ccss-S BOA-ccreg 08-07-1990 )( 284 SPECIAL MEETING OF THE CITY COUNCIL AUGUST 7, 1990 The Schertz City Council convened in Special Session, Tuesday, August 7, 1990 at 6:00 p.m. at the Municipal Building, 1400 Schertz Parkway, Schertz, Texas, with the following members present: Mayor Earl W. Sawyer, Joe Potempa, Hal Baldwin, Barbara Stanhope, Mary Marsh and Ken Greenwald. #1 The Council immediately departed with the City Manager to tour the Police Department, Fire Department and Library. #2 This meeting was adjourned at 6:55 p.m. k ATTEST: REGULAR MEETING OF THE BOARD OF ADJUSTMENT AUGUST 7, 1990 The Schertz Board of Adjustment convened on August 7, 1990 at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas, with the following members present: Mayor Earl W. Sawyer, presiding; Joe Potempa, Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken Greenwald. Al so present were City Manager Kerry R. Sweatt and City Secretary June Krause. Before openinq the Board of Adjustment Hearings, Mayor Sawyer turned the meeting over to the President of the Business Club. Mr. Potempa then called Russell Wagster of the Street Department forward and presented him with a plaque for being selected "Employee of the Quarter". After being congratulated by the Mayor and Council Members, Mr. Wagster's supervisor, Jerry Graham, also congratulated him adding that Mr. Waqster had been employed by the City for about five years. He has served as Crew Leader and Now Foreman for the Street Department and had previously been selected as "Employee of the Quarter" for his department. 285 #1 The Board of Adjustment to receive citizen input on the followinq two requests: Mayor Sawyer advised that the two requests would be handled separatelY. A. Rick & Rita Saenz request for an eiqht foot variance to the front yard setback at 501 Aviation. Mr. Sweatt advised that 55 letters had been mailed to property owners within 300 feet of this property. Nine letters were returned as undeliverable, nine replies were received who were in favor of the variance and one received showing they were opposed. There were no citizens present wishinq to comment on this request. Mr. Baldwin moved to approve the request for variance to the front yard setback by Mr. & Mrs. Stanhope seconded the motion. an eiqht Saenz. foot Mrs. Mrs. Marsh said she felt that qrantinq this request would not set a precedence, that each request for a variance must be considered on its on merit. Mayor Sawyer then called for a vote on the motion before Council and the motion carried with the followinq vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None B. Southwest Remodelers' request, on behalf of the Bortels, for a four foot variance to the side yard setback at 700 Mitchell. Mayor Sawyer asked Mr. Scott Barr of Southwest Remodelers why they did not qet a permit before commencing work on this carport. Mr. Barr replied that there was a mix up between the on-site crew and his office. Mayor Sawyer stronqly requested that they do not commence work in the City of Schertz without first obtaining a permit. there were no citizens wishinq to comment on this request. Mr. Greenwald moved to grant the request from Southwest Remodelers, on behalf of the Bortels, for a four foot variance to the side yard setback at 700 Mitchell. Mr. Baldwin seconded the motion, which carried with the followinq vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. \ \" x 286 NAYS: None Mr. Potempa reminded Mr. Barr that since Southwest Remodelers had done the work prior to obtaining a permit, they would now have to pay double the fee for the permit. #2 Adjournment: There being no further comments on either of the Board of Adjustment hearings, the meeting was adjourned at 7:11 p.m. ATTEST: REGULAR MEETING OF THE CITY COUNCIL AUGUST 7, 1990 The Schertz City Council convened in Regular meeting, Tuesday, Auqust 7, 1990 at 7:11 p.m. in the Council Chambers of the Municipal Offices, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Joe Potempa, Hal Baldwin, Barbara Stanhope, Mary Marsh and Ken Greenwald. Staff present were City Manager Kerry Sweatt and City Secretary June Krause. # 1 APPROVAL OF MIlIUTES: A. B. Special Meetinq of 6-27-90 Regular Meeting of 7-3-90 Mrs. Marsh moved to approve the minutes of the Special Meetinq of June 27th and Reqular Meeting of July 3rd, 1990. Mr. Potempa seconded the motion. Mrs. Stanhope requested the eiqhth sentence of #4 of the minutes of the Special Meeting of 6-27-90 be corrected to read' as follows: "Among those, we struck out gas, wrote in conditions that provided for CPS to secure a permit to cut streets, changed the terminology so that they were required to place improvements back in the condition they were in when the work started." Mrs. Stanhope asked that the second sentence of #5 of the same minutes be corrected to read: "Mr. Sweatt said the directives applied to everyone." She also asked that the first sentence of 287 the third paragraph of #6 be changed to read as follows: "Mayor Sawyer asked an estimated cost that it would take to have the inspectors do this sort of thing on the weekends." After Mrs. Stanhope called attention to two spelling type errors, Mayor Sawyer called for a vote on the motion and the motion carried as follows: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #2 HEARING OF RESIDENTS: None #3 ORDlNAMCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 90-L-23 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS; PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 13, ARTICLE II, SECTION 13-14(b)(S) AND (7) AND SECTION 13-14(e) PEDDLERS' AND SOLICITORS' PERMITS; AND REPEALING ALL ORDINANCES IN CONFLICT. Mr. Potempa moved to approve the final reading of an ordinance amending the Code by revising Chapter 13-14 Peddlers' and Solicitors' Permits (b)(7) and (e). Mrs. Marsh seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #4 ORDINAMCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 90-L-24 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AMENDING THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, CHAPTER 10 BY ADDING ARTICLE VI GARAGE SALES; BY AMENDING ORDINANCE 86-S-28 SIGN ORDINANCE, ARTICLE V SIGNS PERMITTED IN RESIDENTIAL DISTRICTS BY ADDING SECTION 8 GARAGE SALE SIGNS; PROVIDING FOR A PENALTY; REPEALING ALL ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. Mrs. Stanhope moved to approve the final reading of an ordinance amending the Code of Ordinances Chapter 10 by adding Article VI Garage Sales. Mr. Potempa seconded the motion. \ ~ x 288 " 11 Mrs. Sweatt pointed out the effective date of September 1, 1990. He said it is our intention to begin an intensive notification to persons who are current I y placing signs for garage sales. We will put an article in the September Newsletter and handouts at the counter in an effort to get the word around. Mrs. Marsh wanted everyone to know that in passing this ordinance, the Council is not against garage sales. They feel these garage sales are helpful; but the fact remains that the signs the people have been placing makes the City look trashy. Mayor Sawyer then called for a vote on the motion and it carried as follows: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #5 ORDIBAIICE: Mayor Sawyer introduced an ordinance and read the caption as follows: Alf ORDIBAIICE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTION 18-76 OF SAID CODE; PROVIDING FOR SPEED LIMITS ON LOWER SEGUIN ROAD. Mrs. Marsh moved to approve the first reading of an ordinance providing speed limits on Lower Seguin Road. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #6 SURPLUS PROPERTY: Mr. Sweatt informed Council that two bids were received on the items of surplus property. One of the bids was only for two computers for a total of $100. We have reviewed our needs and feel that this is as good a bid as we could get for these two items. The other bid was for various items from our list but not nearly all of them. The prices bid on the bicycles is not sufficient. We feel that we could realize more by some other type sale. We went throuqh the list of other items that were offered for purchase; and exclusive of the bicycles, we recommend accepting the second bid. Mr. Baldwin moved to approve the City Manager's recommendation on the items bid from our surplus property list. Mrs. Stanhope seconded the motion, which carried with the followinq vote: 289 AYES: Councilmembers Potempa, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None Mayor Sawyer suggested the bicycles Society for sale at their auction. suggestion. go to the Library I Humane Council agreed with this #7 CITY MARAGER'S REPORT: We received a letter from the State Department of Highways and Public Transportation concerning the rerouting of traffic on I35, placed into effect this date. Mr. Sweatt said this rerouting would be placed in local newspapers and posted to keep people up to date on the detours. #8 ITEMS BY COUNCIL: Mrs. Stanhope suggested that perhaps the City could come up with some procedures on what to do if a child gets bitten by an animal. She said one of our citizens had some trouble getting the proper information recently. Mr. Sweatt was to check into this. Mr. Greenwald called attention to an article in our Newsletter about CVADAC, saying they do now have a 24 hour answer line (659- 1369) . This is not a recording but a person that will give referral information to callers. #9 ITEMS BY MAYOR: Mr. Sawyer announced that this date is the "National Night Out" and he wanted to compliment Ms. McGill for the nice block party she invited him to attend on Vicki Lynn in observance of this day. #10 ADJOURNMENT: Mr. Baldwin moved the meeting be adjourned at 7: 31 p. m.
