REGULAR MEETING OF THE CITY COUNCIL
MAY 3, 1988
The Schertz City Council convened in Regular Session, Tuesday,
May 3, 1988, at 5:3~ p.m. in the Council Chambers, 14~~ Schertz
Parkway, Schertz, Texas. The following members were present:
Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Adolph
Aguilar and Ken Greenwald. Absent: Hal Baldwin. Staff present
were City Manager Jimmy G. Gilmore and City Secretary June G.
Krause.
#1 APPROVAL OF MlROTES: Mr. Stanhope moved to approve the
minutes of the Regular Meeting of April 5, 1988 and the Special
Session of April 13, 1988. Mr. Greenwald seconded the motion,
which carried as follows:
AYES: Councilmen Sharpe, Stanhope, Aguilar and Greenwald
ABSTAINING: Mr. Aguilar on the minutes of the Special
Session of April 13, 1988.
NAYS: None
#2 BEARING OF RESIDENTS: Mrs. Courtney asked if her
petition is submitted on the Ad Hoc Committee, who has access to
it after' being submitted. Mayor Sawyer said it then becomes
public knowledge.
#3 EXECUTIVE SESSION: Mayor Sawyer said Council has
discussed the consideration of an investigation of our police
department based on certain things brought forth by a member of
our community. Now that our attorneys are present, Mayor Sawyer
called for an executive session under Article 6252-17, Section 2
(e) and 2 (g) on possible litigation and department investigation
at 5:35 p.m.
MR. BALDWIN ARRIVED AT 5:4~ P.M.
The Regular Session was reconvened at 7: 4~ p.m. with the Mayor
saying Council had discussed the possibility of investigating the
police department. He said a number of issues were discussed.
Mr. Greenwald moved to get a list from the City Manager, provided
in the same format that he provided, of average turnover rate for
two years, this to be for Council use and accumulated from
various surrounding cities of comparable size. Mr. Stanhope
seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
Mr. Baldwin moved to ask the City Manager to make an inventory of
the property room of the police department and the log to
determine if all property has been properly handled in accordance
with city policy. Mr. Aguilar seconded the motion, which carried
with the following vote:

Mr. Baldwin moved the City Manager give us a list of all warrants
paid to policemen working for the City of Schertz for the past
two years. Mr. Aguilar seconded the motion, which carried as
follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
Mayor Sawyer said that ends the discussion on the executive
session.
#4 CONSIDERATION of instituting investigation of Police
Department. .
Mr. Greenwald moved to table this item until this information is
provided by the City Manager. Mr. Stanhope seconded the motion,
which caLried with the following vote~
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#5 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
ORDINANCE NO. 88-S-9
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, AMENDING THE ZONING
ORDINANCE NO. 87-S-1 BY REZONING 3.017 ACRE
TRACT OF LAND OUT OF GUADALUPE COUNTY FROM R-
2 TO GENERAL BUSINESS (GB) AND NEIGHBORHOOD
SERVICES (NS) AND REFLECTING SUCH CHANGE ON
CERTAIN ZONING MAPS IN ACCORDANCE WITH THE
SCHERTZ ZONING ORDINANCE.
Mr. Greenwald moved to approve the final reading of an ordinance
amending the zoning ordinance by rezoning 3.017 acre tract. Mr.
Stanhope seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.

#6 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:

ORDINANCE NO. 87-S"""1 BY REZONING AN AREA OF

Mr. Stanhope moved to approve the final consideration of an
ordinance amending the zoning ordinance by rezoning 8~~+ acres
surrounding Schertz Parkway. Mr. Aguilar seconded the motion,
which carried with the following vote:

Greenwald.

#7 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY
OF SCHERTZ, TEXAS, PROVIDING THAT THE CODE OF
ORDINANCES, CITY OF SCHERTZ, TEXAS, BE
AMENDED BY REVISING SECTION 18-76 MAXIMUM
LIMITS ON SPECIFIC STREETS, OF SAID CODE;
PROVIDING SPEED LIMITS ON FARM TO MARKET 78;
AND REPEALING ALL ORDINANCES IN CONFLICT.
Mr. Aguilar moved to approve the final consideration of an
ordinance regulating speed on F.M. 78. Mr. Baldwin seconded the
motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
# 8 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, PROVIDING THAT THE CODE OF ORDINANCES,
CITY OF SCHERTZ, TEXAS, BE AMENDED BY
REVISING SECTION 18-45 VEHICULAR WEIGHT LIMIT
ON PORTION OF SCHERTZ PARKWAY AND EAST LIVE
OAK ROAD; AND REPEALING ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT WITH THIS

Mr. Aguilar moved to approve the first reading of an ordinance
regulating weight limits on Schertz Parkway and East Live Oak
Road. Mr. Greenwald seconded the motion.
Mr. Greenwald asked that the first paragraph to changed to show
that this is for through traffic.
Mayor Sawyer called for a vote on the motion, which carried as
follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#9 ORDINANCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, PROVIDING THAT THE CODE OF ORDINANCES
BE AMENDED BY REVISING CHAPTER 12 1/2 PARKS
AND RECREATION, AND REPEALING ALL ORDINANCES
OR PARTS OR ORDINANCES IN CONFLICT WITH THIS
ORDINANCE.
Mr. Sharpe moved to approve the first reading of an ordinance
amending Chapter 12 1/2 of the Code on Parks and Recreation. Mr.
Greenwald seconded the motion, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#10 CITY MANAGER;S REPORT: A. SAFES organization was
selected as the Basic Life Support System of the Year. They are
the only one in the State that was so awarded. This information
has been passed out to the various media.
B. There will be a grand opening of Cardinal Pets and Saddles at
11:3~ Friday, May 6th at the Lone Oak Mall, that is Dr.
Harborth's mall.
#11 ITEMS BY COUNCIL:
Mr. Aguilar: The Library Board had a very good Book Sale and
people are really using the library and they are considering
being open more hours.
Mr. Greenwald:

#13 ADJOURNMENT: Mr. Aguilar moved the meeting be
adjourned at 7:59 p.m., -motion was duly seconded and unanimously
carried.
