REGULAR MEETING OF THE CITY COUNCIL
MAY 1. 1990
The Schertz City Council convened in Regular Session, Tuesday,
May 1, 1990, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz. Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Earl Hartzog; Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken
Greenwald. Staff present were City Manager Kerry Sweatt and City
Secretary June Krause.
# 1 PUBLIC HEARING: The Counci 1 to cons ider adoption of
Impact Fees for new or expanded water and waste water service
extension or connection to the Municipal Utilities System.
Mayor Sawyer asked Mr. Ty Brisgill, Chairman of the SB336
Advisory Committee to make a few comments.
Mr. Brisgill said that according to SB336 the City Council must
appoint an Advisory Committee to work with an engineering firm to
make recommendations to the Council on the impact fees. The
Council appointed the Planning & Zoning Commission to act in this
capacity. The members of this committee meet requirement of the
state law. Some of the functions of the committee are to advise
and assist the City Council on land use assumptions; review the
capital improvement plan regarding water and waste water capital
improvements; monitor and evaluate the implementation of the
program; advise Council of updating or revision of the program
and/or fees, if necessary; file a semi-annual report eval uating
the progress of the City; and file written comments with the City
on the plan not less than five days before the public hearing.
Mr. Br isgill said that after several months of meetings, the
Advisory Committee has made their recommendation concerning the
Impact Fees on water and waste water. After considering all
information, the committee has agreed with the rate structure
submitted by Mr. Bierschwale, City Water/Waste Water
Superintendent. The rate for water connection should be $550 per
Living Unit Equivalent and $650 per Living Unit Equivalent for
Waste Water. These rates are under the maximum allowed under
SB336. He then recognized Ms. Mickey Fishbeck with Rimrock
Consulting Company.
Ms. Fisbeck went over the requirements of SB336 for the benefit
of the public, who might not be aware of the process. She said
it is a two step process. The first being to develop planning
assumption, which was presented to and passed by the Council
previously. This hearing specifically deals with the Capital
Improvements Program that was developed to determine the
construction costs and development of the fees Basically the
steps they were required to go through according to law were
first to develop a service unit that was the basis on which to
charge the fees. They chose to use the water meter to determine
the Living Unit Equivalent. Next. they had to estimate current
and future demands. She advised that there is sufficient

capacity in the system fer residents; and within the next ten
ye::u period there will be a need for additional water supply
facilities and ground storage facilities. There, of course, will
also be a need for additional line work. With waste water, the
Schertz fee will include onlY line work because waste water
treatment is provided by CCMA or HBU. Both of those entities are
proposing or have adopted impact fees, which will be passed along
to Schertz and we are incorporating them into this process.
After the demand projections were performed, the law required the
engineer to perform an inventory of existing capital facilities,
determine their capacity and what amount of t~at capacity was
needed for existing customers, and how much \'IIas reserved for
growth. What resul ted from all this was a weighted cost per'
Living Unit Equivalent for the various types of facilities that
are required for service. That weighted cost gave the fee payer
the benefit of having the lower cost associated with being able
to utilize facilitles that are already in the system and require
them to pay a proportionate share of future facilities that will
be bui 1 t at genera 11 y higher cos t s . As you can see from the
charts, the costs for providing water service is $1211 and th3.t
for sewer service is $1377. We also were able to add the cost of
performing the study on top of that.
Mr. Ed Ford then discus sed what faci 1 it ies were in the Capi ta 1
Improvements Procram ICIPJ, saying that at the last public
hearing we discussed the plant facility and cc>st alloc:ated to
each. For water pumping, we have two wells in Universa~ city and
two wells at Nacogdoches that are provid.ing water to the ,::itv.
There is an additional well that is being pre'jected on
Lookout Road that would add to the system. The current
population is using about a .86 million of gallons out of a total
capacity of over a million gallons a day. With the future
facilities. that will bring 1.32 million 9allons on line, which
will be part of the usage for future development. FJr groun,j
storage, we have the existing facilities which are the Live Oak
tank, the Ware- Seguin tank, and the Deer Haven tank. Then i.Ie
have the elevated tank located on Nacogdoches and two gre,und
storage tanks in Universal City, that are classified as elevated
storage because cf the physical characteristics of the tanks. We
do have a future tank that will be going in ()n Lookou't Road.
which is a 1-1/2 million gallon capacity, and it's cost would be
prorated into the future grDwth. As growth takes place we will
update the impact fees. For the transmission or providing
facilities to transport water from these facilities to the
community, 'vole have taken into consideration the 18". 20" and 16"
mains that the city has constructed; and we are taking intJ
consideration the future mains that will be going in ana
connected to the Lookout Road facility and in the Schirmerville
area. Mr. Ford said the primary area for sanitary sewer is the
extension of waste water lines and collector lines that will be
associated with the New Braunfels colle..::tion line extersions.
These were all used to come up with the costs.

Ms. Fisbeck advised that the law says that you cannot charge more
than the fees established. She then explained the law in detail.
She explained the mechanism used in the past was the Equity
Residual Model and has been around for five or six years and has
been used by a number of cities and has been found to be one of
the best systems in Texas. She then illustrated the concept used
in developing the fee amount.
Mr. Simonson then stated that from the date of this public
hear ing, the ordinance must be adopted wi thin thirty days. We
therefore, ask you to consider the ordinance on first reading at
this meeting even though there may be some minor changes.
Mayor Sawyer declared the public hearing closed at 7:25 p.m.. He
then asked everyone to join him in the Pledge of Allegiance to
open the regular meeting.
#2 APPROVAL OF MINUTES: Special meeting of 3-28-90.
Mr. Hartzog moved to approve the minutes of the regular meeting
of March 28, 1990. Mrs. Stanhope seconded the motion.
Mr. Baldwin asked if the wording "passed on first reading" was
correct. Mr. Sweatt advised that the first reading of an
ordinance is either ~passed or approved~, whichever is preferred.

# 3 HEARING OF RESIDENTS: Mr. Sharpe, representi ng
Guadal upe County Appraisal Distr ict, said they interviewed 11
applicants out of 35 received. On Monday night they hired a new
Chief Appraiser, Mrs. Pat Fox, the Deputy Assistant to Comal
County. He added that she brings a wealth of experience to this
posi tion, having been in the appraisal district for about ten
years and prior to that in tax offices and real estate. She will
take over her position on the 15th of May. Then he advised that
on the 15th of May, they will begin mailing out appraisal notices
to everyone.
#4 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:

ALL ORDINANCES IN CONFLICT.

regulating speed limits on Schertz Parkway. Mr. Hartzog seconded
the motion, which carried with the folloWing vote:

#5 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE
OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT
THE CITY CODE BE HEREBY AMENDED BY REVISING
ARTICLE V OF CHAPTER 19 TO READ AS FOLLOWS:
Mr. Greenwald moved to approve the first reading of the ordinance
on capital recovery fees. Mr. Baldwin seconded the rno~ion. which
carried with the following vote:
AYES: Councilmembers Hartzog. Baldwin. Stanhope, Marsh and
Greenwald.
NAYS: None
#6 CITY MANAGER'S REPORT: Mr. Sweatt asked the Council to
mark their calendars for June 2nd for the annual Volunteer Fire

discuss Senior Citizen Appreciation Day after this meeting.

#8 ITEMS BY MAYOR: Mayor Sawyer asked Mr. Sweatt to find
out how often our patrol officers go through a subdivision.
He also advised that on Webster, just off FM 3009. there is a big
hole, please check to see if it is our responsibility or that of
the State.
