ccswks 02-28-1990 (":>;; ~ c:: SPECIAL SESSION OF THE CITY COUNCIL FEBRUARY 28, 1990 The Schertz City Council convened in Special Workshop Session, Wednesday, February 28, 1990, at 7:00 p.m. in the Conference Room of the Municipal complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Earl P. Hartzog; Hal Baldwin; Barbara Stanhope; and Ken Greenwald. Absent: Mary Marsh. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. #1 getting citizen certain HEARING OF RESIDENTS: Mr. Bill Neller explained about a call from the American Legion in seguin concerning a wanting a flag placed in the cemetery in Cibolo on flag days. He advised that they would be doing this. Mr. Neller said that last year the American Legion received a call from a school administrator who said they had a student in the Junior class that wanted to go to Boys State in Austin and he wanted to know if they would sponsor him. It would cost about $200 and that is about what they had in their treasury, so they sent him. In the event they get alike request this year, they wanted to know if they could possiblY contact citizens of Schertz; and for a minimal amount of money, they would paint the house number on the curb in front of their homes. He asked if a permit was required for this. Mr. Sweatt said there is an ordinance that requires a solicitors 1 icense for persons going door to door sell ing a product or a del i very of items. He said they would need the names of the people who would be going. He said perhaps they could waive the fee for an exempt organization but the organization would need to make the application. Mr. Neller also asked if they could possibly use the Newsletter to inform the citizens that they will be contacting the people with this request. Mayor Sawyer agreed. 12 Discussion of an ordinance amending the Zoning Ordinance by rezoning 5 tracts of land out of Comal and Guadalupe Counties. Mayor Sawyer asked if anyone had any new information or questions on this item and received none. #3 Discussion of an ordinance calling an election for May 5, 1990 for the purpose of electing a Mayor and Councilmembers Places 1 and 2. There was no new comments on this ordinance. #4 Discussion of an ordinance abandoning right-of-way and authorizing the Mayor to execute a Quitclaim Deed conveying 0.40 acres of land to the Schertz-Cibolo-Universal City Independent School District. ~ 14(~ ...L a Mayor Sawyer reminded Council that gentleman questioned this conveyance. as best he could and asked Mr. Baldwin of view. at the last meeting a He said he had explained to give the school's point Mr. Baldwin said the extension of Williams Street in front of the Schertz Elementary was not deeded to the School District when they bought the property. The City does not have any record of it being City property either. It has always been considered as belonging to the school and the school has accepted that and has maintained it. Now part of the bond issue they just passed is to pave that street, put in curbs and a parking lot on one side; and they did not want to do that unless they owned the street. Their attorney said the best way to handle it was to have the City assume it was their property and Quitclaim it to the School Distr ict. He went on to say that it probabl y is a City street because utilites on in there. He said the meter is on the school side of the street and they would like to relocate the water line and the gas line and put the meter in the alley. #5 Discussion of the City's recommendation regarding revision to Federal Communication Commission's Cable Regulations. Mr. Sweatt said we included in the packets a May 1989 letter that was sent to Senator Benson, Senator Graham and Representative Laughlin regarding cable legislation. Also attached letters of reply from these letters and a new article relating to the FCC Regulations. As you are aware, Paragon has filed their request and statement of intent to increase cable rates. Mr. Greenwald said the reason he had asked that this be on the agenda is that it is ironic that right after the article appeared, Paragon filed their intent to increase rates. The article explains some of the things the FCC is considering. He said we should send a letter or resolution to the FCC and encourage all our surrounding cities do the same. We should quote Mr. Guerrero who said they would not increase over 7. 9% maximum; and in less than six weeks, they went up almost 20% and now they are gOing up another 10%. We need as much input into the FCC as we can possible get to them. Mr. Baldwin said we should get the Paragon to cut us all out and then get come in. If all cities in the Randolph want your service when our contracts done. RandOlph Region to tell another cable company to Region said we no longer end, something would be Mr. Sweatt said the other companies he had contacted said they could not afford to compete with the present company. The alternative would be that they buyout Paragon or at the time the franchise expires, we would cut out. However, all the contracts with Paragon do not expire at the same time. i i I )' Mrs. Stanhope said the people are the ones that can bring them to their knees by giving up their service. Mr. Greenwald said right now there is no one that has any control over the rate structure. When we had some control, we could keep the rate within reason. Mayor Sawyer said we could try to get the United Suburban Cities to pass resolutions with us. He then asked if Council would be ready to act on a resolution at the next meeting and they agreed they would be ready to act. #6 Discussion of an ordinance amending the Code by adding Chapter 15-1/2 Sexually Oriented Businesses. Mr. Sweatt said Council adopted a comprehensive ordinance dealing with this. We amended the Code but we would like now to set it up as a Chapter number in the Code. #7 Review of preliminary specifications for Official Notice of Publication. Mr. Sweatt said that some time ago we had discussed various means of communication regarding our official notice of publication. He is asking tonight for any comments or recommendations to add to items we should include in our request for proposals. It is our intent to solicit proposals from various newspapers. He went over about ten items: 1. Legal Notice items - price per column inch in classified section; 2. Help wanted charges - price per word rate; 3. Charges for legals that must, by law, appear in some other section besides the Legal Section and that have special heading specifications - price per column inch through the general news section; 4. Deadl ine for receipt by the paper for legal notices; 5. Circulation date - both an audit statement and information as to distribution in the City of Schertz; 6. Area of coverage; 7. Question as to furnishing galley proofs prior to publication time; 8. Do they provide discount on notices, either classified or others, that repeat within 14 days; 9. Sol ici t a charge for monthl y distribution in Schertz area only of the newsletter furnished by the city; and 10. A written statement as to how the newspaper qualifies as a newspaper of general circulation in the City of Schertz. Mr. Hartzog asked about garage sa Ie notices item asking what percentage of newsprint material. and to incl ude an used is recycled #8 EXECUTIVE SESSION: Mayor Sawyer called an executive session under Article 6252-17 V.T.C.S., Section 2 {f} for a discussion of land acquisition and Section 2 {g} discussion of personnel at 7: 19 p.m.. The Special Session was reconvened at 8:40 p.m. 150 #9 Consider and take action, if any, on the items discussed in No. 8 above. Mr. Greenwald moved to authorize Mr. Sweatt to proceed with the land acquisition for widening of FM 78 and proceed with land acquisition discussions for a water well site. Mr. Hartzog seconded the motion, which carried with the following vote: AYES: Councilmembers Hartzog, Baldwin, Stanhope and Greenwald. NAYS: None Mayor Sawyer advised that under the second part of the Executive Session, there was no action necessary because they merely discussed rating of personnel. #10 CITY MANAGER'S REPORT: A. Acknowledge recent resignation from our Police Service - Officer Tony Garland has resigned. B. He distributed a tabulation of bids received this date for vehicles that are a part of our budget and capital acquisition program. We would like to place this on our next action agenda to be acted upon. This is for three vehicles - a I-ton truck in the Street Department for sign maintenance and the other I-ton to be for the Water Department as part of their maintenance and the half-ton truck for the Park Department. We had originally solicited these bids and asked that Council reject them because of an advertising problem. We received three bids and on each Bluebonnet Motors is the apparent low bidder. C. Presented the schematic showing the 1-35 off-ramps. D. Reminder of a notice of the Texas Lutheran College meeting on March 20th on Economic Community Development matters. #11 ITEMS BY COUNCIL: Mrs. Stanhope: A. She had a couple of calls regarding the van being used for senior citizens. It is no longer under the Housing Authority's jurisdiction, Guadalupe County took it back. This was brought about by an accident and there are some new guidelines; but they are still going to Wuests etc. and seem to think it will eventually be coming back. B. sign. She asked if staff was working on the logo for the front Mr. Sweatt said staff was working on that. C. She then asked if anything was being done about the speed on Schertz Parkway. Mr. Sweatt said the Chief of Police is handling that. D. When a new business comes in, do we have a packet for them. Mr. Sweatt said yes we do have the Newcomer's packet that goes to ) ':; I, ':'vjj anyone that opens a utility account. putting a map in the packet. Mrs. Stanhope suggested Mr. Baldwin: A. Said as he had promised, he went to Las Colinas when he was in Dallas and took several pictures of the overlay district there. Mr. Greenwald: A. The Child Care services sign at the Corner of Curtiss and Schertz Parkway really looks terrible. Mayor Sawyer suggested checking with the dentist to see if he thinks it is the city's property and that we want those signs to be placed there. B. Cibolo Valley Alcohol and Drug Abuse will have their monthly presentation at the Schertz Library with Dennis Smith of HCA Hill Country speaking on "Is There Crisis in Your Marriage?". C. On March 10th, there will be the ribbon cutting at the Library; the Closing Day Ceremonies for BVYA and the basketball game at 1:00 p.m.. KENS TV will be out filming the game. #12 ITEMS BY MAYOR: A. A man talked to him about putting a speed trap on Nell Deane; also about the skateboard thing in the same area being dangerous. B. On March 13th, the VFW will entertain 30 people from Audie Murphy Hospital. They will have some games etc. and will be there from 10:00 a.m. until about 2:00 p.m. C. He has been invited to speak to different classes at the schools - the 4th and 6th grades. # 13 ADJOURNMENT: There being no further business, Mayor Sawyer declared the meeting adJourned at 9'13 p m ATTEST: Schertz '-....
