BOARD OF ADJUSTMENT MEETING
DECEMBER 4, 1990
The Schertz Board of Adjustment convened Tuesday, December 4,
1990 at 7:00 p.m. in the Council Chambers of the municipal
Complex, 1400 Schertz Parkway, Schertz, Texas. The fOllowing
members were present: Mayor Earl W. Sawyer, presiding; Joe
Potempa; Barbara Stanhope; Mary Marsh and Ken Greenwald. Absent:
Hal Baldwin. Staff present were City Manager Kerry R. Sweatt and
City Secretary June G. Krause.
Mayor Sawyer welcomed everyone to the meeting and asked them join
him in the Pledge of Allegiance.
Mr. Sawyer then explained that the City Councilmembers, by
Charter, act as the Board of Adjustment in Schertz.
BOARD OF ADJUSTMENT HEARING: The purpose of the hearing was to
receive citizen input on the following requests:
#1 A request by Mr. William C. Giberson, 416 Marilyn Drive
(Lot 20, Block 1, Parkland Village #1 SubdiVision) for a five
foot variance to the side-yard setback reqUirements of the Zoning
Ordinance.
Mr. Giberson explained that he wanted to put up a two-car carport
cover and in order to do that he needs the additional space.
Mr. Sweatt advised that forty-three notices were mailed to the
property owners within three hundred feet of this property.
Three were returned unclaimed, six returned saYing they were in
favor of the request and one returned with just a general
comment - not for or against. The request concerns a variance to
the existing seven-foot side yard, which would provide for the
side of a carport to be within two feet of the property line.
There were no questions from the audience.
#2 Consider and take action, if any, on the above request.
Mr. Potempa moved to approve Mr. Giberson's request for a

seconded the motion, which carried with the following vote:

Mr. Sweatt said seventeen notices were mailed to the property
owners within three hundred feet of this property. Eight letters
were returned - six were for the request and two against. He
said the request is for a six-foot variance to the Zoning
Ordinance to allow a building to be built within five feet of the
existing residence.
Mr. Gibler explained that the positioning of a storage building
on the back of the property is difficult due to two things - the
placement of trees and a sixteen-foot utility easement that runs
the whole length of the back yard. The place selected for the
building will be right behind where the existing two-car garage
is located. This will completely block its view from the street.
It will only be visible from the neighbor's back yard. He said
the structure would be done by a licensed contractor and would
blend as much as possible with the roof line and color of the
existing main structure.
Mr. Gibler said he called the City Secretary and asked the
location of the two dissenting property owners. He said he then
went to both locations and from the best of his abil i ty, the
structure could not be viewed from either property. He said they
both must be at the extremity of the three-hundred feet the City
uses as a guideline.
Mayor Sawyer said that the Planning & Zoning Commission has
recommended approval of this request.

Mrs. Marsh moved that this request be approved.

#5 ADJOURNMENT: There being no further business to come
before the Board of Adjustment, Mr. Sawyer declared the meeting
adjourned at 7:10 p.m.
