SPECIAL MEETING OF THE CITY COUNCIL
MARCH 9,1988
The Schertz City Council convened in Special Workshop Session,
Wednesday, March 9, 1988, at 7:8~ p.m. in the Conference Room of
the Municipal Complex, 1408 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Charles B. Sharpe, Hal Baldwin; Ray Stanhope; Adolph Aguilar and
Ken Greenwald. Staff present were Deputy City Manager/Secretary
June G. Krause and Assistant City Manager Steve Simonson.
Prior to the regular agenda items, Mayor Sawyer read a
proclamation naming the week of March 6 - 12 as "Girl Scout Week"
in Schertz. Several of the scouts gave the Gir I Scout Promise
before receiving the proclamation. One of the leaders explained
they have about 158 girls involved in their organization and this
summer they are planning a day camp in the City park.
#1 BEARING OF RESIDENTS: Mrs. Ruth Tienor announced the
Buffalo Band Boosters will have their First Annual Cow Patty Day
on March 26 and solicited Council support on the ticket sales.
Mayor Sawyer said that he and Mr. Baldwin attended a luncheon
held by the SChertz-Cibolo-Universal School District to thank
the various cities for their outstanding support of the district.
Mr. Harry Richburg, who lives on Fawn Drive, asked Council if
something could be done to get Fawn Drive widened enough for two
cars to pass and maybe some curbing. He emphasized that he did
not want the drive straightened. He had queried several of the
residents on that street and said he had not gotten any negative
responses.
Mayor Sawyer thought this a good idea; but said the City had
tried to do this before under Urban Renewal but the residents in
Deer Haven at that time did not want the City to do anything.
They insisted they wanted it to stay with the rural look.
Mr. Richburg said there are a lot of new people living there now
and they want it changed. Recently there was a bad accident on
Fawn and later another tree was hit.
Mr. Sharpe said he had discussed this with Mr. Simonson and they
are going up there the next day to see what trees could be taken
down without destroying the area but still make it safer.
Although Mr. Richburg said they did not want the street widened
to City specifications, Mayor Sawyer said it seemed to him that
if the City did it, it would have to be to specifications. Mr.
Sawyer continued by saying we could take a look at it and see if
there is something that can be done.
Mr. Baldwin said the right of way varies at different points and
it is hard to determine just where the right of way is.

#2 Discussion of purchase of a small pickup truck for the
Street/Parks Department.
Mr. Steve Simonson said that in addition to the information
previously given Council on the 1975 3/4 ton pickup, he would
like to add that it has over 108,000 miles on it. He said staff
feels that the age makes it beyond spending any further money on
repairs. With the expanded area of the City, we are putting a
lot of miles on the vehicles now.
Mr. Stanhope asked if this vehicle would be used as a trade in or
be auctioned. He then suggested keeping it for strictly a park
vehicle. Mr. Simonson said we would look at what is the best way
to go.
Mr. Aguilar reminded Mr. Stanhope that even for park use, you are
still going to have to consider the maintenance costs.
Mayor Sawyer asked if there was money to purchase a new truck.
Mr. Sharpe reminded Council that Mr. Gilmore had said there was
some left in bond money, as the equipment purchased had corne in
under anticipated costs.
Mayor Sawyer poled Council who agreed to go out for bids using
generic specifications.
#3 Discussion of a resolution to enter into negotiations with
CPS for equitable franchise agreements.
Mayor Sawyer said the committee wanted to see if they could corne
up with some type of agreement to equalize the 2% most cities get
with the 14% San Antonio receives. The representative of CPS
said they will negotiate, they are with Leon Valley right now.
Mayor Sawyer estimated that Schertz only has about 100 customers
on CPS right now.
Mr. Aguilar asked if we want the 14% or do we not want our people
to pay it.
Mayor Sawyer said we want the right to negotiate; that it would
affect Bexar County cities more than it would us.
Mr. Aguilar then asked if San Antonio collects a fee other than
the franchise fee.
Mr. Sharpe said he did not think San Antonio has a franchise fee
because then own CPS. He then asked what are the chances of us
winning this. Mayor Sawyer said the lawyer seems to think we
have a good chance of winning.
Mr. Aguilar said he did not see what the argument was about
because San Antonio owns CPS and why should we get part of the
14%.

Mayor Sawyer answered by saying why should our citizens pay the
14% to support San Antonio.
Mr. Aguilar then asked who sets the franchise limit and Mr.
Sharpe said the State does.
Mayor Sawyer then said this might benefit our tax payers a
little. He then asked if Council agreed to put this resolution
on the next agenda - Council agreed.
#4 DEPUTY CITY MANAGER'S REPORT: A. Mrs. Krause said an
invitation was received - erom CCMA for the Mayor, Council and
staff to tour their treatment plant on Wednesday, March 16th from
3 to 5 p.m.
B. Also a letter from GVEC announcing a meeting at the Schertz
Bank and Trust on Thursday, March 17th, beginning at 9:00 a.m.
The meeting is being held by the Lower Colorado River Authority's
Economic/Industrial Development staff.
C. The Planning & Zoning is recommending setting a public
hearing to reconfirm the zoning for the 85~ acres surrounding
Schertz Parkway. Mr. Simonson explained that when the original
zoning was done, we did not know exactly where the Parkway would
be so there was no acreage given in the zoning. This will
confirm the acreage for the various types of zoning.
Council agreed to set up the public hearing.
D. The P&Z has also recommended approval of the request by the
Knights of Columbus to rezone Lot I as Neighborhood Services and
to rezone an additional 94 feet of Lot 2 as general business _
the front 290 feet is already General Business. They recommend
this be scheduled for a public hearing also.

#5 ITEMS BY COUNCIL: Mr. Aguilar announced that the
Library Book Sale is com-ing up soon. They were asking about
getting a permit if possible for a portable sign. Mr. Simonson
assured him it was authorized.

Mr. Baldwin asked if anyone checked our agreement with the Health
Officer to see if we should be charging for reinspections. Mr.
Gr~enwald said our int~nt was to charge the businesses for any
re1nspections. The ord1nance will have to be checked for this.
Mr. Greenwald said it was brought up at the P&Z meeting about
there being a flashing light for school zone on FM 78 and they
asked why there was not one on FM 3009. Mr. Baldwin said that on

what they call hazardous streets or roads, which include FM 3009,
the School District busses all students.
#6 ITEMS BY MAYOR: Mayor Sawyer advised that he would be
going on vacation Monday and that Mr. Stanhope would be filling
in for him until the end of the month.
Mr. Bob Dietz, a res ident of Deer Haven, spoke concerning the
narrow streets in his subdivision. He had talked with several of
his neighbors and they agree that they want both Fawn Drive and
Antler Drive widened but not straightened. He also brought out
that they feel there are several trees that need to be taken out.
He said one tree is really banged up because it has been hit so
many times already.
Mr. Simonson advised that the City's portion of Schertz Parkway
will be paved within two weeks.
Mr. Sharpe mentioned that the City needs to set up a grand
opening of Schertz Parkway.
#7 ADJOURNMENT: There being no further business, the
meeting was adjourned by Mayor Sawyer at 8:05 p.m.
