BOARD OF ADJUSTMENT MEETING
MARCH 5, 199 1
The Schertz Board of Adjustment convened Tuesday, March 5, 1991
at 7: 00 p. m. in the Council Chambers in the Municipal Complex,
1400 Schertz Parkway, Schertz, Texas. The following members were
present: Mayor Earl W. Sawyer, presiding: Joe Potempa: Hal
Baldwin; Barbara Stanhope; Mary Marsh and Ken Greenwald. Staff
present were City Manager Kerry R. Sweatt and Deputy City
Secretary Alice Austin.
Mayor Sawyer welcomed everyone to the meeting and asked if they
would stand and join him in the Pledge of Allegiance.

request from Vaughan Homes, on behalf of

Mark Vaughan advised that he would be happy to answer any
questions and that they were only asking for half of the easement
to use. He advised that they had talked to Planning and Zoning
and his company felt like they were not going to create a problem
for the two utilities currently using the easement, which are
telephone and cablevision. He advised that they felt like there
would be no future need for additional utilities in the easement
and that they had received permission from both the cablevision
company and the telephone to use the eight feet. He advised that
they had located the current lines and they would not be
interfering with them. He advised that the lot was one of the
smallest in that subdivision.

Mr. Sweatt advised that notices were mailed to property owners
within 300 feet and that out of the eleven notices mailed, three
replies had been received, all of which were in favor. He
advised that the area behind the location was in the 100 year
flood plain, which reduces the impact to expansion behind the
property.

Mr. Greenwald made the motion to approve the granting of the
request by Vaughan Homes in behalf of Mr. Bob Pond at 3013 Bent
Tree for a 8 foot variance on the rear utility easement with the
inclusion of the hold harmless clause.
Mrs. Marsh seconded the motion which carried with the following
vote:
