REGULAR MEETING OF THE CITY COUNCIL
NOVEH'BER 3, 1987

The Schertz City Counc i I convened in Regular Ses s ion, Tuesday,
November 3, 1987, at 7: 00 p.m. in the Counci 1 Chambers of the
Xunicipal Complex, 1400 Schertz Parkway, Schertz J , Te~.s.. The
following members were present: Mayor EarIW.Sawyer. pres14ing;
Charles B. Sharpe; Hal Baidwin; Ray Stanhope; ~dolph Aguilar and
Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
Mayor Sawye'r opened the meeting and welcomed Captain Anderson
and his group of foreign students from Randolph Air Force Base.
Capt. Anderson introduced his four students.
BOARD -OI'AD.JVSDBBr: The City Council sitt'ing as the Board of
Adjustment considered a request by Paul and Philip Gelpke of the
Bottle Shoppe for a variance to the Plumbing Code.

Mayor Sawyer said he had talked with Mr. Gelpke, who had assured
him that If' the way they have the drain now ever becomes a
problem~ tbey will correct it according to the code. It would
cost him about $600 to make the change at this time.

Council discussed with Mr. Gelpke the variance request.
Mr. Sharpe moved to approve the variance for a period of one year
and h.v~ the Health Officer check it out and if not appro~e by
the Hea I th Off icer, then it wi II have to come into, comp I iance
with the code. Mr. Greenwald seconded the motion., which carried
with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#1 APpaOVAL 01' BIWUrBS: Mr. Sharpe moved to approve the
minutes of the Special Meeting of October 14 and the Regular
Meet ing of Oc tober 20, 1987. Kr. Stanhope seconded the mot ion,
which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#2 .BDIBe: 01' a-BSIDBBrS,: Mr'. Pat Osborne, who ,lives on
135. said he has-been a- part of the city for some time and has
not gotten any city services. He claimed he had lost his fire
insurance when he was annexed into the city. He said the State
requires the city to give him services within three years, so now

he wants the city to take him out of the city limits. He went OD
to say he does not have water or sewer and only occasionally sees
a city police car. He did say that he had to call the po11ce on
two occasions and they were very courteous and tried to help.
Mr. Osborne said he understands that now there will be a 135
bridge through his property to Lookout Road but he has not sold
any land for this purpose. He also mentioned that people are
burning trash at, night across from his property that causes them
problems with smoke. He wanted a answer to his request
immediately.
Answering questions from the Council, Mr. Osborne said he was
about 1000 feet from the sewer line and the nearest water line is
in the Industrial Park. His property is across the road from the
Bluebonnet Palace. There are about four houses between him and
the end of the water line.

In answer to Mr. Aguilar's question concerning his fire

Mr. Osborne said he wanted something to get in motion on the
water and sewer now because when they widen 135 they will be
taking about 30 to 40 feet off the front of his property.
Mr. Sharpe reminded Mr. Osborne that the Schertz Fire Department
would respond to fires on his property whether or not be was in
the City limits.
Mayor Sawyer explained that it is in the city's plans to extend
water down 135. Mr. Sawyer asked Mr. Osborne to give Council the
opportunity to work on the water and see what they could come up
with to include this in the present plans.
Mr. Osborne said they have well water and had it analyzed and it
is polluted.
Mayor Sawyer said Council would ask Mr. Gilmore to have the city
people go up to his property within two weeks to see what can be
done.

Mr. Aguilar moved to approve the first reading of an ordinance
amend ing the sign ordinance. Mr. Stanhope 8 econded the mot ion,
which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.

#4 ORDIBABCB: Mayor Sawyer introduced an ordinance and
read the caption as follows:
AN ORDINANCE

TEXAS, AMENDING ORDINANCE 83-F-7, 'SECTION
XXX - SEWER RATES ESTABLISHED, AS SET,OUT IN
EXHIBIT 5 AND REPEALING ALl ORDINANCES IN
CONFLICT.

Mr. Stanhope moved to approve the first reading of an ordinance
amending ordinance 83-F-7, Section XXX, Sewer Rates Established
to allow for cycle billing. Mr. Baldwin seconded the motion,
which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#5 P6Z APPOI.TIIBBT: Mr. Sharpe moved t.o approve the
recommendation of the Planning & Zoning Commission to appoint Mr.
George Vick to the P&Z. Mr. Stanhope seconded the mot10n, which
carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None

Mayor Sawyer explained that Schertz has met with other taxing
entities, including the School Board and have decided to try to
elect three members from this end of the County. The SCUC School
Board will cast their votes for Charles B. Sharpe arid the rest
for Clarence Jackson; Schertz is to cast their vote for Clarence
i Jackson, with Marion, Selma and Cibo10 also joining Schertz; and
i Bill Little will be the candidate for the Guadalupe County
Commissions Court.
Mr. Greenwald moved to cast Schertz' 159 votes for Clarence
Jackson for the Board of Directors for the Guadalupe County
Appraisal District. Mr. Sharpe seconded the motion, which
carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
Mr. Baldwin said that Mr. Morris had called and said he would
announce the winners on the 16th of November. The votes are due
by the 15th.

#7 ITEXS BY COURCIL: Mr. Sharpe said he had drafted a
letter that he would like to have sent to Trudy Messick, Manager
Address Programs Support of the u.s. Postal Service. Mr. Sharpe
said he met with her Monday and three others and discussed
adjustments and changes to the Schertz delivery service area. He
said he advised them that the City's bas ic goal is to have as
many people in the City of Schertz as possible to have their mail
delivered by Schertz Post Office. Mr. Sharpe said he agreed to
provide a current map of the city and E.T.J.. They are in the
process now of reviewing zip codes.

Mayor Sawyer agreed this should be done and to send a copy of the
letter to the Schertz Post Mistress. Mr. Sawyer said this could
be a life or death matter that would affect the Enhanced 911
system and that people like to get their mail addressed to where
they live.
Mr. Sharpe also reported that Carmalina Squires, who replaced (~, {S::
Mike Tanner on the Enhanced 911 Board, is getting status report /tf. 3
on the 911 system. She will provide us with a copy so that we
can tell our people that they cannot call 911 now.
Mr. Ba 1dwin asked if Counc i 1 cou Id review the Anima 1 Cont ro 1
ordinance at the next workshop.
Mr. Stanhope reported the gentleman he contacted about repainting y,e7 /
the welcome to Schertz sign and had looked at it and said he ( ,

would do it for $200, including materials. He requested the

Mr. Aguilar advised the Library Advisory Board had met and are
continuin~ thei;:plans to expand the library building. They also
submitted na.es fpr two-ye~~~~ard membersh1p and asked that they
be appointed at the next regular meeting.
#8 'ITDS BY IlAYOR: Mayor Sawyer re..1inied everyone of the
full-blown exercise with the Air Force to be held in Schertz this
month. The day has not been announced. Mr. Sawyer said he ,had
asked that they notify the schools at th~ time, as there will be
a lot of smoke and debris. Council will probably be getting
several phone calls wanting to know what is g6ing on.
Mr. Sawyer said he received a letter from Susan Tull, pres ident
of the PTA thanking the city's help in the recent bonfire at the
school.
#9 ADJOURBKEWT: Mr. Aguilar moved the meeting be adjourned
at 9:27 p.m.. Motion was seconded by Mr. Baldwin and unanimously
carried.
