ccswks 08-31-1988 238 SPECIAL MEETING OF THE CITY COUNCIL AUGUST 31, 1988 The Schertz City Council convened in Special Workshop Session, Wednesday, August 31, 1988, at 7:00 p.m. in the Conference Room of the Municipal Complex; 1490 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Earl Hartzog; Hal Baldwin; Adolph Aguilar and Ken Greenwald. Absent: Ray Stanhope. Staff present were Interim City Manager Steve Simonson and City secretary June Krause. II IlBARING OF RESmER!'S: S~nday afternoon he was looking patrol car on the other side of in that area and he did not feel A. Mr. Ed Mazian related that over his back yard and notice a the fence. There are no houses the car should have been there. Mayor Sawyer said the City has a lot of areas where there are no house but small roads and we do patrol in there at times; but he would have the City Manager look into that. B. Mr. Joe Potempa advised that several people have noticing trains coming through our city. at excessive speeds. arms go down on the crossing fast and he felt someone would an accident. been The have Mayor Sawyer suggested asking the railroad representatives to come to one of the meetings and explain about their speeds to Council again. C. Mark Vaughan of Vaughan Homes said he had talked Planning and Zoning about a request to an exception to the zoning ordinance concerning a lot in Greenshire Oaks Subdivision. He said they are asking for a 19 foot set back rather than the 20 foot setback called for in the ordinance. He said they at first did not feel the 28 foot setback applied to them as they had developed under a POD. He said P&Z had recommended approval and he thought he would get that approval from Council at this meeting. Mr. Hartzog asked if this request had to go before the Board of Adjustment. Mr. Simonson said no, just P&Z who made a recommendation to Council. ' l o D Mr. Vaughan said he would like to propose Council give him some indication of their views so that he could go ahead and start construction since the owner is pushing him. Mayor Sawyer asked for a concensus of Councilmembers, who all agreed they would have no problem approving the recommendation. 12 Discussion of Fawn Drive residents petition concerning tbeir street. D1 Mayor Sawyer referred to the petition submitted by residents of I Fawn Drive in Deer Haven, in which they request the City put in a ,! . " ,.:,,,..:,'i;~"i;; (- 239 r- new street with no assessment to residents. He then asked Mr. Baldwin about the meeting he had with those residents of Deer Haven. Mr. Baldwin said a lot of people turned out for his meeting and some thought the residents of Antler spoke out more than Fawn residents. Mr. Baldwin said he personally thinks the City should do some type of study and get back with those people. The City should see what the engineer says about adding two feet onto the road. Mr. J.D. Jones, who is in the street construction business, says it would not be feasible; but we should have the I engineer look at it and give his recommendation as to safety, etc. Mr. Hartzog said Council needs to decide and then tell the engineer what to go with. He felt the Council should not put in less that a standard city street according to ordinance. He said that ten years ago we had the mone"y and the residents did not want it and today we have some or the same people signing a petition. He said he felt if the City is going to put in curb and gutters then they should assess the people. If Council elects to widen the street, maybe the street Department personnel can do it in house. r- Mr. Baldwin stated that anything the City would do with the street would make it easier to speed. Mr. Simonson said one of the things Council needs to address is if the road is changed very much, it will change the drainage and that could become another problem. The flat curbs requested are not going to work, it would just allow the water to drain on someone's property where it had not been before. Mr. Aguilar reminded Council that the people do not want a standard city street so why waste all the time and money on the study if they do not want it to city standards. i Mr. Hartzog asked who is going to pay for all this. He said we still have some bond money to pay for some of it. Mayor Sawyer said he did not recall it being in the bond issue to , do subdivision streets. Mr. Baldwin said Council could still have the engineer look at the trees. Mr. Duffield said one tree in particular had been hit at least four or five times. Mr. Baldwin also suggested having the engineer determine the right of way for this street. Mr. Hartzog agreed, saying it is something that has to be done. r- Mayor Sawyer said the City should find out where the right of way is and get a rough estimate of the cost to do a good street in there. 240 Mr. Baldwin said if Council is looking at a major project in Deer Haven, then he felt drainage needs to be done first. Mayor Sawyer asked Mr. Simonson to see if he could have the engineer's findings within four weeks at that workshop. 13 Discussion of request by Mr. Ratc~ concerning reco-.endations for a lot nezt to bi. on Kline Circle. Mayor Sawyer referred to Mr. Ratchman' s written request, which included the City putting up two fences across the lot next to 2620 Kl ine Circle, which would be about 43 feet long. Mr. Ratchman then would seed and maintain the lot at his expense. He said this lot is really an eye sore. Mr. Simonson said this is a drainage right of way. Mr. Ratchman said he had lived at 2620 Kline Circle for three years. At first this was a ditch and he was led to believe that the City and/or Gemcraft would fill it in and he was told that the City would clean it. He said he had been cleaning it for about 1-1/2 years. He said last Sunday a small kid on a small bike hit a rock in that lot and was hurt. \ o Mr. Simonson said a lot of things done in Woodland Oaks, we had to redo or make them redo. Mr. Ty Brisgill said you could not put a fence at the end of 01 Hidden Grove because of the pipe in there. Mayor Sawyer suggested sending this to Planning & Zoning and have them study it and come back to Council with a recommendation. Mr. Ratchman asked about him going to Gemcraft for help and was told it couldn't hurt. 14 CIft IlARAGER'S REPOft: A. Mr. Simonson reported that everyone in the City had been given a raise in salary except the City Secretary. Mayor Sawyer said he thought Council had discussed in the past about putting the City Secretary in the grade structure so they would not overlook her pay. It was decided that this item should be on the next workshop. B. Bob Sohn of New Braunfels utilities will be at the workshop of September 28th to discuss proposal of bringing sewer to 1-35 area. Paul Brown will also be in attendance. C. The Water Department personnel have laid the pipe on Ware- Seguin to within about 200 feet of the tank and will put that in D as soon as finish painting it. , .,::,it~~: j~_r:r. ., _"" ~ ..: ~~ t It"' !~~..~,.~!.. Mr. Baldwin said we are talking about a lot of money and we need something more from him than interest. Mr. Hartzog asked if we could get a price from the San Antonio River Authority on a small package plant. D. We have received a lot of complaints about the south bound exit on 1-35 to FM 3089. People take this exit and then turn completely around and go back to Garden Ridge Pottery. Mr. Simonson said he had talked with the Highway Department and they wanted to know if we wanted to move the ramp or put in an additional ramp. Have written them a letter on this. Mr. Baldwin said they will probably wait and do that when they are doing I-3S north. To help now, it seems it would be simple to put a "No u-turn" sign at that point. We could also suggest to Eric White that he should put up a sing further up at the next exit saying "last chance to Garden Ridge Pottery". Mr. Brisgill suggested something should also be done at the Flea Market place. #5 ITEIIS BY COURCIL: Mr. Aquilar: Several weeks ago people came from Aero and wanted help. He asked Mr. Simonson if he had had any luck helping them. I Mr.. Simonson said the one house they complained about has been cleaned up. On the other one, we had to go in and clean up and the VA will refund the money to us. They don't know where the i people got the idea of a half-way house because it is not now nor was ever considered for one. i B. he said he knew that the Streets/Parks people keep our lawns, etc. and they are real busy; but who takes care of the area just past Stop & Go. It is an eyesore. Mr. Simonson was to contact the Highway Department about this. . Mr. Hartzog: A. The striping is complete and he felt our people did an excellent job getting it done before school starts. B. They are also doing a good job on the Cibolo Creek clean up. , Cibolo Creek needs to be put on a fact list and checked more often. C. Water pressure is low in our area, what is the status of the 16 inch line. f""- Mr. Simonson said Council should have the status report at the , next workshop. l 242 D. Lone Oak Park - the citizens of that area are watering that park. The last time the city mowed, they took the sprinkler fiead. Is it possible, since we are no longer using wafer hose out front, to give them one of our hoses and the sprinkler head. E. Got a call about 509 Mitchell, there is a bunch of trash in the carport and they are working on a vehicle there. F. Last Monday he got a call from someone that was upset about animals getting in trash. Could we have the Animal control people put on split shift to help cut down on overturned cans. They seem to have a lot of overtime hours and this might help there too. Mr. Simonson said they get a lot of calls after hours on animals running at large, hurt animals etc. G. Also had complaint about police patrolling on 1-35 from 2 to 6 am. It seems two officers were leaning heavy on 1-35. It came over the scanner about a light out on FM 78 and they could not respond because they were too busy on 1-35. Mr. Simonson said he would check that out. Mr. Baldwin: A. Have they started construction on the 1-1/2 mill ion gallon tank. Mr. Simonson said they are on the second ring now and should take another five weeks. B. Mr. Baldwin announced that school would start the following day. Mr. Greenwald: At the Home Owners of Oak Forest meeting, we were asked to check at San Marcos to see if an'architect could design a plan to dress up FM 78. Mayor Sawyer said he understood they did that for some other cities and maybe we could get in touch with them to come down here. B. Has there been any headway done on the City brochure. Mr. Sharpe said he had not done anything since that was given to someone else to do. 16 I~ BY MAYOR: A. Received a letter from the Highway Department 'and they will not put a light at River Road and FM 78. B. Cibolo sent a nice letter complimenting our staff. C. Our application for a park grant was turned down so we are going to s~art spending ouroond money on the park. D. The Department of Health has postponed the landfield hearing until December 5th. ~ :;11 't; '" \ ! n D o ,~, ( r i I I r- 243 E. The Guadalupe County Appraisal District will have their budget hearing on September 12th at 7:88 p.m.. Mr. Sharpe and his board have come up with an acceptable budget. F. Attended a party honoring Mr. Funk on Monday night. Mayor Sawyer said he read a proclamation making the 30th "Tom Funk Day" and added that Tom has done a remarkable job for the city. i Mr. Aguilar asked what was being done about advertising for a Police Chief. Mr. Simonson said it will be in this weeks paper and we have been receiving applications from allover. Mr. Hartzog gave a report on the August 19th meeting of the Greater Austin/San Antonio Corridor Council. There was a writeup about it in the paper that was fairly factual. One of the things brought out was that the Council is pulling back a little on what they are doing. They are mainly concerned with Economic Development. 17 ADJOORRKE~: Mayor Sawyer declared the meeting to be adjourned at'8:94' p.m. ATTEST: City
