ccswks 06-13-1990 ': SPECIAL MEETING OF THE CITY COUNCIL JUNE 13. 1990 The Schert z C it y Counci 1 convened in Spec ia 1 Workshop Ses s ion, Wednesday, June 13. 1990. at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer. presiding; Joe Potempa; Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. #1 HEARING OF RESIDENTS: Mr. Ed Mazian reported there are some large chuckholes on Fawn Drive and deep drop-offs at edge of pavement where the water has washed out the soil. #2 Discussion recommendations. of Recycling Committee Report and Mr. the Billy Keen, Chairman of the Recycling Study recommendations of the committee as follows: Committee. gave 1. Establish a curbside recycling program. with recyclable material being picked up on one of the two normal pickup days and containers being provided by the waste hauler. Pros: reduced energy costs of producing varieties of products and a reduction of material entering landfills. Cons: Cost to household would be about $1.50 per month and the inconvenience of separation of recyclable materials in the home. Steps to implement include moti vat ing c it i zens to part icipa te , education and negotiation s with hauler to provide containers. 2. Build or participate in the building of a recycling facility to function a san integrated recyc 1 i ng center. prov idi ng for separation and marketing of commodi ties. Pros: this wO~lld be the optima 1 so 1 ution to beth recyc II ng and 1 andf i 11 probl ems. Revenues generated by the sale of recyclable commodities can fund all activities. Cc'ns: Cost is a major inhibitor. alcng \.Jith a perception that viable markets are not available. 3. Develop composting program to use yard waste as a s(,il conditioner/fertilizer. Pros: Signlficant reducticn of solia waste entering landfills. Cons: The additional cost of separation/pickup as well as the cost of operating a composting system. Steps would be to ontain site for composting operations and develop methods of disposition. 4. Designate a member of City staff to serve as envire.nmental coordinat.]r. 5. Require City Manager to aggressively pursue the purchase of recyclable products in purchasing decisions. She said she personally did not think it would be totally successful, and would require a lot of educating of the citizens. She added that she felt this was a good report but it is basic and now the heavy work can begin. Henry Gutierrez advised that he and Robert Treisch are considering putting in a drop-off center for recyclables at his old landfill site on FM 3009. He had discussed this with the City of Cibolo and they are in favor of it. He said maybe they could use the old I andf i II site for composti ng yard waste limbs, leaves and grass. Mr. Treisch added that the way they would arrange the drop-off center was to have a 30 foot trailer on site, manned from 8:00 a.m. until noon with one man separating the recyclable materials. This would incl ude glass, cardboard, metal, etc.. They al ready have an agreement with Wal-Mart in Universal City to do the same thing there and are going into three additional area locations next week. Mr. Gutierrez said this would be open Thursday, Friday and Saturdays. Mr. Keen said the real problem is in filling the landfills. committee is still recommending curbside pickup and felt should be a part of the negotiations when accepting bids haulers. Mr Keen added that Leon Valley has about participation in their curbside project. His that for 70% Mrs. Stanhope asked if any contact was made with cities across the nation who have had this service for a period of time. She told of a Cal ifornia city who has had great success with the curbside pickup. Mr. Potempa added that in New Jersey they have a complete package and it must be profitable or the people would not go for it. Mr. Greenwald felt the curbside service is the way we should go, the people will not pay for twice a week pickup and then take their recyclables somewhere else. Mayor Sawyer said we should have Mr. Sweatt go ahead a and negotiate for new contracts as we have been approached by 3 or 4 companies who are in the business. He said he would go for curbside service; but he did not mind the pickup center either. Mrs. Stanhope said she is all for starting with curbside service. Mr. Baldwin said he would also favor curbside service; and one of the things the Council should be looking at is recyclable materials on some of our projects. We have to generate a market in Texas. ) Mrs. Marsh suggested that Council endorse Mr. Gutierrez and Mr. Treisch to go ahead with their idea. We shoul d have an artic 1 e in our Newsletter. in the newspapers and by word of mouth. This is just the first step between now and October, when He ca:: negotiate for a new contract. At the same time, we can put forth recycling and consider goals for going into business for ourselves in the future. Mayor Sawyer commended the Committee for coming up with these recommendati,ons. He thanked them for doing a fantastic job on this outstanding study. Mr. Sweatt said he would like for Mr. Keen and members of his ~ommittee to give him input on the hauling contract negotiations. # 3 Discus s ion regardi ng Beck Readymix Cc.ncrete Campa ny' s request for Type IV Landfill. Mr. Sweatt advised that we have been dealing with Mr. Ben Davis. President of Beck Readymix Concrete Company, for several months. They have filed their application for a Type IV Landfill with tne Texas Department of Health. In August of 1989, we advised t:le Department of Health that we felt a public hearing to inform cur citizens and assess information concerning the implications ~Qr environmental damage to ground water and the Cibolo Creek would be appropri.ate. Mr. Davis, to give a little background. said they purchased this land in 1970 and even back then It was used as some type landfill. In 1984, there were some stricter type regulations imposed and they started dealing with the Department of Health in 1985. That is when they starting dumping; because at the time they were given Grandfather status. contingent upon their bringing it up to a Type IV Landfill. He said t:ley never expected to go into the public hearing stage; but now they have to yo through the complete permi ttiWJ process. Schertz is the only one that asked for a public hearing. He said he had until August to talk to:) the Council and hopefull y get them to revoke their reques t for a publ ic hear i ng . He said t ha t of the 212 acres, only about 162 acres would be dumped on. He then explained what the burm would look like to the people living on Zuehl Road and Mill Street. It will be abciut 110 to 137 feet from the street. Mr. Sweatt said the Heal th Department publ ic hearing is a very forma 1 hear i nCJ, 1 ike a tr ia 1 record. However. there is another type of hearing in which you can give property owners an opportunity to ask questions and give input. We can hold this type hear ing our se 1 ves, if we revcke the forma 1 publ ic hear i ng request. Council then questioned Mr. Davis about his plans. who said he would rather vlOrk things out wi th Council and have an informal hearing than to go with the formal Public Hearing held by the Department of Health. (jAC'fI .:;.. jtbJ Mayor Sawyer said why not go with the City hearing and asked Mrs. Krause to set up a date as soon as possible. Mr. Sweatt added that the earliest date would be July 17th and at that time we can talk about pulling our letter. On being questioned, Mr. Davis said this landfill should increase their traffic by about ten trucks per hour. He said he is in the process of obtaining a rear access onto FM 1518. Mr. Davis also said they would be extending the length of their concrete drive onto FM 78 to eliminate the trucks getting mud, etc. on the highway. Council agreed with Mayor Sawyer's request to set up a hearing ourselves for July 17th. #4 Consider request for City Counci 1 endorsement of Swim Team Program. Mayor Sawyer reminded Council that this was addressed last year. He then introduced Mary Peralto. Ms. Peral to handed out copies of the By-Laws of Schertz Area Youth Swim Organization (S.A.Y.S.O.) and copies of their Articles of Incorporation. She explained that they have received three quotations on insurance and will be making a decision on that soon. They have had a very good response as 106 youth are on their roster. When questioned by Mrs. Marsh, Ms. Peral to said that this year they do not have dues but have asked for a $10.00 donation from each. They also plan to have fund raisers throughout the season. The organization asked permission to use the pool facilities for practice. Mr. Sweatt said they wished to use the pool Saturday mornings for their meets and Tuesday through Saturday before opening of the pool for practice. He said we have secured Hold-Harmless Agreements that are part of our liability. They will provide Special Events insurance for members and their invited guests. He said Saturday mornings are no problem and he thought we could work out the weekday practice times. He said he saw no problems as long as they have life guards on the team while practicing. Mayor Sawyer said if it gets so big that it will start costing our taxpayers, then Council may have problems. He asked that Council be advised if the organization increases the membership by very many. He added that about all Council is providing for this year is the pool facilities. Mrs. Marsh said that next year they shoul d be se If - suff icient because they will be charging dues. Mayor Sawyer apPointed Mrs. Marsh as ex-officio member of this organization and wished them luck on their program. , ) #5 Discussion of Public Hearlng sCf:eduled for June 19 regarding proposed name change of Binz-Englemann Road to Beonig Drive. Council had no problem with the publIc hearing being held. #6 Discussion of Public regarding proposed amendment to District. Hearing scheduled for June 19 the Jack Hays Boulevard Overlay Mr. Sweatt said Council had asked to discuss the size of the signs and Section 2.3(e)6 states that signs would not exceed a height of eighteen feet seven inches (18' 7") and the maximum allowed size not to exceed 90 square feet in area. Mayor Sawyer received consent of Council for this public hearing. #7 Discussion ,)f orcanance regarding proposed fra:1chise agreement with City Public Service. Mr. Sweatt pointed out the recommended changes that were made ~o the ordinance, mainly housekeeping and to eliminate the reference to gas as they do not furnish gas in our city. Added was the statement that CPS shall replace or restore landscaping or improvements disturbed by CPS installation, repair or construction work - we really prefer that they bore rather that disturb the streets; that no fee shall be charged for use of pole space; changed the time for continuation of agreement to 30 days wr i t t en not ice and added Sect ion XIV on Liabi 1 it Y . He sald that Council had approved the first reading of the ordinance and now it should be sent to CPS for their approval, Council agreed lrJith this. #8 Discussion regarding final consideration of an ordinance amendi ng the Subdi vis ic,n Ordinance. Art. I I, Sect ion 15. 5, par a 0, One-foot non-access easement. Mr. Sweatt said that basically this sets up conditions in which we would hope to prevent curb cuts and openings. This gives us a one-foot barr ier. This was approved on first reading and is ready now for final consideration. #9 Discussion regarding Planning and Zoning recommendations regarding future annexation matters. Mayor Sawyer said he had looked these over and could find nothing wrong with the recommendations. Mayor Sawyer then explained. for Mr. Potempa's benefit, the procedures for annexation by a Home Rule City. '\ 244 #10 Discussion of ordinance adopting zoning change requested by Edgar Von Scheele to rezone 2.286 acres located at the southeast corner of Schertz Parkway and Pecan Drive. Mayor Sayer reminded that the publ ic hearing had been held and this is now ready for consideration of adoption. #11 Discussion of posts installed in City park. Mayor Sawyer said he had had several calls on this, that the post look terr ibl e, especial 1 y around the pav i 1 ion. He asked how we could object to people parking in that area and then allow the carnival. He said the posts look like a cemetery. Mr. Sweatt advised that they are the same as in National Parks. He said the posts were moved once to allow for an alley for unloading supplies. He said the posts on FM 1518 had been there for years. Mayor Sawyer said no one was objecting to those but just those around the pavilion. Mr. Greenwald said the main problem is that we do not have sufficient parking. After much Council discussion I Mrs. Marsh suggested taking out the post around the pavil ion, leave the rest in place and next year put in the budget for an additional parking area. Three Council members agreed to this idea. #12 EXECUTIVE SESSION: Mayor Sawyer called an executive session at 9:39 under Article 6252-17, Section 2 (f) of Vernon's Texas Civil Statutes to discuss property acquisition. The special meeting was reconvened at 10: 11 p.m.. #13 Consider and take action, if any, regarding item #12. Mayor Sawyer advised the only action taken was to ask the City Manager to begin acquisition of certain property in Schertz. #14 CITY MANAGER'S REPORT: A. He said he hope to bring to the next Council meeting the contract with the Business Club for the 4th of July Jubilee. The new contract is the 1989 verbatim. B. We have a conflict on the 4th of July. Budweiser has planned a major concert at Rotama and expect up to 100,000 people. One problem is going to be traffic off site as they plan to take traffic off 1-35 at FM 3009 and go down Lookout Road. Mayor Sawyer said that is a State problem and we should contact the State Highway Department and advise them they have this problem. Mr. Sweatt said if Budweiser wants to meet their responsibility, they could hire off-duty or reserve officers. If not, they can ) (---- ruin whatever they have planned. may have a problem. If it cannot be worked out. we # 15 ITEMS BY COUNCIL: Mrs. Marsh: A. Reported on the recent San Antonio/Austin Corridor meeting hosted by the Metro':om Chamber of Commerce at Woodlake. She said she had a table set up with hand-outs from Schertz. She said she handed out brochures and pI ugged Schertz. She then gave a report of the meeting. which included new businesses in the area. report ot t~e conference they had with Mexico with another conference coming up in Monterey in February. They donated $10.000 toward the conference. The name for the San Antonio-Austin highway has been changed from Parkway to Freeway and they need to estimate where it will go. She said they are going for 50% donations. It was a very good meeting. B. She is making out a schedule for working the booth at the 4tn of July Jubilee and no one should have to work ever one hour. Requested the residence at 5214 Irola Drive be rechecked for high weeds - complaints have been going on since September of 1989. B. At Plaza Drive and 1-35 in tne drainage ditch. there are sun flowers and thick vegetation. C. There are still people speeding on 1crala Drive and there is a gutted camper parked on the drive across from 5214. MJ::e.,..~.:L~nho.p~: A. At the Housing Authori,ty meetinq the main topic of discussion was speeders they are still having problems. She said they feel part of the problem is that people turn in thinking it is a through street to the Village. Mr. Sweatt said that most of the speeders are residents or relatives or deliver people. He said maybe the only sol12tion was speed bumps, even if it is nc>t the best ',.Jay. We coule make a quit claim to the HQusing Authority. close it as a public street and put i~ bumps. They suggested putting an article in our newsletter, saying ~hat if visiting, please be extra cautious t~ protect our senier citizens. M~.
