ccreg 11-06-1990 82 REGULAR MEETING OF THE CITY COUNCIL NOVEMBER 6, 1990 The Schertz City Council convened in Reqular Session, Tuesday, November 6, 1990, at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The fOllowing members were present: Mayor Earl W. Sawyer, presidinqi Joe Potempa i Barbara Stanhope and Mary Marsh. Absent: Hal Baldwin and Ken Greenwald. Staff present were City Manager Kerry R. Sweatt and City Secretary June G. Krause. Mayor Sawyer opened the meeting and asked everyone to jOin him in the Pledge of Alleqiance. #1 APPROVAL OF MINUTES: Mrs. Marsh moved to approve the minutes of the Budget Workshop of August 29th, the Reqular Meetinq of September 4th, the Public Hear inq of September 11th and the Special Meetinq of September 12th. Mrs. Stanhope seconded the motion, which carried with the fOllowing vote: AYES: Councilmembers Potempa, Stanhope and Marsh NAYS: None #2 HEARING OF RESIDENTS: Mr. Potempa, President of the Schertz Business Club presented Mr. Kirk Timke, Firefighter, a plaque naminq him the Employee of the Quarter. #3 INTERIM CONTRACT: Consider and take action on an Interim Contract for solid waste collection. Mr. Sweatt said staff had prepared, for Council consideration, a proposed contract to be known and may be cited as the Municipal Solid Waste Interim Contract of the City of Schertz, Texas. It will become effective December 1st, at which time our current contract will expire, and will run until our franchise ordinance is finalized on March 30th, 1991. The rates are to be made a part of the contract with the residential rate beinq $6.47, listinq all classification of service throuqh the larqe roll-off containers. This is a decrease for residential rates of 18.2% from our current rates. Mr. Sweatt recommended these rates be a part of the interim contract and the contract be approved. Mr. Potempa moved to approve the Interim Contract, includinq the new rates. Mrs. Stanhope seconded the motion, which carried with the fOllowinq vote: AYES: Councilmembers Potempa, Stanhope and Marsh. NAYS: None #4 ORDIIlABCE: Mayor Sawyer introduced an ordinance and read the caption as follows: /- 83 AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING ARTICLE V, CHAPTER 7 1/2 MUNICIPAL SOLID WASTE COLLECTION AND DISPOSALi PROVIDING FOR PENALTIES NOT TO EXCEED $200.00 FOR VIOLATION THEREOF: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE. Mrs. Marsh moved to approve the first reading of an ordinance amending the Code by revising Article V, Chapter 7 1/2 Municipal Solid Waste Collection and Disposal. Mr. Potempa seconded the motion, which carried as follows: AYES: Councilmembers Potempa, Stanhope and Marsh NAYS: None #5 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE GRANTING ALAMO WASTE, INC. A FRANCHISE FOR MUNICIPAL SOLID WASTE COLLECTION AND DISPOSALi IMPOSING PROVISIONS AND CONDITIONS RELATING TO THE EXERCISE OF SAMEi AND PROVIDING FOR PENALTIES NOT TO EXCEED $200.00 FOR VIOLATION THEREOF. Mrs. Stanhope moved to approve the first reading of an ordinance granting Alamo Waste, Inc. a franchise for providing solid waste collection. Mrs. Marsh seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Stanhope and Marsh NAYS: None Mr. Mike Moore, of Moore Industrial Waste, said he had talked with Mr. Sweatt earlier in the week and was told of his recommendation. Mr. Moore said he fel t this was a pol i tical rather than logical decision. He said his company had done a survey of the citizens and they were overwhelmingly satisfied with Moore's service. He said they had participated in the Communi ty and they had been good commercial citizens. He said one of the things for the future security of the City is access to landfills and at a reasonable price. He said their future agreements include access to the Buffalo Valley Landfill. He said that obviously everyone on the Council knows and likes Henry Gutierrez and that he liked Henry too. He said he felt that to come back and change proposals after everyone had put their cards on the table was not exactly fair. He added, they were denied some good publicity from the reduction they tried to do for the Ci ty. He said he fel t the Council should look at this from a logical and business standpoint other than merely a political standpOint. He ended by saying he appreciated Council's patience in listening to him. \" 84 Mrs. Bobby Vanada said she would like to respond to that. She said she is a resident of Schertz and believes in keeping businesses in Schertz. She mentioned the increase in rates of Moore Service and the various complaints she had heard of this company, although she had not had any problems with themi but she did feel we should support our local businesses. #6 BID AWARD: A. Half-ton pickup. Mr. Sweatt advised that three bids were received, from San Antonio Truck Sales, in the amount of $11,868 i Koepp Chevrolet Inc. for $13,525 and from Gunn Chevrolet Inc. for $14,216. Mr. Sweatt said staff recommend accepting the bid from San Antonio Truck Sales. Mrs. Marsh moved to accept the bid for the 1/2 ton pickup from San Antonio Truck Sales, in the amount of $11,868. Mrs. Stanhope seconded the motion, which carried with the fOllowing vote: AYES: Councilmembers Potempa, Stanhope and Marsh. NAYS: None B. Backhoe/loader/tractor Mr. Sweatt said bids were received from Case Power & Equipment, in the amount of $28,353.68i from Alamo Ford New Holland Inc. for $29,242.00 and from Kuenstler Machinery for $30,058.00. He recommended accepting the Case bid. Mrs. Stanhope moved to accept the bid, in the amount of $28,353.68, from Case Power & Equipment. Mr. Potempa seconded the motion, which carried with the fOllowing vote: AYES: Councilmembers Potempa, Stanhope and Marsh NAYS: None #7 CITY MANAGER'S REPORT: A. Reminded Council of the Veteran I s Day parade on November 10th in Universal City. Our float will be number 49 in the parade. Mrs. Marsh mentioned that Council would need some way to get from the end of the parade back to their vehicles and ask what about the weather? Mr. Sweatt said he would make arrangement to transport Councilmembers back to their vehicles and we had not heard of any plans concerning the weather.
