ccswks 05-11-1988 // 123 SPECIAL MEETING OF THE CITY COUNCIL MAY 11, 1988 The Schertz City Council convened in Special Workshop Session, Wednesday, May 11, 1988, at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore and Deputy City Secretary Alice Austin. Also present were Mr. Earl Hartzog, newly elected Councilman for Place 1 and approximately 25 to 30 citizens. #1 BEARING OF RESIDENTS: Mr. Ron Neely of the First Baptist church advised that they- would like to put on a Run and Fun Day in Schertz. He advised that it would include a 5 mile run, a three mile wheelchair race and a one mile walk. Mr. Neely advised that they would like to have the event hosted by the First Baptist Church and the City of Schertz. He also advised that he had brought one of the head runners for the San Antonio Running Club out and that they were very impressed with the streets in the city. Mr. Neely said they had been guaranteed 2~~ runners from the San Antonio Running Club and 10~ runners from Randolph and that as yet they had not contacted any other organizations. Mr. Neely advised that with our streets we could probably look forward to more runs in the future which would bring very good publicity to the city. Mr. Neely advised that any proceeds would be donated to RACAP. Entry fee would be $8.013 per person which would cover t shirts and insurance. He also advised that they would provide the manpower to clean the area after the conclusion of the race. Council consensus was for Mr. Neely to proceed with setting up the races. Mr. Jack Stomackin advised that he was appearing in behalf of the Literacy Council and that he was here to ask for $5130.~0 from the City of Schertz. Mr. Stomackin advised that the Literacy Councils were uniting to help save money but that they had lost some of their funding. He explained that they take everybody who does not speak english or has not graduated (from 2nd grade to high school) Consensus of Council was that they would like to discuss this further during their budgeting period. Mayor Sawyer invited Mr. Stomackin to return during that period. Mr. Sharpe advised that the council would benefit by knowing where other donations were coming from. Br ian Doerk advised that he had copies to pass out of letters from 5 ex employees making known their views and hopefully being able to pass on to the council some of the reasons that they have in fact left the Schertz Police Department. ~ 124 \ After passing out the copies Mr. Doerk spoke to council as follows: " The only thing I would ask is after you read all of these letters and hopefully will give you a little insite about some of the things that really does happen over at the police department. I don't know if you plan on voting whether to investigate or whatever you can do tonight or if your going to table it to the next council meeting or whatever. The only thing I would ask is that after seeing some of these statements and also some of the things that I have found out personally. I would hope that either we could appoint some type of investigative person an outside person as the City of Live Oak does, or maybe a committee be formed of councilmen themselves. Its my opinion after reading and hearing from some of these people, I don't believe the City Manager can do a biased investigation of the police department. I just hope that you'll will think about that when it comes around time to decide what you'll are going to do." Michelle Tereletsky of the Humane Society asked to address the Council in regards to the lack of publicity that Schertz seems to get for the good things that they do. And she requested that the Council try to request the Herald give more publicity as far as volunteers are concerned and give us a little insight into the good that we do versus the bad. She also requested that the Schertz Humane Society be put on the next Council agenda to present a check for $355.57 which is the final installment on over $2,~~~ in cat cages which the Humane Society had donated to the Schertz Animal Shelter. She explained that although they had already officially given the check to the city, they felt it was important for the individuals who volunteered their time and effort to know that they are helping the shelter. She advised that in addition to the picture that had not appeared in the Herald, their add had not been run for two weeks in a row. She advised that she had contacted the Recorder Times and they are more than happy and more than willing to run an add for the Humane Society and she requested the City place an add with them for their adoptions. She advised that the key to helping was education in spaying and docking and that is what the Society is here for. Doris Courtney advised that she supported Brian Doerk wholeheartedly and that he had gotten involved because of infamous letters. She said that she had approached council twice and had tried to abide by the rules to get them to listen to her. She said that she was not here to fight with council but only to help. She said that it seemed like they were trying to sweep it under the rug. She requested that Council reconsider an ad hoc committee and that she agreed with Mr. Doerk that it should be an outside committee. Mrs. Courtney also advised that see was still doing her petition and had 155 signatures. She said that she had been planning to present :t at this meeting but would wait until the Meeting on Tuesday. /< 125 John Yeater addressed the Council as follows; "My name is John Yeater. I am a former police officer for the City of Scheitz as of FebLuary 29, I have been setting kind of patiently watching thisf what I'm kind of looking at as a charade in a sense, and trying to decide whether or not I should approach the council on an inhouse terms w~th some problems that I believe to need to be addressed or whether or not to bring suit against the City and certain officials that represent the city. Basically I m not that familiar with the procedu~es of the council since of course police officers were always shunned from getting ~nvolved ~n city government. I would like to talk with some of you'll a ~_ttle b~t more on maybe how we can address some of these problems. As of today, like I sa~di I ve waited kind of patiently. I see that nothing has really been done as far as any investigations in the police department. It should be more than obvious that there is trouble over there. That should be obvious to eve~ybody. However, if any of you 11 have any suggestions on how you 11 would like to work it out w_th me then I 11 be mOLe than happy to work with you 11. I d rather do it like I said in an inhouse way because I m not here to smear any person or the CLty of Sche~tz. That s one of the fULthest things that we want to do right now. I will say that the FBI, Texas RangeLs and some otheL people from the Distr~ct Attorneys office ~s involved on a standby type thing now and thei r waiting on some documents and some i.nfo~mation that I have that I m holding. I don t want, like I said I don t want to go that route unless its abso~utely necessa.y and 1..f we have to go that route with getting those other agencies involved then there also will be a civil ~awsuit and I m trYLng to stay away fLom that a..i..So. So _n other wo....ds I m try~ng to work directly w~th council in an in house thing. I do not want to get out in the news and smear anybody l.n the pape:cs or with the mediao I just want to talk wi,th you .L.L dil.ect..LY so maybe we can come up w.:.th something a way to do this." #2 REGULAR AGENDA ITEMS: A. Discussion of ordinance revising Section 18-45 of the Code on Weight limit on Schertz Parkway and East Live Oak Road. Mr. Agu_lar ask if the terminology of 15,000 pounds to through traff~c would allow others to have a h~gher we~ght. Mr. Gilmore explained that this was true for persons who had business in the a.ea. Mr. Baldwin asked what would be done about persons taking their 18 wheelers home and parking them on the street. Mr. G~.:"'more adv~sed that the city had other ordinances that prohib~t thiS. Consensus of Council was to place this ~tem on the May 17 agenda. B. Discussion of an ordinance revising Code Section 12-1/2 Parks and Recreation. ~ 126 \ There was no discussion. May 17 agenda. 13. Discussion of bids on Seal Coating Streets. Consensus was to place this ~tem on the Mr. Gllmore advised that the two ~ow bidders had bid exactly the same for thi.s job He also advised that Ford Eng lneer ing had investigated and both companies were equally qualified and re.:..iable. Consensus of Council was to draw from these two bidders at the meeting on May 17 and award to the winner_ 14. Discussion of Board of Adjustment request by Tom Wright for a home occupation permit. Mr. Agu~:i.a:_ sa.Ld that this should not be transferable. Mr. Stanhope advised that this man s backyard currently looked like a junk yard and requested that a limit be placed on the number of mowers he could have in his yard. Consensus of Council was to place item on May 17 agenda and Mr. Gilmore to ...eword with J.lm:... tat ions. 15. ELECTION CANVASS~ Mayor Sawyer and councll checked the ta.1ly sheets fro'm the Election held on May 7. 1988 and dete~m.ned the resuits to be as follows: Earl W. Sawyer for Mayor Cha_les B. Sharpe for Place 1 Ear~ P. Hartzog for Place 1 Ha_old D Baldwin for Place 2 55~ 327 339 555 Mr. Baldwin made the motion to accept results of canvass of May II, 1988, Mr. Aguilar seconded the motion which cauled with the following vote: AYES: Counc~lmembeL Sharpe, Baldwin; Greenwald NAYS: None Stanhope,Aguilal and 16 Discussion of Mayor Pro Tem to be voted on at the 5., 17--88 meeting. Consensus of council was to appoint Mr. Aguilar as Mayor Pro Tern. 17. CITY MANAGER'S REPORT: Mr. G.Llmo.e advised that Mayor, Councilor members of staff were invlted to the Steering Committee meeting to be held on May 12 at Converse City Hall. Mr. GllmoLe advised that council had received a _isting of the various liaison areas that Mr. Sharpe had been participating in and that council needs to ~ook at replacements In these a~eas. / // ! 127 He advised that Nanette walkingstick had received a scholarship from the u.s. Humane Society to attend school in Washington DC. The scholarship covers the tuition. The city would have to pay for plane fare and lodging which would be approximately $700. Consensus was to expend the money but additional information would be needed on exact expenditures. Mr. GL_mol.e advised that counCll had .i.eceived Infoi:mation on enlarging the dispatch office to accommodate 911 equipment whIch they will be instaLling in the next 2 or 3 weeks. He advised that they would lose much of what was currently reception area. Mayor Sawyer as for consensus of council on expending monies for enlarging dispatch offIce. Consensus was yes. Mr. GL,more advised that there was a ;etter from County Judge Sagebiel congratulating Safes. Mayor SawyeL advised that several citizens from Northc~iffe were in attendance to discuss deannexation of their al.ea. Consensus of councl,l was to proceed with deannexation pLoceedings. 18. ITEMS BY COUNCIL. Mr. Aguilar said that we had had the gl.and opening for the new Load but there weLe no indlcations that there was a new road. Mr. Gilmore adVIsed the we a e in the process of getting s_gns and lighting. ML. AguilaL asked if the information on the retention of Police department pe~sonne~ requested was available. Mr. Gilmore advised that hiS report was not complete but he would have it on Tuesday. Mr. Sha.pe said that we had a good turnout for the Schertz Parkway opening and that all of the staff involved in helping dId an outstand~ng job ML. GL"eenwald advised that there was a p~oblem with bus~nesses opening and ali.eady in building before we know about it. He advised that P&Z was conceLned with someone opening a busness WhiCh hand~ed haza~dous chem~ca~s. Mr. G~lmore was asked to look into the problem. Mr. Greenwald advised that just past Maske Road on ScheLtz Parkway there was an old barn and brush whjch ~ooked very hazal.dous. He also stated that a s~gn was needed to des~gnate the n_ght deposit box. 19. ITEMS BY MAYOR~ Mayor advised that two area boys Mike Black of Cibo~o and Billy Cress, Jr. of Schertz had went to Boys State UniveLslty of Texas, He a~so advised that he had been contacted by several senior citizens who expressed a wish to have a bench :.nstal.Led between Wuest and the Senior Complex. Mayor said he had ridden WJ_ th Off .J..cer GaL land of the Po:u..ce depa tment and had had a very uneventful night.
