REGULAR MEETING OF THE CITY COUNCIL
MAY 15, 1990
The Schertz City Council convened in Regular Session, Tuesday,
May 15. 1990, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz J Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Earl P. Hartzogi Hal Baldwin; Barbara Stanhope, Mary Marsh and
Ken Greenwald. Staff present were City Manager Kerry Sweatt and
City Secretary June Krause.
Mayor Sawyer opened the meeting by leading the audience in the
Pledge of Allegiance. He then read a proclamation urging
ci tizens of this community to recognize the mer its of and to
support the Buddy POppy Program and then presented the
proclamation to Doug Christmas, representing the Veterans of
Foreign Wars.

Mr. Hartzog moved to approve the minutes of the Regular Meeting
of April 3, 1990 and the Special Meeting of April 11, 1990. Mr.
Baldwin seconded the motion.
Mrs. Stanhope referred to the minutes of April 3rd and requested
the spell ing of Mrs. Marsh' name be corrected in item #5 i the
last sentence of the first paragraph of item #8 be corrected to
read: ~The property can be used for residential purposesi but it
will require a variance to put a residence on the 50' lot and we
have asked the Planning & Zoning Commission to consider that as
part of the sal e. " She al so asked that in item # 10 the school
name be correctly stated as ~Corbett Junior High School~.
Mayor Sawyer then called for a vote on the motion, which carried
as follows:
AYES: Councilmembers Hartzog, Baldwin. Stanhope, Marsh and
Greenwald.
NAYS: None
#2 HEARING OF RESIDENTS: Mr. Carl Clark of 320 Lori Lynn
had several items he wished to discuss with Council.
A. Regarding the painting of our water tank in Garden Ridge, he
felt we should have left it as it was or that the City of Garden
Ridge should have paid for the repainting if they did not like
it.
B. He said the City has an ordinance about branches hanging over
sidewalks; but the City is getting lax in enforcement as there
are some sidewalks you can not walk down without ducking
branches.

City about a year ago and when he found out what they paid, he

some are not. Oak Street is 20 miles per hour and he was told it
was because of the park; however, on the other side of the park
the speed limit is 45 miles per hour.
Mayor Sawyer said on the matter of the water tank, we vJere
supposedly in violation of their law, that is why we repainted.
We will look into the branches hanginG over sidewalks. As to
F.M. 1518. that is a State road and we will certainly see \vhat
the State says about widening.

portion of the City. The thing is that those are only picked up
once a week and a lot of our residents feel that with only once a
week pick-up, the barrels would smell terrible.

Mayor Sawyer said we try to take care of our employees and pay
them a decent wage and are trying to br ing them up higher and
higher so that we don't loose our good employees.

Mayor Sawyer expressed his thanks for their kindness to our
employees. He said that we all enjoyed the day with the students
and felt they gave good reports. He thanked Mrs. Briscoe for the

# 3 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 90-F-15
AN ORDINANCE OF THE CITY OF SCHERTZ,
PROVIDING THAT THE CITY CODE BE HEREBY
AMENDED BY REVISING ARTICLE V OF CHAPTER 19,
WATER AND WASTEWATER CAPITAL RECOVERY FEES,
AND PROVIDING A REPEALING CLAUSE.
Mr. Sweatt said that most of the changes that our legal advisors
made to the ordinance were housekeeping matters; perhaps changing
grammar, making things more understandable and to clar ify some
issues. We have removed exhibits A and B, which are maps that
will from time to time change with growth of the area. These maps
will be placed in the office of the City Secretary and can be
more eas il y changed by not being a part of the ordinance. On
page 12 we completelY rewrote the description of the manner in
which the capital recovery fees are calculated per service unit.
Then on pages 14 and 15, we clarify that hard-ship cases can be
paid out over a period of twelve months. The appeal process for
determination was fel t to be a technical determination, rather
than a determination based on eval uation. The remainder of the
changes are mainly rearranging of wording.
Mike Spain said they spent some time on this ordinance and most
of the changes were merely housekeeping changes.
Mr. Greenwald ffigved to approve the final consideration of an
ordinance amending the Code of Ordinances by revising Article V -
Water and Waste Water Capital Recovery Fees. Mr. Hartzog
seconded the motion, which carried with the following vote:
AYES: Councilmembers Hartzog, Baldwin, Stanhope. Marsh and
Greenwald.

#5 MAYOR PRO TEM: Consider and take action on selection of
a Mayor Pro Tern for 1990.

for this year. Mrs. Stanhope seconded the motion.
Mrs. Marsh said she would first like to know what the policy is
on the selection of Mayor Pro Tern.
Mayor Sawyer said the policy is that it is up to the City Council
and it is written in the City Charter.

Mrs. Marsh said she felt that anyone on the Council would make a
good Pro Tern and that Ken Greenwald would make an excellent Mayor
Pro Tern; but she was disturbed with the lack of how this is done
and the discrepancy that seems to go on every year.
The vote was then taken on the motion. which carried as follows:
AYES: Councilmembers Potempa, Baldwin, Stanhope. Marsh

ABSTAINING: Mr. Greenwald.
Mrs. Stanhope said she felt Council needed to set up a poliCY on
this. Mayor Sawyer advised this subject should be placed on the
next workshop agenda.
# 6 ORDINANCE: Mayor Sawyer introduced an ordinance 3nd
read the caption as follows:

read the caption as follows:

PROGRAM; DESIGNATING A RECORDS MANAGEMENT
OFFICER; ESTABLISHING A RECORDS MANAGEMENT
COMMITTEE AND PROVIDING FOR THE DEVELOPMENT
OF A RECORDS MANAGEMENT PLAN AS REQUIRED
UNDER THE TEXAS LOCAL GOVERNMENT RECORDS ACT
(TITLE 6, SUBTITLE C, LOCAL GOVERNMENT CODE).
Mrs. Stanhope moved to approve the first reading of an ordinance
establishing the Office of Records Management. Mr. Greenwald
seconded the motion, which carried as follows:
AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and
Greenwald.

shoes was going to be a big job.
Mr. Baldwin advised that the Senior Citizen Appreciation Day went
very well and he is in the process of writing thank-you letters
to those who made donations of prizes and their time.

Mayor Sawyer then thanked each member of the Council for their
past endeavors on behalf of the Council and for their new duties
as well.
C. Mr. Sawyer announced that the VFW has asked us to clean up
the area around the monument and flaq poles in the park. If the
City has a ~City Flag", they want to add another flag pole and
fly all three flags.
D. He then asked the City Manager if there has been any progress
on the purchase of Mr. Osborn's well. Mr. Sweatt said yes, the
City Attorney and staff are working on the proposed offer now.
E. Mr. Sawyer said he had a 1 ist of some of the things the
Council must do in the coming year:
1. Have a recycling program instituted by no later than
September of this year.
2. Intend to continue efforts to bring industry to our city.

4. Would like to improve our citizen response time.
5. Would anticipate that the city Council will continue to keep
taxes as low as possible.
6. He said he planned on continuing the quarterly audit program
in order to keep the Council better informed on any budgetary
problems that may arise.
7. Will continue to keep our park system up dated.
8. Mayor Sawyer said he watched the TV news prior to coming to
the meeting and he was shocked and appalled at the sign on our
water tank in Garden Ridge and he wanted to find out who is
responsible for doing that. He said he would take action against
that person, regardless of who they are - if they work for the
City, then they will no longer work for us. He said he felt it
was an insult to our City and an insult to Garden Ridge because
it is in their city 1 imi ts. He said he wished to apologize to
the residents of Garden Ridge for the article that was on
television. He said he could see no reason at all to print
something on the tank to cause another word to be made out of the
name of this fine City. This is not a thing we would be proud of
and he will insist that we find out who is responsible for this
and to see that they are brought to some form of justice.
#11 ADJOURNMENT: Mrs. Marsh moved the meeting be adjourned
at 7:39 p.m.. Mr. Baldwin seconded the motion, which carried
unanimously.
