ccreg 03-07-1989 ( 101 REGULAR MEETING OF THE CITY COUNCIL MARCH 7, 1989 The Schertz City Council convened in Regular Session, Tuesday, March 7, 1989, at 7:00 p.m. in the Council Chambers of the Municipal Complex, l400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Earl P. Hartzog; Hal Baldwini Barbara Stanhope; Adolph Aguilar and Ken Greenwald. Staff present were City Manager Kerry R. Sweatt and City Secretary June Krause. After welcoming everyone to the meeting, Mayor Sawyer presented a proclamation to Mr. Don Christenson declaring the month of March "Red Cross Month" in the City of Schertz. #1 APPROVAL OF MINUTES: A. Regular Meeting of 2-7-89 B. Special Meeting of 2-15-89 Mr. Baldwin moved to approve the minutes of the Regular Meeting of February 7th and the Special Meeting of February 15, 1989. Mr. Hartzog seconded the motion, which carried as follows: AYES: Councilmembers Hartzog, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None #2 HEARING OF RESIDENTS: None #3 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 89-E-7 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, CALLING AN ELECTION TO BE HELD ON MAY 6, 1989, FOR THE PURPOSE OF ELECTING THREE (3) COUNCILMEMBERS. Mr. Greenwald moved to approve the final reading of an ordinance calling an election for May 6, 1989. Mrs. Stanhope seconded the motion which carried with the following vote: AYES: Councilmembers Hartzog; Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None #4 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 89-S-8 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE SUBDIVISION ORDINANCE, NO. 87-S-11, SECTION 23.2a LOT DIMENSION AND SECTION 30.3 SEPTIC TANK, AND PROVIDING A REPEALING CLAUSE. \ \ 102 . v"" \ Mr. Greenwald moved to approve the final reading of an ordinance amending the subdivision ordinance, Section 23.2a and Section 30.3. Mr. Baldwin seconded the motion, which carried as follows; AYES: Councilmembers Hartzog, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None #5 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING CHAPTER 12 1/2, ATTACHMENT "B", OF SAID CODE, PROVIDING FOR THE USE AND REGULATIONS OF SWIMMING POOL FACILITIES; REPEALING ALL ORDINANCES IN CONFLICT. Mr. Aguilar moved to consider favorably the first reading of an ordinance providing use and regulations for the swimming pool facility. Mrs. Stanhope seconded the motion. Mr. Hartzog said he felt the restriction of a child under 8 years old being accompanied by an adult 18 years old was too restrictive. He felt is should be for some younger age. Mayor Sawyer then called for a vote on the motion, which carried with the following vote: AYES: Councilmembers Baldwin, Stanhope, Aguilar and Greenwald. NAYS: Councilman Hartzog #6 COOPERATIVE AGREEMENT: Consider and take action on a Cooperative Agreement - CDBG Program for Fiscal Years 1989, 1990 and 1991. Mr. Sweatt advised this is a proposed agreement between the City of Schertz and Bexar County for an interlocal agreement for funding years 1989, 1990, and 1991 and will provide that we are parties with Bexar County. Each individual project would be required to be presented by the City. We recommend approval of this agreement. Mr. Hartzog moved to enter into a Cooperative Agreement with Bexar County for CDBG program for Fiscal Years 1989, 1990 and 1991. Mr. Greenwald seconded the motion, which carried with the following vote: AYES: Councilmembers Hartzog, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None Mr. Sweatt said he had talked with Ms. Teran and we can have come out to a workshop; but we do have a longer time this year. We ( 103 have a deadline of December on this. We will have more time to put a package together than in the past. #7 CITY SLOGAN: Consider and take action on adopting "The Friendly City" as the City's official slogan. Mr. Aguilar moved to adopt the slogan of "The Friendly City". Mrs. Stanhope seconded the motion, which carried as follows: AYES: Councilmembers Hartzog, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None #8 WATER WELL DRILLING BIDS: Consider and take action on bids for water well drilling project. Mr. Sweatt said this project was developed in keeping with our plan for a well site in the Edwards Underground Aquifer. As a result of the City of Selma refusal to participate in the agreement, we find it necessary to redesign our water program. The two bids received were both good bids; but in light of the refusal, we recommend rejecting both bids at this time. Mr. Greenwald moved to reject both bids received on the water well drilling based on the City of Selma's refusal to cooperate. Mr. Baldwin seconded the motion, which carried as follows: AYES: Councilmembers Hartzog; Baldwin; Stanhope; Aguilar and Greenwald. NAYS: None #9 CITY MANAGER'S REPORT: A. Have received notice of a TML Region meeting for April 7th at 6:30 p.m. in San Marcos. Let staff know of your intention to attend so we can send in the registrations. B. You may have received a copy of a letter about a planned celebration by the Schertz-Cibolo-Universal City School District. They are having a "Hands Across the District" on March 10th at 3:00 p.m.. This will be a human chain across the whole district. #10 ITEMS BY COUNCIL: Mr. Aguilar: A. The Library Book Sale will be March 31st and April 1 and 2, 1989 at the Community Center. The Library also had a very successful auction and dance. The are now working on finishing the interior of their building. The hope to have some of the councilmembers to help them the weekend after the book sale. B. On the road turning from Schertz Parkway to Live Oak Road where they cut the road for the water line, when people turn the corner, the ruts are getting deep. \ 104 Mr. Greenwald: CVADAC will be having another of their seminars on March 16 from 7 to 8:30 p.m. at the Library. The topic is "Death, Dying and Grief". #11 ITEMS BY MAYOR: A. Since the library is getting ready to finish the inside of their building, what are we going to do with the bicycles, etc. in there. Mr. Sweatt said we will have to store the bicycles elsewhere. We are arranging a place now. B. At the meeting next week we are to discuss the evaluation of the City Manager. Since we have not done this before, we have nothing to go on so have asked Mr. Sweatt to come up with something. We will do the same thing when we evaluate Mrs. Krause. We need something so we can handle it in an orderly manner. #12 ADJOURNMENT: adjourned at 7:21 p.m. carried unanimously.
