ccreg 08-01-1989 242 \ REGULAR MEETING OF THE CITY COUNCIL AUGUST 1, 1989 The Schertz City Council convened in Reqular Meetinq, Tuesday, Auqust 1, 1989, at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The followinq members were present: Mayor Earl W. Sawyer, presidinq; Earl Hartzog; Hal Baldwin; Barbara Stanhope; Mary Marsh and Ken Greenwald. Staff present were City Manaqer Kerry R. Sweatt and City Secretary June G. Krause. Mayor Sawyer read a Proclamation designatinq "Business Appreciation Week" for the week of August 13-19, 1989 and presented the proclamation to Jim Shriver, president of the Schertz Business Club. The proclamation asked that our citizens show their appreciation by visiting their local businesses. Mr. Sweatt asked to make an announcement. He said that it was with a qreat deal of pleasure that he introduced Mary Lou Malone as the new Administrator of Schertz Area Facility for Emergency Service (S.A.F.E.S.). After receivinq conqratulations from the Council, Mrs. Malone said she appreciated the support. #1 APPROVAL OF MINUTES: Reqular Meeting of June 20, 1989 Mrs. Stanhope moved to approve the minutes of the regular meeting of June 20, 1989 as presented. Mr. Hartzoq seconded the motion. Mrs. Marsh requested that the tenth paragraph of item #2 be corrected to read: "Mr. Greenwald said this property has been in the AICUZ ever since it was annexed into the City." Mayor Sawyer then called for a vote on the motion before Council and the motion carried with the following vote: AYES: Councilmembers Hartzoq, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #2 HEARING OF RESIDENTS: There were no citizens wishing to speak. Mayor Sawyer took this opportunity to welcome County Commissioner Brown to our meetinq. #3 ORDIBAIICE: Mayor Sawyer introduced an ordinance and read the caption as follows: ORDINANCE NO. 89-M-19 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES ( 243 BE AMENDED BY REVISING SECTION 2-11 PROVIDING FOR NON LIABILITY IN CLAIMS FOR PROPERTY DAMAGE OR PERSONAL INJURY. Mr. Hartzog moved to approve the final consideration of an ordinance amending the Code, Section 2-11 Non Liability in claims for property damage or personal injury. Mrs. Marsh seconded the motion, which carried with the following vote: AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #4 ORDINANCE: Mayor Sawyer advised that the City manager had asked that this item be tabled at this time in order for him to get back with the Texas Department of Highways and publ ic Transportation on distances. Mrs. Marsh moveg to table consideration of the ordinance revising Section 18-76 of the Code providing for school zone on F.M. 1518. Mrs. Stanhope seconded the motion, which carried as follows: AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #5 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS, BE AMENDED BY REVISING SECTIONS 18-75 AND 18-76 OF SAID CODE; PROVIDING FOR EXTENDED SCHOOL ZONES. Mr. Sweatt pointed out a couple of changes that had been made as a result of the workshop discussions, also a map of the specific recommended zones has been provided. These school zones, especiallY on Schertz Parkway and Elbel road are to emphasize to drivers the proximity of the school. Mr. Sweatt then pointed out the exact locations of the school zones being recommended. Mr. Hartzog moved to approve the first reading of an ordinance providing for extended school zones and asked that this ordinance be brought up again at the next workshop. Mr. Greenwald seconded the motion. Mr. Hartzog said he felt the 20 miles per hour school zones on both Schertz Parkway and Elbel Road are too long and would like to discuss this further at workshop. ~ 244~ ~ Mayor Sawyer then called for a vote on the motion, which carried as follows: AYES: Councilmembers Hartzoq, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #6 ORDIIlAIfCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES BE AMENDED BY REVISING SECTION 18-131 PROVIDING FOR TRAFFIC SAFETY HAZARDS. Mr. Greenwald moved to approve the first reading of an ordinance amendinq the code, Section 18-131 Traffic Safety Hazards. Mrs. Stanhope seconded the motion, which carried with the following vote: AYES: Councilmembers Hartzoq, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #7 ORDIIlAIfCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES, BE AMENDED BY REVISING SECTION 2-8 OF SAID CODE, PROVIDING FOR COMPETITIVE BIDS FOR PURCHASES AND SALES. Mr. Hartzoq moveg to approve the first reading of an ordinance amending the Code, Section 2-8 Competitive Bids for purchases and sales; bidder's security. Mrs. Marsh seconded the motion. Mr. Baldwin said the Leqislature has just chanqed the limit to $10,000, effective September 1st; but he did not know if the Council wanted to consider qoing that hiqh. Mr. Sweatt said this ordinance was prepared before we received word of that and we may want to corne back later and raise the limit to comply with the new lawi but for now, we recommend only raising it to the $5,000 limit. ( 245 Mayor Sawyer then called for a vote on the motion and the motion carried with the following vote: AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #8 RESOLUTION: Mayor Sawyer introduced a resol ution and read the caption as follows: RESOLUTION No. 89-R-6 BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, SUPPORTING A SOLID WASTE DISPOSAL SITE ON SCHAEFER LOOP ROAD. Mrs. Marsh moveg to approve the resolution supporting a solid waste disposal site on Schaefer Loop Road. Mr. Baldwin seconded the motion. Mr. Hartzog said he would like to find out what staff's recommendation is on this proposed resolution. Mr. Sweatt said we certainly find no fault with the resolution. He went on to say that we understand the application has been made to the Texas Department of Health. We believe the Department of Health has the authority to deal effectively with the landfill regulations. We perceive that there is a need in our area for a disposal site. Mayor Sawyer then called for a vote on the motion and the motion carried with the following vote: AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None #9 ORDINANCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS PROVIDING THAT THE CODE OF ORDINANCES, CITY OF SCHERTZ, TEXAS BE AMENDED BY REVISING ARTICLE IV MANDATORY WATER CONSERVATION, SECTION 19-81 Mrs. Stanhope moved to approve the first reading of an ordinance adopting a Water Management Plan. Mr. Baldwin seconded the motion, which carried with the following vote: \ 246 \ 1 AYES: Councilmembers Hartzog, Baldwin, Stanhope, Marsh and Greenwald. NAYS: None # 10 PROPOSAL: Review recommendation of the Planning & Zoninq Commission on the Cosmic Futures, Inc. Subdivision. Mayor Sawyer advised that this subdivision was started several years aqo and not finished. Mrs. Marsh said she would like for Council to go out and look at this subdivision and see just what the gentleman is talking about. She said she fel tit was a good idea; but so many questions have been raised, it might be a good idea to look at the land. After discussion, it was the concurrence of Council to meet at 6:30 before the next workshop and visit this property. #11 CITY MANAGER'S REPORT: A. Mr. Sweatt said that the previous day he had filed a recommended budget with the City Secretary in accordance with the Charter. He said staff has placed in Council hands a summary of the budget and the detailed work sheets will be supplied prior to the first budqet workshop. At the same time we will be prOViding notice of the proposed effective tax rate and notice of the August 16th meeting in which we will be discussinq the tax rate and will vote on the proposed ~ tax rate. Auqust 22nd is the date for the public hearing on the proposed tax rate and budget. Then on September 5 Council will consider a tax rate and the budget. B. We have received notice of the TML Region VII meeting in Castroville for September 8th. The quest speaker will be State Representative Dan Morales followed by an informative legislative update by TML Executive Director, Frank Sturzl. We will be asking for Council's RSVP soon. #12 ITEMS BY COUNCIL: Mr. Hartzoa conqratulated Mary Lou Malone on her appointment as SAFES Administrator. Mrs. Marsh gave an update on the status of sponsorship for the swim team. She expected, by the end of the week, to have received sufficient donations to reach the $1,000 projected. This will take them throuqh this summer and prOVide some money that can be utilized next summer. She assured everyone that the donations will be fully accounted for so the persons who donated will be assured their money was well spent. *13 ITEMS BY MAYOR: Mayor Sawyer thanked staff for cutting the grass under the railroad crossinq. He emphasized that is one of the main entrances to the City and people notice it.
