REGULAR MEETING OF THE CITY COUNCIL
JANUARY 19, 1988
The Schertz City Council convened in Regular Session, Tuesday,
January 19, 1988, at 7: 00 p.m. in the Council Chambers, 1490
Schertz Parkway, Schertz, Texas. The fOllowing members were
present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal
Baldwin, Ray Stanhope; Adolph Aguilar and Ken Greenwald. Staff
present were City Manager Jimmy G. Gilmore and City Secretary
June G. Krause.
#l APPROVAL OF MINUTES: Mr. Baldwin requested the last
paragraph of item #2 of' the minutes of December 30, 1987 be
corrected to read: "Mayor Sawyer thanked Mr. Ling for coming in,
saying he felt there was a need but just did not know where they
could be placed and comply with our sign ordinance." Mr. Baldwin
also asked that the first sentence in paragraph II of the same
minutes be corrected as follows: "Mr. Sharpe said he got some
negative feedback from a citizen when they asked a City employee
about the entrance of Deer Haven and was told that was not the
City's problem but the State's."
Mr. Baldwin moved to approve the minutes of the Special Meeting
of December 3~, 1987 and the minutes of the Regular Session of
January 5, 1988 as corrected. Mr. Stanhope seconded the motion,
which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#2 BEARING OF RESIDENTS: Mr. Hartzog, president of the
Library Advisory-Board, passed on the Board's thanks to the City
staff for their help in putting together the specifications for
the library addition, especially Mrs. Krause for working with the
contractors.
#3 BID AWARD: Mayor Sawyer advised the Council had looked
at the bids and discussed them at workshop meeting.
Mr. Aguilar moved to accept the bid of $25,983 from Kirchner
Construction Co. Inc. of Seguin for the library extension. Mr.
Greenwald seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None

14 APPOINTMENT: Consideration of appointing Marge Smith to
fill a vacancy-on the Library Board.
Mr. Aguilar moved to accept the recommendation of the Library
Board to appoint Marge Smith to the Library Board. Mr. Stanhope
seconded the motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
.5 BVYA COftRAC'l': Consideration of approving renewal
contract with BVYA for 1988.
Mr. Greenwald moved to approve the renewal contract with BVYA for
1988. Mr. Stanhope seconded the motion, which carried as
follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
Mayor Sawyer said that since BVYA was formed, they have done an
exceptional job for the community.
#6 RESOLOTIOR: Mayor Sawyer introduced a resolution and
read the caption as follows:
RESOLUTION NO. 88-R-2
A RESOLUTION BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, APPROVING THE ACQUISITION
OF A CERTAIN TRACT OF REAL PROPERTY BY THE
GUADALUPE COUNTY APPRAISAL DISTRICT.
Mr. Sharpe moved to approve the resolution approving the
acquisition of property by the Guadalupe County Appraisal
District. Mr. Baldwin seconded the motion, which carried with
the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
Mr. Sharpe explained that the State property law changed to allow
Appraisal Districts that have acquired property before January I,
1988 to validate the acquisition and it must be validated by a
majority of the entities in the district.
.7 ORDIRARCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF
ORDINANCES OF ORDINANCES, 'CITY OF SCHERTZ',
TEXAS, BE AMENDED BY . REVISING SECTION 18-32
STOP INTERSECTIONS PROVIDING FOR STOP STREETS
ON SCHERTZ PARKWAY; AND SECTION 18-76 MAXIMUM
LIMITS ON SPECIFIC STREETS OF SAID CODE,
PROVIDING SPEED LIMITS ON SCHERTZ PARKWAY.
Mr. Stanhope moved to approve the ordinance amending the Code by
revising Sections 18-32 and 18-76 speed limits on Schertz
Parkway. Mr. Baldwin seconded the motion, which carried with the
following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#8 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 88-D-3
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF
ORDINANCES, CITY OF SCHERTZ, TEXAS, BE
AMENDED BY REVISING' SECTION 18-76 MAXIMUM
LIMITS ON SPECIFIC STREETS, OF SAID CODE;
PROVIDING SPEED LIMITS ON SOUTH FARM TO
MARKER 1518.
Mr. Greenwald moved to approve the final consideration of an
ordinance amending the Code by revising Section 18-76 Speed
Limits on South FM lS18. Mr. Stanhope seconded the motion, which
carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#8-A AGREEMENT: Consideration of an agreement with Texaco
Pipeline Inc. Work Order 9284 to adjust Austin to San Antonio 6"
pipeline to accommodate the construction of Schertz Parkway.
Mr. Sharpe moved to approve the agreement to Texaco to adjust the
6" pipeline to accommodate the construction of Schertz Parkway at
an estimate cost of $24,391. Mr. Stanhope seconded the motion.

Mr. Stanhope asked if the City had a time limit for this work
be done. Mr. Gilmore said we will go back and asked them to
it right a way. Mr. Gilmore said we plan on telling them that
is needed now but afterall it is their line.

Mr. Aguilar asked what was meant by adjustment to the line.
Gilmore said it has to be lowered.

Mr. Aguilar said he agreed with Mr. Stanhope - we should commit
to a certain time limit. Mr. Gilmore said we are approaching
them and trying every means possible to get them to do it.
Mr. Sharpe said we could tell them that we have a time limit on
our contractors and need their help in meeting the deadline.
Mr. Gilmore said that from what he has been told, this agreement
is cheaper than any other oil company would do it.
Mayor Sawyer then called for a vote on the motion before Council,
and said motion was approved by the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
19 CITY IlARAGER'S REPORT: A. We have a memo from the Fire
Chief requesting assistance. The Firemen and Fire Marshal's
Association ,meet twice a year in different communities. Our
Fire Departmerithas been asked to sponsor such a meeting and have
expressed a willingness to sponsor the October 1988 convention.
If they do they will need the assistance of all City departments
to succeSsfully organize it. They would require about 6 typists
to assist in registration, 2 police officers and a SAFES unit.
After a short discussion, Mayor Sawyer told Mr. Melton he has
Council blessing to sponsor this event.
B. Good Shepherd Church is getting ready for the annual festival
and have asked permission to place banners on the streets as they
have in past years. Council concensus was to allow this.
C. In pursuing water development under our bonds, we have
located what we feel is a very good location for our tank south
of Randolph Air Force Base. It is on high ground and between the
two runways. The land is owned by Mr. Cantu, who is willing to
sell one acre plus easement for $2,999. We will give him hook up
free but not free water. Council concensus was to go ahead with
the transaction.
D. We are getting quite a bit of discussion from developers on
bandit signs. We have picked up quite a number of these signs
this week. The developers have approached Mr. Simonson several
times and are looking for some kind of relief in regard to our

ordinance. They claim they need every kind of advertisement they
can get. We have advised them by phone that they should approach
Planning & Zoning.
Mayor Sawyer said Council could think about granting a variance
for 60 to 90 days but they should go to P&Z first.
Mr. Sharpe said the reason people are not buying is because they
do not have the money - not because the developers don't have up
more signs. The developers cannot seem to comply with the
ordinance now. Mr. Sharpe said he did not see this as a problem
but as an excuse.
Mr. Aguilar said if they had complied in the past, then come in
now and ask, he might consider their request; but they have not
complied before.
E. Have received a letter from the Hearing Examiner on the solid
waste permit application - a copy is in the Council packets.
F. Have received a reply from the Parks and Wildlife Department
on our grant application saying it is scheduled for review by the
Commission at their public hearing on January 21, 1988 at
Department headquarters in Austin. Their staff has recommended
this be included in their next review due to limited funds. We
are contacting them to see is there is any way we can strengthen
out plan.
G. The library had their grant hearing before the Commission
today and will go before the Executive Board at AACOG tomorrow.
H. Have had the proposed City logo in the hall and are looking
for suggestions. Mayor Sawyer said he would like to get a
picture of it in the Herald to get some publicity on this. Mr.
Gilmore said the Recorder has already taken a picture and it will
be in the next paper.
#10 ITEMS BY COUNCIL: Mr. Sharpe asked when the public
hearing on Jack Hays is scheduled. Mr. Gilmore said February 3rd
at 7:~~ p.m. in the Community Center.
Mr. Sharpe said our meeting did get in the Seguin paper stating
what would be under discussion tonight. This is a good plus for
our city.
Mr. Aguilar reminded everyone of the Library's dance and auction
at the Community Center on February 13th from 8 until 1 p.m.
Mr. Greenwald commented that the Street Department is getting the
street lines painted. He actually saw the striper in operation
when he carne home from work.

III ITEMS BY MAYOR: Mayor Sawyer mentioned that there is a
sign down at the intersection of Linda Court and Marilyn Drive.
Mayor Sawyer said he had attended a meeting the previous night
with other Cities that are being served by City Public Service
Board. He would like to'discuss this at the next workshop.
Mr. Sharpe mentioned that the bids carne in pretty good for the
Schertz Parkway. Mr. Gilmore said this would be on the next
workshop. The low bidder very seldom bids on this small a
project.
