 21, 1992 at 7:00 p.m. in the Conference Room of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer,
presiding; Joe Potempa; Hal Baldwin; Barbara Stanhope; Mary
Marsh and Ken Greenwald. Staff present were City Manager Kerry
R. Sweatt and Deputy City Secretary Alice Austin.
Mayor Sawyer called the meeting to order and asked those present
to join him in the Pledge of Allegiance.
Mayor Sawyer introduced and presented a plaque to Stephanie
Bilotta, a lifeguard employed at the Schertz Pool. The plaque
was given in appreciation for saving the life of a 2 year old who
fell into the pool.
Mr. Sweatt said that he applauded Stephanie on a job well done.
Mayor Sawyer introduced Troop Leader Bruce Anderson with members
of troop Benjamin Anderson, B.J. Marcos, and Troop Leader Mike
Felds with Mike Felds, Jr., Steve Felds, Joe and John Ristivo and
Jason Hernandez. Mayor Sawyer advised that the two troops had
done an outstanding job assisting with the Fourth of July
activities in the park.
Mayor Sawyer welcomed Judge Sagebiel and Larry and Linda Jones.
#1 PUBLIC HEARING: Mayor Sawyer opened the Public Hearing
at 7:04 to receive citizen comments on a request by C.E. Stone
of 3521 Jack Hays Boulevard for a rezoning change from
Neighborhood Services to Single Family Dwelling District.
Mr. Sweatt advised that 34 letters were sent and that no
opposition had been received.
There were no citizens wishing to be heard on this item.
Mayor Sawyer closed the Public Hearing at 7:06 p.m.
#2 PUBLIC HEARING: Mayor Sawyer opened the Public Hearing
at 7:06 p.m. to receive citizen comments on the proposed Pecan
Drive Reinvestment Zone to support a Tax Abatement request by Rex
Bornmann of CFTI Hardwood Products, Inc., 124 Pecan Drive.
Mr. Sweatt advised that the Economic Development Task Force has
made recommendation following a request by the property owner to
expand an existing business located at 124 Pecan Drive.
There were no citizens wishing to be heard on this item.

#3 APPROVAL OF MINUTES: Regular Meeting of 7-1-92.
Mrs. Stanhope made the motion to approve the minutes of the
Regular Meeting of 7-1-92. Mrs. Marsh seconded the motion which
carried with the following vote:
AYES: Councilmembers Baldwin, Stanhope, Marsh and Greenwald
NAYS: None
ABSTAIN: Councilmember Potempa

#5 ORDINANCE: Mayor Sawyer introduced for consideration
and action and read the caption of an ordinance as follows:

Mrs. Marsh made the motion to approve the ordinance on final
consideration providing for Tax Abatements for existing
businesses in the City of Schertz. Mr. Greenwald seconded the
motion which carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#6. ORDINANCE: Mayor Sawyer introduced for consideration
and action on first reading and read the caption of an ordinance
as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, ESTABLISHING THE PECAN DRIVE REINVESTMENT
ZONE.
Mr. Baldwin made the motion to approve on first reading the
ordinance establishing the Pecan Drive Reinvestment Zone. Mr.
Potempa seconded the motion which carried with the following
vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.

#7 ORDINANCE: Mayor Sawyer introduced for consideration
and action on first reading and read the caption of an ordinance
as follows:

Mrs. Stanhope made the motion to approve the Tax Abatement
Ordinance and Agreement with Mr. Rex Bornmann. Mr. Baldwin
seconded the motion which carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
Mr. Sweatt advised that a similar request had been made to
Guadalupe County. He introduced Judge Sagebiel. Judge Sagebiel
advised that he and the Commissioners Court were in favor of
helping existing businesses and that he would look favorably on
the request when it carne before the County Commissioners Court.
#8 ORDINANCE: Mayor Sawyer introduced for consideration
and action on first reading and read the caption of an ordinance
as follows:
AN ORDINANCE

Mr. Greenwald made the motion to concur on first reading the

Marsh seconded the motion which carried with the following vote:

AMENDING THE CODE OF ORDINANCES OF THE CITY OF
SCHERTZ TO REQUIRE INSTALLATION IN CONVENIENCE
STORES OF SECURITY CAMERA SYSTEMS, SILENT ALARM
EQUIPMENT, DROP SAFES OR CASH MANAGEMENT DEVICES,
COMPLIANCE SIGNS, ILLUMINATED PARKING LOTS,
HEIGHT MARKERS, CASH MANAGEMENT POLICIES AND
WINDOWS WITH CLEAR AND UNOBSTRUCTED VIEWS;
PROVIDING FOR ROBBERY PREVENTION AND AWARENESS
TRAINING; PROVIDING FOR PENALTY; AND
ESTABLISHING AN EFFECTIVE DATE.
Mr. Baldwin made the motion to approve on first reading the
ordinance requiring installation in convenience stores of certain
security equipment. Mr. Potempa seconded the motion which
carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
Mr. Sweatt advised that this ordinance was aimed at convenience
stores which are open between 11p.m. and 6 a.m. He advised that
research had been done by the police services, the city attorney
and the inspection department and that it is believed that this
is the time to take action before it becomes a problem.

Mr. Sweatt advised that the policy is intended to deal with
those problems which arise causing cash flow demands and where it
is in the city's best interest to transfer available funds

Funds. Mrs. Marsh seconded the motion which carried with the
following vote:
