ccswks 12-28-1988 40 \, SPECIAL SESSION OF THE CITY COUNCIL DECEMBER 28, 1988 The Schertz City Council convened in Special Workshop Session Wednesday, December 28, 1988, at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The followinq members were present: Mayor Earl W. Sawyer, presiding; Earl P. Hartzoq, Hal Baldwin, Ray Stanhope, Adolph Aquilar; and Ken Greenwald. Staff present were City Manager Kerry R. Sweatt and City Secretary June Krause. '1 HEARING OF RESIDENTS: A. Mr. Bill Neller brought the Council up to date on the installation of brackets on poles along Main Street for the installation of flaqs on Special holidays. He advised they have 15 brackets installed and as soon as the others are received, they will also be installed. The American Leqion is accepting donations towards the brackets and flags. B. Mr. Ed Mazian asked who does the maintenance on pol ice vehicles. He had seen our vehicles at various place around the area. Mr. Sweatt said we seek the best prices and take our cars to various private garages for the work. We are in the process of establishing City maintenance for minor work but cannot afford to set up for full maintenance. Generally it is not a question of making a choice but who can qet the work done the fastest. '2 Discussion of BVYA contract renewal. Mr. Greenwald said the BVYA Board did not have any changes to the contract. The preSident of BVYA was present to answer questions or to sign the contract if Council was ready. Mayor Sawyer said he has not seen anythinq wrong with the contract, which we have had for several years. Mr. Hartzog said in Section X it says the "City" agrees to perform all maintenance operations on fencinq, dugouts and score booths; but it does not say "who" in the City. Mr. Hartzoq mentioned that he noticed that ballfield lights are being used for purposes of practice late at nights. He asked if there was someway the City could restrict them from using the liqhts late at night, say put in a 10:30 p.m. limit for use of the lights. He said he had seen them on as late as eleven or twelve at night and that is too late for the children to be up on school nights. Mr. Little used that definitely there late said that sometimes durinq tournaments the lights are late but not at other times. He said he would look into this though as there should not be anyone except for tournaments. ( ~1i ~-:'T J1 Mr. Greenwald said the organization is also aware that if they use over the amount of kilowatts in the contract, they have to pay the difference. Mr. Sweatt said he had discussed with BVYA the shifting and turning of the fields but the timing is such that it could not be done this year. Mr. Aguilar pointed out that Section I designates who the "City" is. '3 Discussion of final reading of an ordinance establishing speed limits on F.M. 482. Mr. Hartzog reminded Councilmembers that the speed limit is recommended by the State. Mayor Sawyer asked that this be put on the next agenda for vote. #4 Discussion of 1st reading of an ordinance amending the Code, Section 18-32 providing for stop intersections in Silvertree. Mr. Sweatt advised this ordinance will designate specific locations to control traffic. We have had some requests for yield signs but staff feels the stop signs are better. #5 Discussion of first reading of an ordinance amending the Zoning Ordinance confirming the rezoning of land out of Comal and Guadalupe Counties. Mr. Sweatt advised that as the new zoning map was being prepared a lot of staff time and P&Z time went into this and there was discovered that some of these zonings were not consummated by ordinance, although the public hearings were held and vote taken. These rezonings clear that up. This has been discussed with the attorney. Mr. Sweatt said one of the many values of doing a zoning map is going through all the ordinances and finding some of these that were not finished. Mr. Baldwin said then this is just confirming what Council has already done. Mr. Hartzog pointed out that the zoning map does not show that. the Beck property is designed R-1. Mayor Sawyer requested this item be on the next agenda. #6 Discussion of first reading of an ordinance amending the Mobile Home ordinance regarding the design and location of storage facilities. Mr. Greenwald explained that the Mobile Home ordinance on this subject was amending two months previously but the inspector is \ ,,12 1 still having problems because of the design of lots. give him some latitude. This will Mr. Hartzog asked if this would also would give the latitude of facing the storage facility doors to the front of the lots and Mr. Greenwald said it would. '7 Consider and take action regarding the Revenue Sharing Budqet. Mr. Sweatt said this budget is proposed as an action agenda item. We have published various notices as required by ordinance and law. We are recommending that of the $7638 left in revenue sharing funds, $3200 be allocated to the police department for Capital Outlay - radios $2000 and traininq program - $1200. Of the $2600 designated for Management, $1200 for office equipment and $1400 for a printeri then the balance for a portion of the cost of an auxiliary generator for the Municipal Complex. Mr. Sweatt said that if this budget is adopted, we will bring to Council at next meetinq the amount to budget for the increase in police chief salary. Mr. Agui lar asked if it could not be stated that the balance would be for the auxiliary generator so that when interest is added, there would not have to be another amendment. Mr. Sweatt said it would be and he recommended this budget be adopted. Mr. Greenwald moved to approve the Revenue Sharing budget as presented. Mr. Baldwin seconded the motion, which carried with the followinq vote: AYES: Councilmen Hartzog, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None # 8 Discussion of request from Dannenbaum Engineering to rezone two tracts of land in Scenic Hills, Phase II and set public hearing date. Mayor Sawyer requested the City Secretary set up a public hearing date, as there was no objections from Council. #9 Discussion of a request from Mike Besch for Specific Use Permit to allow a mobile home on Salvage Enterprises property for security and set public hearing date. Mayor Sawyer pOinted out that Council had a favorable recommendation from Planninq & Zoning on this request. Mr. Greenwald said Mr. Besch wants to put a mobile home on his property. At one time there was an old mobile home on the property and there is a septic tank available. Mr. Besch wants someone there to look after the place. ( 43 Mr. Hartzog expressed his op~n~on that it would be unsanitary for a mobile home to be placed among the junked cars. Mr. Simonson said it would be on the other side of the fence from the junked cars. Mr. Hartzog then asked if it would meet all the set back requirements from the road. Mr. Simonson said it would or it could not go in there. Mr. Baldwin asked if this was to be for a specific period of time or will it be permanent. It was agreed that it would be permanent as far as a specific use permit allows. Mayor Sawyer asked the City Secretary to set a public hearing date. # 10 Discussion of a request from Mike Knotts of FM 1518 Auto Parts for a fencing exception to the Junk Yard ordinance. Mayor Sawyer said Council has a memo showing P&Z recommends this for approval by a 4 to 3 vote. Mr. Sweatt said Council has a layout of what Mr. Knotts has and what he is proposing. The ordinance says a junk yard should be completel y enclosed by an opaque fence. Mr. Knotts is saying that the Randolph stable closes off part of this property and he will paint the existing fence fronting on FM 1518 and extend such painted fence to a length on both sides of the property that would prohibita I ine of sight from the yard of the adjoining residence. All of his land is not within the city limits. After Council discussion, Mr. Hartzog asked if the next door resident has agreed to this. Mr. Simonson said he had agreed because he contends that if fully fenced, it would cut off air from his residence. Mr. Hartzog then asked if the City had a letter from the next property owner saying he does not want the fence. Mr. Simonson said he would get one by the next Tuesday meeting. Mr. Aguilar said he would like to insure that if there is a gap between the stables and the road that it would be fenced. Mr. Ty Brisqill of P&Z said he thought the intent was to enclose the view from the road. The back of the stable backs up to this man's property. Mr. Stanhope said Randolph Air Force Base is using shrubbery for this purpose and asked why this man does not want to be a good neighbor and do it the same way. Mr. Greenwald asked how Council could enforce it outside the city limits. i\ 44 ~ Mr. Sweatt said if Mr. Knotts applied for any service, such as water, perhaps we could enforce it. He said we could discuss this with the city attorney to see what our enforcements are. '11 Consider and take action regarding U.S.C. legal services. Mayor Sawyer reminded Council that they have a memo from the City Manager saying this is on the agenda in case something comes in from U.S.C. and Mr. Sweatt said we have received nothing at this time. Mayor Sawyer asked that this be on the next agenda. '12 Review of Comprehensive Planning Study. Mayor Sawyer said at the last meetinq Council discussed this item and he felt it was decided Council would have a group work with P&Z. He then called attention to a revised copy of the survey. Mr. Sweatt advised that a couple of items had been added to the original survey form. Discussed was the survey being used to help set options and goals. This survey is more of an opinion, somethinq to get some feed back and it will help to determine future goals. He said Council had discussed using the newsletter, and after we get the resul ts from this survey, we will use the newsletter for the responses. Mr. Greenwald asked if this was to be mailed back or what. Mr. Sweatt said there are many ways of distributing the surveys and qettinq the responses back j such as using the Home Owners Associations, etc. Mr. Sweatt went on to say that we want to emphasize the role of Planning & Zoning in the plan. Mayor Sawyer then asked if Council was ready to go with the proposed survey and received an affirmative answer. *13 CITY MANAGER'S REPORT: Mr. Sweatt: A. Included in Council packets are various suggestions received for name of our newsletter. Council made several suggestions from the list and Mayor Sawyer suqqested they narrow it down to about four names and have them ready for the next meeting. B. Reminded Council to be thinkinq of names of candidates for the Community Plan Study committee. * 14 ITEMS BY COUNCIL: happy New Year. Mr. Aauilar: wished everyone a ( 45 Mr. Hartzoa: A. Announced a strategic planning meeting at the Library on Economic Development. He said they have invited members of the P&Z/ Industrial Development Committee, and members of Council are also invited. B. Referred to the Heal th Inspection report and asked about Butlers place that was discussed at the previous meeting. Mr. Sweatt said we are working on this and believe we will secure compliance. Mr. Hartzog asked if we could give a citation and if they have a liquor license. Mr. Sweatt said we could give the citation but would have to check on the license. C. Have been getting a lot of complaints about the dust on the streets as a result of seal coating. Mr. Sweatt advised that our sweeper would not pick it up and he did not have a good suggestion other than to hope for rain. Mr. Aguilar said there are also a lot of leaves and Mr. Baldwin said the city does a good job on that. D. Referred to the letter from Debbie Barnes concerning the help needed for the cheerleaders to go to Internationals. Mr. Hartzog said, when he was approached, he told her the City normally does not do this since some girls are from other cities. Mr. Stanhope said there is a Council fund and he did not see why they could not be given some of that. Mayor Sawyer suggested giving them $250 providing we could get some publicity for our schools and city. Mr. Sweatt asked if Council would agree to a letter of agreement and explain that it would be an exchange for them providing services of advertising so that it is not an out and out donation. Mayor Sawyer advised to let Mr. Sweatt work on that. Mr. Baldwin: Wished everyone a happy New Year and said he looked forward to 1989. Mr. Greenwald: A. BVYA people could not stay for the end of the meeting, but they need the use of the gym occasionally for practice. They will want to use it if they cannot get the school gym and our's is not scheduled. They will have to notify us at least a week in advance. Mayor Sawyer said if not scheduled, then fine. Mr. Greenwald said they would like a waiver on the fees if at all possible. Mr. Sweatt said fees have been waived in the past and Mayor Sawyer agreed, saying it would be good public relations. Mr. Stanhope wished everyone a happy New Year, saying it has been a great year. He went on to say we should start pushing the Library/Human Society dance and auction on February 4th. \ 4fi '\ #15 ITEMS BY MAYOR: Wished everyone Happy New Year, addinq that sometime in the future we will publish a letter on the State of the City, which will cover various thinqs that have happened durinq the last fiscal year. Mr. Ty Brisqill of P&Z said that if Council will notice, most of the ordinances that were passed left the enforcement up the inspectors. Since he has been on P&Z, the City has two inspectors who cannot do everything by themselves. There has to be some kind of expenditure as for as enforcement is concerned. Mr. Sweatt said one of the most effective ways is to assign a task force. He said he is considerinq a task force and would talk to Council about this at budget time. Mr. Greenwald reminded everyone that at one time if an employee that was out on the road saw a violation, they would note it and turn it in to the proper department. Mr. Sweatt said that has not entirely gone by the way side. #16 ADJOURNMENT: There being no further business, Mayor Sawyer declared the meeting to be adjourned at 8:05 p.m. ~ ~or, tz, Texas ATTEST:
