ccreg 10-02-1990 x P'(" 007 REGULAR MEETING OF THE CITY COUNCIL OCTOBER 2, 1990 The Schertz City Council convened in Regular Session, Tuesday, October 2, 1990 at 7:00 p.m. at the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding i Joe Potempa, Hal Baldwini Barbara Stanhopei Mary Marsh and Ken Greenwald. Staff present were City Manager Kerry Sweatt and Deputy City Secretary Alice Austin. Mayor Sawyer opened the meeting and asked those present to join him in the Pledge of Allegiance. Mayor Sawyer then ask Mr. Lou Borgfeld of the Economic Development Task Force to come forward and presented him with a proclamation. Mayor Sawyer read the proclamation which proclaims the week of October 7th through 13th 1990 as "The Second Annual Schertz Business Appreciation Week" and further calls upon all citizens of Schertz to contact the business owners and managers and express their appreciation to them for locating their business in the City and for products and services they provide. II APPROVAL OF MINUTES: Special Tour of 8-15-90, Special Meeting of 8-15-90, Budget Session of 8-15-90, Board of Adjustment 8-21-90, Regular Meeting of 8-21-90 and Budget Session of 8-21-90. Mrs. Stanhope made the following corrections: Minutes of 8-15-90, #5-2 date given as September 19th and Minutes of 8-21-90, #8-C date given as September 10th. Mr. Sweatt advised that the date was September 10th. Minutes of August 15, 1990 page 7, para 9 last line to read "the latter part of this year we will be adding additional open space" . Minutes of August 15, 1990 page 8, para 1, next to last line "positions", 7 para 4th line "an", 8 para, line four "(young in this profession)and he said he has". Minutes of 8-21-90 extra spaces in dollar figure in #1-1 and #1- 4, on pg. 17 para 3, line 4 "Secretary's" Mrs. Marsh made correction in #5-4 "para-mutuel. Mr. Baldwin made the motion to approve the Minutes of the Special Tour of 8-15-90, Special Meeting of 8-15-90, Budget Session of 8- 15-90, Board of Adjustment 8-21-90, Regular Meeting of 8-21-90 and Budget Session of 8-21-90. Mrs. Stanhope seconded the motion which carried with the following vote: 60 AYES: Councilmember Joe Potempa, Hal Baldwin, Barbara Stanhope, Mary Marsh and Ken Greenwald. NAYS: None 12. HEARIRG OF RESIDERrS: Mr. Thomas G. Weaver and Mr. Ed Nordmier reserved time for Item #4. Mr. Dale asked to speak on Deerhaven Drainaqe. He advised that on May 9 after conferrinq with several of his neiqhbors he had written a letter to Mr. Sweatt concerninq the drainaqe in Deerhaven due to construction of Savannah Square housinq addition. On May 14 Mr. Dishonq also wrote a letter concerninq the same thinq. On May 23 they had received a letter from Mr. Sweatt sayinq that he would look into this matter. He advised that some time after that he had a conversation by telephone with Mr. Sweatt indicatinq that the city was goinq back to the oriqinal contractor to see if somethinq could be done. Mr. Dale had relayed this information to all of his neiqhbors that are involved. He advised that this summer had been quite dry but that there had been two heavy rain falls in their area. He said that he would like to know what has been done, if anythinq and what the prospects are. Mr. Sweatt advised that we had contacted the oriqinal contractors and oriqinal enqineers on the project. He advised that we met with them here, aqreed on the format of the information that they needed to gather to reconsider the design of that retention basin and retaininq structure there. He had then called Mr. Dale to advise him that there miqht be some surveYing beinq done by the developer and his enqineer. He had placed two calls since that time to the enqineer and they have not replied to our request. He advised that it was our understandinq that they are redesigninq the retention structure to make chanqes that would affect the down stream drainage but that they had not replied to our call. Mayor Sawyer requested that Mr. Sweatt enqineers and see if can qet them to do problem. aqain contact the somethinq about the Mr. Dale advised that the catchment basin is a perfect breedinq qround for mosquitos. Mayor Sawyer thanked Mr. Dale for bringing the matter to Council's attention and ask him to be patient with us as we are dOinq the best we can. He advised that we are lookinq into improvinq the drainaqe behind the houses on Antler and we will keep after the developers to see if we can get them to straighten up what they have already done. Mr. Dale asked if they could get some information every now and then. J x ,co, C1 ~) .1 Mayor Sawyer requested DeerHaven Drainage be added as number 26 on the Bellringer List. 13 PRESENTATION: Mayor Sawyer advised that this was an acknowledgment and receipt of qrant funds from Wal-Mart Foundation for economic development activities. He requested that Mr. McDonald of Wal-Mart and Mr. Lou Borgfeld of City of Schertz Task Force to come forward. Mr. McDonald advised that this was a check for $1,666.66 which is one-third of a five thousand dollar grant that Wal-Mart Foundation had awarded to the City of Schertz for economic development. Mr. Sweatt advised that he would like to say in behalf of Wal- Mart and Mr. McDonald that his company and he individually has been an extremely valuable supporter of our economic development activities and in overall city activities. The company has made substantial donations for landscaping and beautification work this past summer. He advised that Mr. McDonald had been rather reticent of being recognized publicallY and he would like to take this opportunity to recoqnize that and other contributions the company has made to us. '4 storage follows: RESOLUTION: Mayor Sawyer introduced a resolution and burning of toxic waste and read the caption on as RESOLUTION NO. A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, OBJECTING TO TRANSPORTING TO, STORAGE AND BURNING OF TOXIC WASTE, AS A FUEL, BY THE LAFARGE CORPORATION AT IT'S CEMENT MANUFACTURING FACILITY, OR AT ANY OTHER FACILITY LOCATED IN COMAL, GUADALUPE OR BEXAR COUNTIES. Mr. Thomas G. Weaver of 106 Tocama, Universal City advised that he is a tax payer in the City of Schertz and that he also works here. On the issue of storaqe and burning of toxic waste he advised that he had a personal interest in that he has a weekend summer place in New Braunfels less than two miles from the stack at the Lafarge plant. He advised that he has been in a position to observe area cities and that the Schertz Council has developed a reputation over the last five or six years of being very careful in non-political decisions that Council makes. He advised that the city manager had been very helpful to him by providing him with a copy of the resolution. Mr. Weaver advised that he would like to commend Council on their concern in environmental matters but he had a few comments he would like to make before they considered the resolution. He advised that the list of things classified as toxic waste has qrown. He said that most people are toxic waste qenerators and we have to dispose of it. He advised that he was not an expert, only a concerned citizen, and he had checked into the plant and that there would be no radioactive material, no pesticides, no dioxines or pcbs. 62 He said that the items scheduled under the permit must be disposed of and if they are used for fuel we would be recycling. He advised that there are twenty plants in existence and there are no environmental or health problems even in California who has the most restrictions. He advised that for the resolution to be effective they must have facts and documentation accompanYing it to be considered. He suggested that the Council could use their resolution to petition the Texas Water Control Board and Commission that they maintain a stringent permitting program. He advised that what he was asking was that Council base their decision on facts and not on emotion. He said that he respectfully requested that Council vote the resolution down. Mr. Ed Nordmier of 409 Aviation advised that the cement kiln uses the highest temperature of 2700 to 3000 degrees. He advised that there is nothing that he knew of that uses that high a temperature. He advised that the firing time is far longer. He advised that the purpose of the plant was to save energy i and that 50 percent of the cost of cement was the energy used in manufacturing it. He advised that he could think of nothing that could survive the temperature and time the toxic waste would be subjected to. Mayor Sawyer thanked Mr. Nordmier for his concern. Mr. Potempa made a motion to table the resolution and schedule it for further consideration at workshop. Mary Marsh seconded the motion which carried with the fOllowing vote: AYES: Councilmember Joe Potempa, Barbara Stanhope, Hal Baldwin, Mary Marsh and Ken Greenwald. NAYS: None #5 ORDINAlICE: Mayor Sawyer introduced for final consideration and read the caption to an ordinance as follows: ORDINANCE 90-S-29 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE SUBDIVISION ORDINANCE, NO. 87-S-11, ARTICLE III, DESIGN STANDARDS, SECTION 24, PUBLIC SITES AND OPEN SPACESi AND PROVIDING A REPEALING CLAUSE. Mrs. Marsh made the motion to approve on final reading the ordinance amending the subdivision ordinance No. 87-S-11. Mr. Potempa seconded the motion which carried with the following vote: AYES: Councilmember Joe Potempa, Barbara Stanhope, Hal Baldwin, Mary Marsh and Ken Greenwald. NAYS: None I I- I I I i / /x r~ 6'-; vi) '6 ORDINANCE: Mayor Sawyer introduced for consideration on first reading and read the caption to an ordinance as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING SECTION 18-32 STOP INTERSECTIONSi SECTION 18-35 YIELD INTERSECTIONS AND SECTION 18-76 MAXIMUM SPEED ON SPECIFIC STREETS AND REPEALING ALL ORDINANCE OR PARTS OF ORDINANCES IN CONFLICT. Mr. Potempa made the motion to approve on first reading amendinq the code of ordinances. Mrs. Stanhope seconded the motion which carried with the following vote: AYES: Councilmember Joe Potempa, Barbara Stanhope, Hal Baldwin, Mary Marsh and Ken Greenwald. NAYS: None 17 CITY MANAGER'S REPORT: 1. Mr. Sweatt advised that Bob Schwartz, who has been with GVEC for many years, was retiring and the Council was invited to his retirement party on the 5th at GVEC between 3 and 5 pm. 2. He advised that Samuel Clemens would be holding their bonfire and snake dance on the 10th at 7 pm. 18 ITEMS BY COUNCIL: BARBARA STANHOPE: Advised that she had a packaqe for the Texas Forest Service which was in regards to funds that were available. MARY MARSH: 1. Invited everyone to the Commerce Trade Fair on October 11, from 2 to 8 pm. She advised that our task force would have a booth there. She also advised that that night the Business Appreciation would be held at the VFW at 7:00 pm. and they would be showing our new marketing tape. 2. She advised that she would like to express her appreciation to Mr. Sweatt who had spoken to Oak Forest Community Council. She advised that there were 30 something people there and Mr. Sweatt had presented an excellent presentation of "how goes it with the City". 19 ITEMS BY MAYOR: Mayor Sawyer advised that tomorrow was his birthday.
