REGULAR MEETING OF THE CITY COUNCIL
JANUARY 2, 1990
The Schertz City Council convened in Regular Session, Tuesday I
January 2, 1990, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presidingi
Earl P. Hartzogi Hal Baldwini Barbara Stanhope, Mary Marsh and
Ken Greenwald. Staff present were City Manager Kerry Sweatt and
City Secretary June Krause.

Mrs. Marsh asked that the minutes of December 13, 1989 be
corrected as follows: # 12 Executive Session: B. 2 & 3 be
changed to read as follows: "2. To authorize the City Manager to
secure appraisal of property on FM 1518 for the purpose of
purchase consideration for a service center and animal shelter.
At the same time, investigate cost of an alternate possibility of
land acquisition and construction in lieu of purchase.
3. Author ize Staff to prepare process for purchase of
Certificates of Obligation in the amount of $750,000 for (a)
right-of-way acquisition for FM 3009 project and (b) acquisition
of land, building or construction of a service center and animal
shelter."
Under #7 of the minutes of December 5, 1989, Mrs. Marsh requested
the second sentence be corrected to read: "Mrs. Marsh added her
thanks to all those who worked so hard."
Mrs. Marsh also asked that the second sentence of # 14 of the
minutes of the meeting of December 13, 1989 to corrected to read:
"He asked about nomination for volunteer of the year."
Mr. Baldwin requested the 4th sentence of #6 of the minutes of
December 13th be corrected to read: "Mr. Baldwin advised that
the problem with the buses using the recessed area was that
mothers were stopping their vehicles on the other side of the bus
to let children off, and the children were then going in front of
and in back of the bus to get to the sidewalk."
Mr. Hartzog referred to the minutes of the meeting of December 5,
1989 and asked that the date of the Melick, Armstrong and Vaughan
party under #6 be corrected to read "December 8th."
Mrs. Marsh moved the minutes of the Regular meeting of December
5, the Special Meeting of December 13 and the Regular Meeting of
December 19, 1989 be approved as corrected. Mr. Greenwald
seconded the motion, which carried with the following votes:

AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and
Greenwald for the meetings of December 13th and 19thi Stanhope,
Marsh and Greenwald for the meeting of December 5, 1989.
NAYS: None
ABSTAINING: Mr. Hartzog and Mr. Baldwin for the meeting of
December 5, 1989.
#2 HEARING OF RESIDENTS: none
#3 GFOA AWARD: Mr. Sweatt said that, as Council knows, the
Government Finance Officers Association presents a Certificate of
Achievement to those entities who prepare comprehensive annual
financial reports that are in keeping with certain standards and
goals. We are please to aCknowledge that this year the City of
Schertz has received this achievement for excellence in financial
reporting for fiscal year ending September 30, 1988. He said
although the Certificate specifically mentions him as Director of
Finance, he would like to recognize those who helped to achieve
this award. First, the audit committee, which included Mayor
Sawyer and Mayor Pro Tem Baldwin, our Finance Officer Debbi
Williams and more particularly the firm who prepared our audit _
Melick, Armstrong and Vaughan.
Mayor Sawyer, in recognizing the audit firm, said Council has
enjoyed dOing business with them these many years and appreciate
their time and effort.
Mr. Armstrong advised that this is the fifth time Schertz has
received this award. He said it has been a few years since we
have applied for this award. It is a major achievement - less
than 1% of the cities in the United States ever receive this
award. It is a very prestigious award over and above normal
reporting. He added that several years ago when the City went
out for bonds, the fact that the City had received this
achievement helped the City to receive a better bond rating. He
added that he fel t the City should be recognized for having
achieved something that very few cities in the nation will ever
receive.
#4 ORDIIIAlfCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 90-D-l
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF
ORDINANCES, CITY OF SCHERTZ, TEXAS, BE
AMENDED BY REVISING SECTION 18-76 OF SAID
CODEi PROVIDING FOR SPEED LIMIT ON EAST LIVE
OAK ROAD.
Mr. Baldwin moved to approve the final reading of an ordinance
providing for speed limit on East Live Oak Road. Mr. Hartzog
seconded the motion, which carried with the following vote:

#5 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 90-T-2
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, ADOPTING GUIDELINES AND
CRITERIA FOR TAX ABATEMENT AND RE-INVESTMENT
ZONES.
Mrs. Marsh moved to approve the final reading of an ordinance
adopting guidelines and criteria for Tax Abatement and Re-
investment zones. Mrs. Stanhope seconded the motion, which
carried with the following vote:
AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#6 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE
ESTABLISHING RULES AND REGULATIONS GOVERNING
THE BORROWING, RETENTION AND CARE OF LIBRARY
MATERIALS AND REGULATING CONDUCT WHILE ON
LIBRARY PROPERTY AND PROVIDING PENALTIES FOR
VIOLATION OF THE SAME.
Mr. Hartzog moveg to approve the first reading of an ordinance
regulating failure to return library materials. Mr. Baldwin
seconded the motion, which carried with the following vote:
AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
Mr. Sweatt related that this ordinance would make it unlawful for
a person to borrow 1 ibrary material and fai 1 to return it. In
the event they do not return the material, there are fines by
which we can recover the expense. He said that most borrowers
return their booksi and it is only the small number who do not
that is driving up our costs. Mrs. Douglas said the average book
costs about $27.35. We believe this will be an added incentive
for patrons to return the books.

INTENT TO PARTICIPATE WITH THE ALAMO AREA
NARCOTICS TASK FORCE; AUTHORIZING THE CITY
MANAGER TO ENTER INTO AN AGREEMENT TO
PARTICIPATE IN THE TASK FORCE AT NO COST TO
THE CITY
Mr. Hartzog moved to approve the resolution declaring the City's
intent to participate with Alamo Area Narcotics Task Force. Mrs.
Stanhope seconded the motion, which carried as follows:
AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#8 PROPOSAL: Consider and take action regarding radio and
auto equipment financing proposals.
Mr. Sweatt said we have provided within the operating budget for
receipt of financing proposals for both new vehicles and radios.
This was originally established in the budget as a lease-purchase
item and we solicited bids accordingly. As a result of the
review of the two proposals received, we recommend that you
reject all bids and authorize the City Manager to consider this
item as a part of the over-all Certificates of Obligation issue
that is being discussed for early this year. We could save
approximately $2100.
Mr. Baldwin moved to reject the bids received on radio equipment
and vehicle financing proposals. Mr. Greenwald seconded the
motion, which carried with the following vote:
AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and
Greenwald.
NAYS: None
#9 CITY MANAGER'S REPORT: A. We have tentatively set for
January 16th at 10:00 a.m. a brief ceremony regarding the opening
of the County Sub Tax Office and Juvenile Probation Office.
B. It is our intent to close the 1 ibrary during the week of
January 15 - 20 to accomplish the carpeting and relocation of the
shelving and books. We will begin publicity of this closing at
this time.
# 10 ITEMS BY COUNCIL: Mr. Hartzog advised that he had
filed that day for the office of District Clerk of Guadalupe
County.
Mr. Greenwald advised that the Mayor, Council and City Manager
were all invited to the Opening Day of the Basketball Season
Saturday the 6th of January at 9:00 a.m. at Corbett Junior High.
