REGULAR MEETING OF THE CITY COUNCIL
NOVEMBER 1, 1988
The Schertz City Council convened in ReO'ular Session, Tuesday,
November 1, 1988, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
followinO' members were present: Mayor Earl W. Sawyer, presiding;
,Earl P. Hartzog; Hal Baldwin; Ray Stanhope; Adolph Aquilar and
Ken Greenwald. Staff present were City ManaO'er Kerry R. Sweatt,
iCity Attorney Michael L. Spain and City Secretary June Krause.
IMayor Sawyer welcomed everyone to the meetinO' and introduced Mr.
Jim Shriver, President of the Business Club, to present an award.
Mr. Shriver said it was indeed a pleasure to award a plaque
desiO'nating this person as the "Employee of the Quarter" as he
ihad occasion to observe his quality of work over the last several
months and Mr. Steve Simonson was truly deservinO' of the award.
Mayor Sawyer then introduced several quests in the audience - Mr.
Norman Aqee, the new Chief of Police, who comes to us from De
,Soto and has approximately 20 years experience to offer us.

PUBLIC HEARIBG: The Council to receive citizen input on the
proposed annexation of 30.63 acres of land out of Comal and
Guadalupe Counties.
Mr. Sweatt advised that this hearing was published in the October
19th issue of the paper and we have used that as means of
notifyinq people of the hearinq. Staff has developed a service
plan to provide services for the area, which joins the city
limits on 1-35 at FM 1103. The Utility department has reviewed
the area and will be coming to Council with plans. We see no
drain on the budget for services to this area as we already serve
a portion of it. The second public hearinq will be published on
November 12 and the hearinq will be held on November 15th. We
would ask that you consider the first readinO' of the ordinance at
,the workshop of November 30th if you intend to annex. Then the
final consideration could be held on December 6th.
As there were no comments from the public, Mayor Sawyer declared
the public hearinq closed at 7:07 p.m.
#1 HEARING OF RESIDENTS: A. Michelle Tereletsky presented
a letter of commendation for one of our police officers, saying
the writer of the letter was unable to present it herself because

she was out of town. Mr. Sweatt read the letter from Candace M. 0
Purcell commendinq Police Officer Stiles.

Mr. Baldwin requested the first sentence of item "10 B of the
minutes of October 4, 1988 be corrected to read: "Mayor Sawyer
said Council would encouraqe any citizen that would like to talk
with Mr. Sweatt to qive him a call and make an appointment." He
also asked that the 3rd from last sentence of item '2 of the
minutes of October 12th be corrected as follows: "They have
taken many precautions over the last few years to enhance the
safety of the railroad."
Mr. Hartzoq requested the second sentence of the fourth paraqraph
of item 17 of the minutes of October 4th be corrected to read:
"Mayor Sawyer said that he and Mr. Sweatt had attended the last
meetinq of the USC and they discussed quite a few thinqs they
wanted to do." He also requested a chanqe to the tenth
paraqraph of item '11 of the minutes of the meetinq of October
12th as follows: "Mr. Stanhope said he had noticed a qrader on
top of the landfill on FM 3009 and asked Mr. Gutierrez if it was
closed what was qoinq on."
Mr. Baldwin moved the minutes of the Special Meetinq of September 0:
28, the reqular meetinq of October 4 and the Special Meetinq of
October 12, 1988 be approved. Mr. Stanhope seconded the motion,
which carried with the followinq vote:
AYES: Councilmen Hartzoq, Baldwin, Stanhope, Aquilar and
Greenwald.
NAYS: None
'3 BID AKARD: Consider and take action on awardinq bid on
Water Transmission Main Extension.
Mr. Sweatt reminded Council that Mr. Denham of our enqineerinq
firm was present at workshop and they had recommended awardinq
the bid to Waqner a Sons Pavinq Company, Inc., the low bidder,
for the amount of $269,874.28 be accepted.
Mr. Greenwald moved to award the Transmission Main Extension bid
to Waqner a Sons, in the amount of $269,874.28. Mr. Hartzoq
seconded the motion, which carried as follows:
AYES: Councilmen Hartzoq. Baldwin, Stanhope, Aquilar and
Greenwald.

ORDINANCE NO. 88-A-20
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING ORDINANCE NO. 88-A-15,
SECTION I TO CORRECT THE METES AND BOUNDS AND
DECLARING AN EMERGENCY.
Mr. Aquilar moved to approve the ordinance amendinq ordinance No.
.88-A-1S as an emerqency measure. Mr. Stanhope seconded the
imotion, which carried with the followinq vote:
AYES: Councilmen Hartzoq, Baldwin, Stanhope, Aquilar and
Greenwald.
NAYS: None
#5 ORDIRAlICE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING ORDINANCE NO. 8S-H-18,
SCHEDULE "A" GARBAGE COLLECTION FEES AND
PROVIDING FOR A SERVICE FEE INCREASE;
PROVIDING AN EFFECTIVE DATE; AND REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT.
Mr. Greenwald moved to approve the first readinq of an ordinance
amendinq Ordinance No. 85-H-18, Schedule A. Mr. Baldwin seconded
the motion.
.Mr. Sweatt said this item has been discussed previously with
:Waste Manaqement. Information qiven included increased costs of
· transportation and landfill disposal charqes. They have
requested a 6% increase across the board. Staff has reviewed
. this request and these charqes are in line. We recommend you
'pass this ordinance effective November 22, 1988.
Mr. Hartzoq asked if we have any customers that fall into the
Class II and III cateqories. Mr. Gutierrez said he believed
Pecan Grove would be the only one; and this was intended for
those trailers that come and qo on a temporary basis.
'Mayor Sawyer then called for a vote on the motion, which carried
as follows:

ORDINANCE NO. 88-S-19

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS AMENDING THE MOBILE HOME
ORDINANCE NO. 87-g-8, SECTION XI, MOBILE HOME
PARKS, PARAGRAPH B.2.g DESIGN AND LOCATION OF
STORAGE FACILITIES.
Mr. Greenwald moved to approve the final reading of an ordinance
amending Section XI of ordinance 87-S-8. Mr. Hartzog seconded
the motion, which carried as follows:
AYES: Councilmen Hartzog, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
'7 PAY PLAR: Consider and take action to revise pay plan
schedule for Police Chief position.
Mr. Sweatt said that according to a review of the salaries in the
area and TML salary study, we are recommending that Council
approve the police chief salary range from a 19 D+ to 22 D.
Mr. Stanhope moved to approve the revised schedule to be 19 D+
through 22-D. Mr. Baldwin seconded the motion, which carried as
follows:

'8 CITY MABAGER'S REPORT: Work has begun on the new sewer
line and we have found problems. We may find ourselves in the
position of having to do remedial work and may have to close the
street longer than we had planned.
'9 ITEMS BY COURCIL: Mr. Hartzog said he noticed in the
paper that the postal identification has been changed for the
City of Live Oak, even though using a San Antonio zip code. This
shows that they will at least talk about changes now.
Mr. Aguilar: Asked what is the problem with the street. Mr.
Graham said the problem is the sub surface and he is having it
tested now and will know more later. Mr. Sweatt said we may have
to remove soil and replace and compact.
Mr. Greenwald suggested that at the next workshop Council should
discuss the options of publishing our legal notices.
'10 ITEMS BY MAYOR: Mayor Sawyer advised that the first
edition of the newsletter is available and we intend to continue 011
putting this out each month. He said Council would appreciate
any comments.

# 11 ADJOUR1IMElft': Mr. Baldwin moved the meetinq be
adjourned at 7:24 p.m. Mr. Greenwald seconded the motion, which
carried unanimously.
