ccreg 06-05-1990 ..\ (';, "} ',) L.U"-i REGULAR MEETING OF THE CITY COUNCIL JUNE 5, 1990 The Schertz City Council convened in Regular Session, Tuesday, June 5, 1990, at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Barbara Stanhope; Mary Marsh and Ken Greenwald. Absent: Joe Potempa and Hal Baldwin. Staff present were City Manager Kerry R. Sweatt and Deputy City Secretary Alice Austin. #1 PUBLIC HEARING: Mayor Sawyer advised that this was a publ ic hear ing to receive comments from citizens on a zoning change requested by Edgar Von Scheele to rezone a 2.286 acre tract located at the Southwest corner of Schertz Parkway and Pecan Drive from General Business (GB) to Garden Home Dwell ing District (R-5A). Mr. Greenwald advised that Mrs. Henderson had dropped a letter off opposing the zoning but had not marked a reason. Mr. Sweatt advised that out of 61 letters, 3 were opposed. Mr. Sweatt asked Mr. Vaughan to explain what type of housing would be on this property. Mr. Vaughan advised that he was representing Mr. Von Scheele and would be building the homes. They would be garden homes in the smaller variety ranging in price from 60-70 thousand dollars. He advised that there would be 11 lots. The homes would be approximately 1200 to 1300 square feet with 2 car garages and 2 car drives. Mayor Sawyer closed the public hearing at 7: 10 p.m. #2 APPROVAL OF MINUTES: Mrs. Stanhope advised that she would like to make corrections as follows: Meeting of April 25th, #7 Items by Council. para 2 line 2 change like to liked. Mr. Greenwald made the motion to approve the minutes of the Regular Meeting of 4-17-90. the Special Meeting of 4-25-90 and the Regular Meeting of 5-1-90 with corrections. Mrs. Stanhope seconded the motion which carried with the following vote: AYES: NAYS: Councilmembers Stanhope, Marsh and Greenwald None #3 HEARING OF RESIDENTS: None / 64 APPOINTMENT OF RESERVE OFFICER: Chief Agee advised that they were recommending Rodney Hubbard for Council consideration as a police Reserve officer. He advised that Rodney had put himself through the training course required and a background check had been performed. He advised that Rodney had been a ve,l unteer with other organizations and was well knc,wn around the city. Mr. Greenwald made the motion to appoint Rodney Hubbard as a Reserve Officer for the Schertz police Department. Mrs. Mar:sh seconded the motion which carried with the following vote: AYES: NAYS: Councilmember Stanhope. Marsh and Greenwald None #5 INTRODUCTION: Chief Agee introduced two new members of the Police Department Beverly Todd and Jack Heinesh. He advised that Officer Todd had beerl hired from the Reserve ranks and Officer Heinesh had been an officer in Windcrest. He Billy Keen, Chairman. Mr. Keen said that since the committee had been apPolnted by the Mayor in March they had conducted several public meetlngs. They had received technical assistance from Moore Industrial and Schertz City Staff. He advised that a consensus of the committee was that "no action~ is not an option. He presented five recommendations which were as follows: Establish a curbside recycling program 2. Build or participate in the building of a recycling faCility with a capacity of 200+ tons per day. 3. Develop composting program to use yard v.laste as a soil conditioner/fertilizer. 4. Mrs. Marsh said that she did not think that they could go intc this item tonight but would like to have the committee come to a workshop. Mr. Keen advised that he could attend the workshop. Mrs. Marsh moved to approve the final consideration of an Ordinance amending the Code of Ordinances, City of Schertz by revising Chapter 10, Article III. Section 10-60 Exceptions. Mr. Greenwald seconded the motion which carried with the fOllowing vote: AYES: Councilmembers Stanhope, Marsh and Greenwald NAYS: None 18 ORDINANCE: Mayor Sawyer introduced an Ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE SUBDIVISION ORDINANCE NO. 87-S-11, ARTICLE II, PROCEDURE, SECTION 15.5. Mrs. Stanhope moved to approve on first consideration an ordinance amending the Subdivision Ordinance No. 87-S-11, Article I I, procedure, Section 15.5 Specif ica tions, Paragraph 0., One- foot Non-Access Easement and Section "C" , Definitions. Mr. Sweatt advised that various traffic counts had been performed in this area. That portion of Maske Road from FM 1518 to Schertz Park\oJay showed 128 vehicles. Maske Road from Schert:: Parkway t" E. Live Oak Road 20 vehicles and Schertz Parkway 793 vehicles. Mrs. Stanhope moved to approve on final consideration an ordinance amending the Code of Ordinances, City of Schertz. Texas. by revising Section 18-76 providing for speed limit on Schertz Parkway. TEXAS ADOPTING A PROCEDURE AND POLICY TO ESTABLISH THE MANNER IN WHICH THE POSITION OF MAYOR PRO-TEM IS SELECTED. Mrs. Stanhope moved to approve a resolution adopting a procedure and policy to establish the manner in WhICh the position of Mayor Pro Tem is selected. Mrs. Marsh seconded the motion which carried with the following vote: AYES: Councilmember Stanhope, Marsh and Greenwald NAYS: None #11 RESOLUTION: Mayor Sawyer presented fr:\r consideration a Resolution and read the caption as follows: RESOLUTION NO. 90-R-9 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE OCTOBER 1989- SEPTEMBER 1990 FISCAL YEAR OPERATING BUDGET. .\ 236 Mr. Sweatt advised that we projected a balanced budget but with no reserve. He also said that he wished to express his gratitude to the department heads for their work on the budget and their willingness to help. Mr. Greenwald moved to approved the resolution amending the october 1989-September 1990 fiscal year operating budget. Mrs. Marsh seconded the motion which carried with the following vote: AYES: NAYS: Councilmember Stanhope, Marsh and Greenwald None # 12 RESOLUTION: Mayor Sawyer presented for consideration a Resolution and read the caption as follows: RESOLUTION NO. 90-R-10 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS APPROVING PARTICIPATION IN PURCHASING PROGRAMS OF THE STATE PURCHASING AND GENERAL SERVICES COMMISSION. Mrs. Stanhope moved to approve the resol ution approving participation in purchasing programs of the State Purchasing and General Services Commission. Mrs. Marsh seconded the motion which carried with the following vote: AYES: NAYS: Councilmembers Stanhope, Marsh and Greenwald None #13 APPOINTMENT: Mayor Sawyer advised that the Planning & Zoning Commission is recommending Bob Andrews as Vice- Chairman. He also said that Mr. Andrews has served the Commission well as a member and as Chairman. Mrs. Marsh moved to approve appointment of Bob Andrews as Vice- Chairman of the Planning & Zoning Commission. Mr. Greenwald seconded the motion which carried with the following vote: AYES: NAYS: Councilmembers Stanhope, Marsh and Greenwald None #14 INSURANCE: Mayor Sawyer advised this item was to consider extending the City's contract for insurance with Bl ue Cross/Blue Shield for one additional year. Mr. Sweatt explained that with modifications to our existing coverage the increase to the city would be approximately 7.28% by approving Plan II. Mrs. Marsh said that for an employee to have to pay $175.40 for dependent coverage was atrocious. Mr. Greenwald moved to approve extending current insurance contract with Blue Cross/Blue Shield and opting for Plan II for one addi tiona 1 year. Mrs. Stanhope seconded the mc,ticn which carried with the following vote: AYES: NAYS: Councilmember Stanhope, Marsh and Greenwald None #15 FRANCHISE AGREEMENT: Mr. Sweatt explained that City Public Service had submitted a proposed ordinance to increase street rental charges from 2 to 3 %. He explained that the city's current franchise agreement was adopted in December of 1983 for 20 years. He advised that there were seileral areas within the proposed ordinance that he did not concur with. Section 5.1 and 5.2 is in need of revision since the city has an ordinance that requires a permit prior to cutting streets. Section 5.2 gives carte blanc for CPS to complete a job and leave wi thou t having respons ibi 1 it y fe-r damages. Sect ion 7 as ses ses tee for sity use of pole space need tc eliminate fee. Mr. Greenwald moved to approve on first reading an ordinance amending Ordinance 83-F-16 granting a franchise to the City of San Antonio acting by and through the City Public Service Board wi th the changes as notated by Mr. Sweatt. Mayor Sawyer asked the disposition of the report he had requested on the number of times officers patrol particular neighborhoods, Mr. Sweatt advised that the Police Department was working on this. 2.
