REGULAR MEETING OF THE CITY COUNCIL
DECEMBER 18, 1990
The Schertz City Council convened in Regular Session, Tuesday,
December 18, 1990 at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Joe Potempa; Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken
Greenwald. Staff present were City Manager Kerry Sweatt and City
Secretary June Krause.
Mayor Sawyer opened the meeting and requested everyone join him
in the Pledge of Allegiance.

Mrs. Stanhope moved to accept the minutes of the Regular Session
of 11-6-90, the Special Session of 11-14-90, the Regular Session
of 11-20-90 and the Special Session of 11-28-90. Mr. Greenwald
seconded the motion, which carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald
NAYS: None
ABSTAINING: Mr. Baldwin for the Special Sessions of 11-14-
90 and 11-28-90. Mrs. Marsh for the Regular Session of 11-20-90
and Special Session of 11-28-90.
#2 HEARING OF RESIDENTS: None
#3 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 90-S-33
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS AMENDING THE SIGN
ORDINANCE, NO. 86-S-28, ARTICLE VI, SIGNS
PERMITTED IN ALL BUSINESS, COMMERCIAL AND
MANUFACTURING DISTRICTS, SECTION 9,
DESIGNATION OF RAILROAD RIGHT-OF-WAY SIGN
DISTRICT; AND PROVIDING A REPEALING CLAUSE.
Mr. Greenwald moved to approve the final reading of an ordinance
designating a Railroad Right-of-way Sign District. Mrs. Marsh
seconded the motion, which carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh, and
Greenwald.

#4 ORDINANCE: Mayor Sawyer introduced an ordinance and read
the caption as follows:
ORDINANCE NO. 90-F-34
AN ORDINANCE GRANTING ALAMO WASTE, INC. A
FRANCHISE FOR MUNICIPAL SOLID WASTE
COLLECTION AND DISPOSAL; IMPOSING PROVISIONS
AND CONDITIONS RELATING TO THE EXERCISE OF
SAME; AND PROVIDING FOR PENALTIES NOT TO
EXCEED $200.00 FOR VIOLATION THEREOF.
Mrs. Marsh moved to approve the final reading of an ordinance
granting Alamo Waste, Inc. a franchise for Municipal solid waste.
Mr. Greenwald seconded the motion, which carried as follows:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
# 5 CONTRACT:

Consider and take action regarding the BVYA
Mr. Greenwald moved to approve the renewal of the BVYA contract
for 1991 calendar year. Mrs. Stanhope seconded the motion, which
carried with the following vote:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#6 APPOINTMENTS: Consider and take action on re-appointing
members to the Schertz Housing Authority Board of Commissioners.
Mrs. Stanhope moved to accept the two people to be appointed to
the Housing Authority Commission - Edith Purcell and Wellington
Cyr. Mr. Potempa seconded the motion, which carried as follows:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#7 CITY MANAGER'S REPORT: A. We have set January 15th
as ,the date for a publ ic hearing on a request for a Special
Exception to the AICUZ Zoning by a church to use the old
Morning Star Building on FM 1518 for their services.
B. Schertz Fire Department has asked Councilmembers to attend
their Annual Tamale Dinner after this meeting.
C. Remind that Council will not meet until January 9th and
wished everyone a very Merry Christmas and a Happy New Year.

#8 ITEMS BY COUNCIL: Mr. Potemoa: A. He reported that
there was a fire across from Garden Ridge Pottery. He said the
response time for Chief Melton and two firemen was tremendous and
they did a super job.
B. He said, on behalf of his family and himself, he wished each
and everyone a Merry Christmas and Very Happy New Year.
Mr. Baldwin al so said he would like to wish everyone a Merry
Christmas and Happy New Year and he was looking forward to the
challenge of a new year.
Mrs. Stanhope wished everyone a very happy and safe hol iday
season.
Mrs. Marsh said she would ditto those statements and also wanted
to commend the City for a very well done Awards Dinner. She felt
Mr. Dovey did an exceptional job as Master of Ceremonies, the
decorations were marvelous, food was good and it was just
exceptionally well done.
Mr. Greenwald: A. Said there was an article in the Light
newspaper saying the FCC was offering new rules that would return
some of the regulation authority of Cable Television back to the
cities. He added that maybe our griping did some good.
B. He also wished everybody a Merry Christmas and said he agreed
that the Awards party was a super good time.
#9 ITEMS BY MAYOR: He asked that the information on the
Special Exception be on the next workshop agenda.
Mayor Sawyer then wished everyone a Merry Christmas and Happy New
Year and said he was looking forward to working with this Council
another year. He added that it has been a pleasure to serve with
the Councilmembers for the past year. He said he felt the City
employees, under Mr. Sweatt's guidance, have come a long way from
what it was when he first started out in 1973.
#10 ADJOURNMENT: Mrs. Marsh moved the meeting be adjourned
at 7: 22 p . m., and the motion was du 1 y seconded and carr ied
unanimously.
