ccreg 09-06-1988 244 REGULAR MEETING OF THE CITY COUNCIL SEPTEMBER 6, 1988 The Schertz City Council convened in Regular Session, Tuesday, September 6, 1988, at 7:08 p.m. in the Council Chambers of the Municipal Complex, 1488 Schertz Parkway; Schertz, Texas. The following members were present: Mayor EarlW. Sawyer, presiding; Earl Hartzog; Hal Balawin; Adolpli Aguilar and "'Ken Greenwala. Absent: Ray Stanhope. Staff present were City Manager Kerry R. Sweatt and City Secretary June G. Krause. Mayor Sawyer introduced new City Manager Kerry R. Sweatt, welcoming him to the community. Mr. Sweatt said he had been made to feel welcome by staff and the community and that he was very happy to be here. He said his philosophy seems to be that of the community. The volunteer ism that is so evident is so appreciated. Mr. Sweatt advised that he has an open door policy and he is here to serve the community. ~ I D Mayor Sawyer announced that Mr. Stanhope was in the hospital and unable to attend this meeting. PUBLIC BEARIRG: The City Council to receive comments on the proposal to increase total tax revenues from properties on the tax roll in 1987 by 4.33 percent. Mr. Chuck Sharpe of Fawn Drive welcomed Mr. Sweat and said he 0 looked forward to working with him. Mr. Sharpe then had three items of concern he had on the budget - one being the dramatic increase in Municipal Court fines. Mr. Simonson advised that both the fines and warrants will be comin~ in and they have already increased because of the addit10nal officers and attitude of the department. Warrants are open to all officers. The second item Mr. Sharpe questioned was the item of $5,888 in revenues for police equipment. Mr. Simonson explained that was part of the new warrant serving policy. The third item Mr. Sharpe questioned was the lease payment from Cibolo Creek Municipal Author i ty. He recalled that the City agreed to purchase the property from CCMA and if so, there would be no income from this. Mr. Simonson advised the City did not go through with the purchase and it still belongs to CCMA. Mayor Sawyer said the Council did agree to purchase the land but it has not been discussed recently. Special Meeting of August 4th; B. Special Meeting' of AUgust 6th; C. Special Meeting of August 13th; D. Regular Meeting of August 16th and E. Special Meeting of August 31, 1988. Mr. Aguilar moved to approve these five sets of minutes as corrected. Mr. Hartzog seconded the motion. Mr. Aguilar asked that the Special Meeting of August 6, 1988 be corrected to show that the executive session reconvened at 11:29 a.m. and the meeting was adjourned at 11:22 p.m. Mr. Aguilar also requested the next to last paragraph of item 18 of the minutes of August 18th be corrected to read: oMr. Aguilar said the Police Department should consider looking into getting a warrant officer.o Mr. Aguilar asked that the minutes of the Special Session of August 13th reflect that Mary Marsh and Dr. Richard were also in attendance. He also asked that these minutes reflect that the special session was reconvened at 1:45 p.m. and the meeting was adjourned at 1:47 p.m. r- Mr. Hartzog asked that the 49th paragraph of item 18 of the minutes of the Special Meeting of August 18th be corrected to read as follows: OMayor Sawyer agreed and said he was letting Mr. Hartzog work on this.o Mayor Sawyer then called for a vote on the motion before Council and the motion carried as follows: and AYES: Councilmen Hartzog, Baldwin, Aguilar and Greenwald. NAYS: ,None - , 12 BEARING OF RESIDEBrS: Michelle Terletsky of the Humane Society announced they woUld be having a Country Music Hoedown on September 25th from 3 to 7:00 p.m. at the V.F.W. and that they would be going throughout the City selling tickets. 13 ZONING EXCEPrION: Consider and take action on a request by Vaugham Homes for an exception to the Zoning Ordinance, specifically a rear yard setback from 28 to 10 feet. Mr. Greenwald moved to approve P&Z recommendation of approval of the request by Vaugham Homes. Mr. Hartzog seconded the motion, which carried with the following vote: AYES: Councilmen Hartzog, Baldwin, Aguilar and Greenwald. NAYS: None 246 ~ I .4 EXECtPrIVE SESSIOR: Mayor Sawyer called an executive session at 7: 16' p.m.. under Article 6252-17 Section 2 <g) of Vernon's Texas Civil Statutes to discuss personnel matters relating to the police department. Mayor Sawyer added that this might take a little longer because our attorney needed to brief Mr. Sweatt. o The Regular Session was reconvened by Mayor Sawyer at 8:12 p.m. #5 Consider and take action on _tters discussed in preceding ezecutive session, itea 14. Mayor Sawyer announced there was no action to be taken, the Council and City Manager were briefed by the attorney on police matters. .6 CITY MARAGBR'S REPO~: Mr. Sweatt had no report. 17 I~ BY COURCIL: Mr. Hartzoq: reminded Council of the Schertz Business Club invitation to a picnic at Dr. Richard's on the lake Saturday the September 10th. Mr. Aquilar: welcomed Mr. Sweatt to the City. Mr. Greenwald: asked that the Waste Management contract be on D the next workshop agenda. 18 I'lBMS BY IlAYOR: Mayor Sawyer announced we have had another good.r~po~t on our Animal Control personnel. Mr. Sawyer read a letter he was sending to the Southern Pacific Railroad concerning complaints we have received about speeding trains and asking a representative to attend a workshop to discuss this subject. Mr. Sawyer announced the next VFW Saturday breakfast was on the 10th of September with everyone invited. ( 247 I i ~ SPECIAL MEETING OF THE CITY COUNCIL SEPTEMBER 14, 1988 The Schertz Ci ty Counci I convened in Special Workshop Session, Wednesday, September 14, 1988, at 7:00 p.m. in the Conference Room of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding; Earl P. Hartzog; Hal Baldwin; Ray Stanhope; and Ken Greenwald. Absent: Adolph Aguilar. Staff present were City Manager Kerry R. Sweatt and City Secretary June G. Krause. #1 BEARIRa OF RESIDERTS: Mr. Willman asked about the caution light in front of the fire station. He was advised that there is a problem under the street causing the blinking caution lights not to work; however the red stop light do work when needed. #2 Chair.aa of the Charter Review Co..ittee to preseat the Co..ittee's reco.aeadatioas to City Couacil. r ! Mayor Sawyer asked to pass on this item as Chairman Richards was not present nor was Councilman Aguilar, who was a member of the Committee. Mayor Sawye r asked to go to item No. 4 as the eng i neers were present to discuss this. #4 Discussioa of 16" Vater Mai. Exteasioa to the 1.5 aillioa galloa water storage taak - East Live Oak Road. Mr. Pau I Denham of Ford Eng i neeri ng showed a p I a t of what was presented previously, showing the new 16" main into the existing system from the U. c. 20" line. He advised the contrac tors are completing the water tank and should be painting it within three or four weeks. Mr. Baldwin asked if the new tank is as high as it was going to be. Mr. Denham said it is and the line will go a little beyond the line on East Live Oak Road. He said they will continue to tie in the 20" main through the system. With this new line, we will be improving the pressure and will have a very strong system and have room for future development throughout the city. Mr. Stanhope asked if we would be able to meet the schedule date. Mr. Denham said it may go a little beyond the December 14th date. In January we should see the system go on line. r-- Mr. Sweatt said the bulk of the work is in pretty tight areas and we will need some of our people out there. There are a couple of places where we might have to cut the street. Mr. Denham said they try to avoid cutting streets and there are only a few places where streets will have to be cut. On Chestnut there are about two places. He said they will try to put the 248 street back better than they found it and will be boring on Schertz Parkway. He said right now we have a construction esti.ate of '321.215 and are expecting to coae in a little less than that. Mr. Hartzog asked what the last estiaate was and Mr. Denhaa said about '290.000. Mr. Hartzog said when this was discussed before. he reaeabered that we were going to be a little tight with aoney. Mr. Sweatt said we would have a better handle on that after the bids coae in and before going to capi tal recovery sources. he will be bringing it back to Council. Mr. Hartzog asked if perhaps we could get a better price by giving a longer construction period. Mr. Denhaa said we are going to give SUfficient tiae but not enough so that they will have open trenches in back of yards for extended periods. It looks like we will get good product at good prices. #5 Update oa aew water well site ia Guadalupe Couaty aad its poteatial develop.eat. Mr. Denhaa showed on the aap the location question. which is owned by Morton Southwest. looking at a 100' x 200 foot site. which will future ground storage tank. We are looking production site. of the site in He said we are give rooa for a for a good well Mr. Stanhope asked what tiae schedule for drilling are we looking at. Mr. Denha. said 3 or 4 weeks. Answering Mayor Sawyer question on cost estiaates. Mr. Denhaa said the test well would be about '20.000. He said it would not be just a test well. we could put it to use as a back up well to the syste.. Mayor Sawyer asked if we could use bond aoney for this. Mr. Sweatt said he believed it was to be done with bond aoney but we .ay have to look at capital recovery sources for soae of it. Mr. Ford said the test well would be about '20.000 and to reaa it out would cost another '60.000. It would be ideal to pull the casing and reaa it out at the tiae of drilling - would be aore econo.ical. But if do not have the aoney. it will deteraine if the well warrants purChasing the property now. Mr. Stanhope said if we do not hurry up and drill anther well. one of these days we won't be able to 'get a well in that area. Mr. Ford said there are three good wells in that i.aediate location and we feel like this would be the aost productive and best location. Mr. Ford said we could write the specifications so that we can do that and stop at that point. We would want to bring up from 4000 to 5000 gallons per minute. This well is out of Guadalupe County and wou 1 d be more econoai ca 1 to run than the Nacogdoches we 11 ; and too this well will be primary. Mr. Sweatt said we would like for this to be on the next agenda. #3 Discussion of Medical Coverage bids. Mrs. Krause explained there were bids received from four companies. with some giving'different deductibles. The G.I.C. bid is not only the lowest. with a S100 deductible but seems to be the best bid also. With this company the employees would have the option of either using the deductible and the 20/80% coverage or they could use the insurance company doctors and pharmacies and save even more aoney. This company also offers a very reasonable dental coverage. We recommend the low bidder of G.I.C. to include the dental and $10,000 life AD&D coverage. which will be considerably lower in premium than the present carrier before their price increase. r- Mr. Baldwin asked if this was an insurance company or a trust and was told it was an insurance company. Mayor Sawyer asked that t his be on t he next agenda and Mr. Greenwald suggested going with the dental included. #6 Discussion of Waste Manage.ent proposed rate increase. Mr. Sweatt said he and Mr. Gutierrez have talked about this but have no verification on inforaation discussed. Within the next two weeks should have the verification. Mr. Sweatt said Mr. Gutierrez would like to discuss some of the increased cost to them. Mr. Gutierrez advised they have had increased costs primarily in two areas. One is the increased cost of disposing of the waste. Since the local landfill closed, they have to haul to the BFI landfill about 20 ailes away. which involves about a 40 minute turn around time. In August they had a 15% increase at BFI. He said they have indicated the increase to Schertz at 3.5%. Mr. Stanhope asked if this is a fair price throughout the region. r- ! Mr. Gutierrez said that in June of 1988, prior to having knowledge of what the BFI increase would be. they added a 7.5% increase in Universal City. He said they went to City of Cibolo and got a 6% increase on services provided there. He said that of the 6% they are requesting, 3.5% of that is just pass through. 250 1 , He said the cpr has increased by 4% and added to that, when the landfill was closed, they provided a 30 cubic yard container at the utility yard and eapty on being called. This is just another service that they did not have to provide. This is tor city waste only and there is no liait on the pulls required. o Hr. Baldwin asked the status at the proposed landtill. Hr. Gutierrez said the hearing dates are now set tor Deceaber 5th week. He telt he would know soaething by the end of the year. Hr. Baldwin asked what the City could expect on reduction of rates it they get the new landfill. Hr. Gutierrez said it appears that there would be a savings and at the tiae they have that inforaation available, the City should bring that to their attention and it can be discussed. Hr. Baldwin asked it the City paid tor all the tree services furnished by Waste Hanageaent, which Hr. Gutierrez said was added costs to thea, what would be the savings. Hr. Gutierrez said these services they provide the city would roughly be about .600 per 1I0nth. Ht. Sweatt said these are soae at the kinds at nuabers we will need tor thea to get to us. He said this was put on this agenda just to get the inforaation to Council and there will be a need 0 for aore inforaation. Hayor Sawyer said what the City Manager is saying is a little aore tiae is needed to get the inforaation and he asked Mr. Gutierrez to hold off on the rate increase at this tiae. Hr. Hartzol asked when Hr. Gutierrez wanted the new rates to 10 into effect. Hr. Gutierrez said hopefully by Noveaber 1st. Mr. Gutierrez said one other thing is that Council aay be heard soaething about the acquisition of Waste Manageaent by Garbage Gobbler. He said that itea is before the Justice Departaent. He said Waste Hanageaent has told the Federal Governaent that they would like to buy Garbage Gobbler. He said they did not know the status or what the outcoae would be. He said they do know that the Justice Departaent has told Waste Hanageaent they aay have to change soae structures of the coapany or soaething in the event that they want to purchase Garbage Gobbler. Mr. Gutierrez said he would keep Hr. Sweatt abreast of anything they hear froa either Waste Manaleaent or the Federal Governaent. Hr. Stanhope asked if anything is being done on burning garbage. Hr. Gutierrez said incineration process has been going on around big cities for a long tiae due to lack of landfill space. He said what would be coaing sooner that incineration would be o ..... He suggested the Council go over the suggested changes and at a later date have some member of the committee present to discuss their reasoning for the changes. #7 CITY MA.AGER'S REPORT: A. We are advertising for bids on 2 phase sea 1 coati ng. He presented a aap showi ng the time schedule. This is an ambitious program and will entail a lot of personal contact and in the news media. We will be needing a lot of he 1 pin advert i sing. I f anyone has suggest ions or ideas. please let the City Manager know. B. Some time ago we discussed getting rid of police units at auction. We have four units that we have cleaned up and plan to place in auction this month. We need to get rid of them and auction is the best way. C. Mr. Sweatt said we do have plans on changes in appearance of police units soon. A new color scheme for one thing. #8 ITEMS BY COU.CIL: >/: M.~!..._BJu:t~Qg: A. There was a United Suburban Cities meeting on Tuesday and they are talking about having a general membership lIeeting to solicit funds from each entity to go back to CPS. Live Oak. Leon Valley and Universal City paid for the attorney for Tuesday's meeting. He said CPS is starting to see the light a little bit. but are trying to justify the 14% San Antonio gets. He said they were talking about increasing the franchise fees to cities; but the USC said no. The general meeting will be on September 29th at Leon Valley. B. Have had a number of complaints about the odor from CCMA sewer plant. especially on Sunday and Monday nights. He said he had talked with Tom Weaver this date and Mr. Weaver said they do have a problem. They are meeting with an engineer from Austin and are working on the problem. Mr. Hartzog said he had invited Tom Weaver to this meeting but he had previous plans. Mr. Weaver said they wanted the people in Lone Oak to know that they have not forgotten them and they will be doing everything possible to alleviate the problem. M1:.!-_~t~.n.hQIH~: A. During the last electrical outage we had there were some houses in Lone Oak that really had difficulties. One had trouble with the water heater and had to call the fire department. Mr. Baldwin said we are just having more and more of these outages. Mrs. Tereletsky said she was aware of the trouble in Lone Oak and that GVEC has been out and they are working on a settlement. B. Mr. Baldwin said he received two or three calls from Deer Haven residents about the surveying and one of the surveyors said they were staking this out because we are going straight through to Schertz Parkway. Mr. Baldwin said he tried to explain to them i that the survey is only to determine the right of way. Mr. , Baldwin said he felt the City needs to be very careful that they communicate with all the people. Mr. Sweatt said part of our concern has been some discussion i regarding street improvements, right of way, and what sort of improvement should be made. We asked Ford Engineers to survey to identify the right of way - this would be very important to the future. C. Mr. Baldwin said he looked at the news about the City raising revenues. He felt we should make it clear to the media that the City Manager had nothing to do with these revenues. That was a decision made by the Council before Mr. Sweatt arrived on the i scene. Mayor Sawyer said he felt we could look forward to some really safe driving in our city from now on. Mr. Greenwald: A. P&Z recommendation on the lot on Kline Circle will be coming to Council soon. They feel this land is city right of way and the City should maintain it. Fencing would create dumping or some place for people to hide. Mr. Hartzog said the man's complaint was people going on his driveway. Mr. Graham said that P&Z had turned it back to the City staff and we will have some recommendations to go in and beautify and do away with the dog trail. B. Mr. Decker requested changing from mobile home to modular park. This was turned down because the street is too narrow to build to city specifications. Mr. Hartzoa: Concerning the newsletter and Economic Development Committee, he said he had talked with Mr. Sweatt and may have something at the next workshop. #9 ITEMS BY MAYOR: A. Mr. Sawyer pointed out that Council has not really done anything about Curtiss Street. The people came to Council about the street being in sorry state of affairs. 254 B. On 23rd of October there will be a Country Music Showcase and on September 24th the VFW Ladies Auxiliary are havinq their benefit breakfast and car wash. The Council is invited or they can donate $3.50 if they don't want to eat. Mr. Sweatt advised we have been keepinq up with the weather and staff had a meeting on the possible emergency. HopefullY these plans will not be put into effect. ,Mr. Hartzoq referred to a letter from Mr. Stan Siler requesting the use of the Community Center for the Girl's Basketball team to practice. Mr. Sweat announced the week of September 18 throuqh 24th will be observed as Texas Emergency Medical Services Week and the SAFES orqanization will be hostinq an open house. Mr. Stanhope referred to a letter in the previous packet on ,Nanette Walkinqstick, Animal Control Officer, which shows the caliber of people we have in Animal Control. 110 ADJouammtrr: There beinq no further business, the meeting was declared adjourned at 8:23 p.m. by Mayor Sawyer.
