SPECIAL MEETING OF THE CITY COUNCIL
NOVEMBER 2S, 1981

The Schertz City Council conven-ed in Special Workshop Session,
Wednesday, November 25, 1987, at 7:00 p.m. ia the Conference Room
of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph
Aguilar and Ken Greenwald. Staffptesent were City Manager Jimmy
G. Gilmore and City Secretary June G. Krause.

#2 Discussion of an ordinance reaulatina speed li.its on
I'.M. 1518.
Mr., Gilmore explained the State had sent in the recommended speed
limits for F.M. IS18 and W~ must pass an ordinance in order for
the City to 'enforce these speed limits.
Mayor Sawyer advised that the City had asked them to check the
F.M. 1518 speed limits for us and this is the results. We
~equested the speeds to be lowered around the park area.
Mr. Aguilar asked how a person would know the school speed limit,
when coming up from the creek on Aviation, was 20 miles per hour.
There was some discussion as to where the signs were suppose to 0:,'
be so Mr. Gilmore said he would check this out.
#3 Discussion of annexations.
We have asked our Financial advisor to tell us the economics of
annexing Northcliffe subdivision.
Dr. Chuck Hall, representing Rauscher Pierce, said he had checked
with Richard Harris and GUADCO Mud #1 is entirely within the city
limits of Schertz. If the city annexed them, they would be on
the same water rates and - taxes, etc. as the rest of the city
c it izens . However, GUADCO Mud #2 1 ies part 1y in the ETJ of
Cibolo, so to operate that system, you would have to ente_r into a
contract with Cibolo. With that background, should the city
annex GUADCO #1, it would be a negative cash flow of
approx iDia tely $100,000 a year; and that is only what it wou ld
take to maintain the system and pay the debt. That does not
count the amount the city would loose by loos ing them as a
customer. We would have to use all of their revenue just to
maintain the system. GUADCO#2 would be a lot less.
Mr. Aguilar asked at what time would the city be able to break
even if they annexed. Dr. Hall gave statistics on the water
rates and taxes for both GUADCO #1 AND GUADCO #2 and ended by U'
saying that GUADCO #1 jus t sold bonds' 1as t 'year at $300,000 a
year to the year200S.

Mr. Baldwin also asked if there was any provision for them
maintaining their system. Dr. Hall said not if the City annexed
them as GUADCO #1 is entirely in the City's ETJ so we could not
annex withottt taking over their debt. GUADCO 12 is partly out of
the City so we could make arrangem~nts for them to retain
maintenance on that one.
Mr. Sharpe asked what expenses would there be other than debt
service. Dr. Hall said for their fiscal year ending March 31st,
their operating expenses were about $340,000, their debt service
was about $264,000, with the total income being about $688,000,
leaving $84,000.
When asked the comparison of the property values of
Guadalupe Counties, Dr. Hall said he did not
information. Mr. Greenwald said he felt they
comparable.

Mr. Baldwin asked when the City could start disannexation of the
houses in question in Northcliffe.
Mayor Sawyer said Dr. Hall had made it quite clear that there

Mr. Baldwin said he did not have any problem with Northcliffe
taking on the responsibility of becoming a municipality it that
is what they want. .
Mayor Sawyer remarked that it would be up to
Council to say whether they could incorporate;

City Attorney before allowing that, as there are other things
involved.

Mr. Sharpe said that if they ask to be annexed and Council says
no, then they say they want to incorporate, then the Council has
no choice but to allow it.

Mr. Gilmore said he saw no problem with disannexing the houses on
Charleston but he did think the ones on the other side should not U'
be included. They were in the City when they built and there is
plans to bui ld some more hous e s there. When they bui It, they
knew they were in the city. The ones on Charleston where the
city limits goes through the middle of the lots were not intended
for annexation when we annexed the 750 feet either side of 1-35.
Dr. Hall had to leave the meeting at 8:51 p.m.
Mr. Aguilar asked what the complaint is.
Mr. Gilmore said they complained of paying the taxes.
Mr. Stanhope said that before committing, he would like to talk
to the people involved.
Mr. Baldwin said he had no problems with the new people that have
built, just the first ones that were not intended for annexation.

Mr. Sharpe asked what Council would do if some want disannexation
and some don't. Council agreed that the majority rules - either
they all request it or none will be disannexed. It was agreed 0'
that the letters should be sent, asking the people to reply by
the meeting of December 9th. Letters should also be sent to the
people that own the lots where possible.
#4 Diaeussion of Schert. Park.ay.
Mr. Gilmore said he had talked with the attorney and they had not
gotten a day for the court as yet. Council can go ahead and make
the deposit to Escrow, take possession of the land and go to work
if they desire. We will have to build a fence on both sides.
The escrow would be about $50,000.
Mayor Sawyer said he thought Council should go ahead and get
started on this; but he thought there may be another road block
when we do get started.
Mr. Gilaore reported that the water line running through Savannah
Square should be tested this week.
Council concensus was to go ahead and get started.
#5 Discussion of APA aeaherships for P.Z aeahers.
Mayor Sawyer said some of the P&Z members would like for Council
to approve memberships for them in the APA. He felt it would be
a good idea.

Mayor Sawyer said it was brought to Council attention that some
c;tiz~ns complained because they paid out-of-line fees for
citations. However, this particular one was different because
the total fines was based on more than one citation. Mayor
Sawyer said he felt our fees are in line.
Mr. Stanhope said that when the Animal Control Officer showed up
the animal was in the people's yard. Th~re was no proof that the
dog was out of their yard. The next day they came back and asked
if the people had gotten the animal shots and when the people
said no, they were given another ticket and the total ended up
being about $600.00.

Mr. Gi lmore cited a recent inc ident where the pers on rece i v ing
the citation became very belligerent. In the past Council had
asked why not have an Animal Control Officer out betwe~n five and
seven in the morning and between seven and eight at night because
that is when people seem to let their animals o~t.

Mayor Sawyer said Council requested to enforce the law gently the
first time and if a second time, then give ticket; or if they are
given a hard time, ticket zight then. Mayor Sawyer said he did
not know how many of the Council had met the ladies at the
Shelter but he had and he thought they are both gentle ladies and
they are reasonable.
Mr. Sharpe said he remembered the Council looking at reports and
commenting that no tickets were given so lets enforce the
ordinance.
Mayor Sawyer said he did not feel there was a need to change the
ordinance but just approach it in a gentle way.

Mr. Gilmore said that the Court points out that the Animal
Control Officers are too gentle.

#7 CITY KAWAGER'S REPORT:
A. Received a letter from the City of Marion thanking Council
for casting some votes for Jackson.,
B. Received a copy of letter from City of Cibolo t.o the State
Highway Department concerning' th~ future 1-35 expansion planning
to include a overpass at Wiederstein Road.
C. Also a letter from Guadalupe County saying they are going up
on the user fee for jail board.
Mr. Baldwin asked why the City had to pay this fee. Mayor Sawyer
said they are mostly for the ones that you would not mind paying
fine for.
D. there will be a Transportation Meeting on December 2nd at the
Seguin State Bank at 5:00 p.m. Mayor Sawyer asked that a staff
member be assigned to attend this meeting as well as
Councilmembers.
E. Received an application from Canyon Chamber of Commerce for
their December 12th parade.

#8 ITBIIS BY COUBCIL: Mr. Aguilar asked about when we were

not see the faint middle stripe at all. Mr. Gilmore said the

Mr. Aguilar also mentioned that with regards to the City's
port ion of Schertz Parkway, even if we have to jus t grade and
asphalt, we should do something just to get to Maske Road.

Mr. Sharpe asked the Mayor if he received a letter from the
Postal Service concerning delivery in Greenshire. He said he ()
understood that they have made a decision to delivery mail from9?~q/
the Schertz Post Office. Mayor Sawyer said he had not received J t'J.-
anything from them.
Mr. Sharpe announced that the Business Club will have the tree
lighting and program on December 3rd.
Mr. Sharpe also announced the Chamber of Commerce Christmas
meeting and dinner for December 12th at 6:30 at the Northcliffe
Country Club. Mayor Sawyer said he felt the City Council should
pay for these tickets at $15.00 each for those wishing to attend.
Mr. Sharpe asked Mr. Gilmore if there was a date set for the
meeting with Mr. Solms of New Braunfels Utilities on the sewer.
Mr. Gilmore said a tentative date of December 9th when he will
come to the workshop. Also the Monday meeting has been changed
to Friday, December 4th at 10:00 a.m. 1n New Braunfels.

Mr. Sharpe reported that Carmelita Squires is getting something DI},qr11
for the papers on the status of 911 system as to who can use 911 ?' /(,3
now and who can't.
Mr. Stanhope said Council had put money in the budget for a
sprinkler system out front of the Municipal Offices and wanted to
know when 1t would be done. Mr. Gilmore said after the 1st of
January 1988.
Answer ing a ques t ion by Mr. Stanhope, Mr. Gi lmore said we wou Id
also get started on the street work in January.
Mr. Greenwald suggested that the next time the attorney briefs
Council on the Parker case, the P&Z members should be invited to
attend as they are directly involved.
#9 ITEKS BY KAYOR: Mayor Sawyer advised that he is in the
proces s of be ing sued over the va lua t ion of Mrs. Fr ie s enhahn' s
property. Mr. Gilmore said our attorney had submitted a letter
to the Court on this stating that we have no influence on the
case. We are named but should not have been named as a party.
Mayor Sawyer said it had come to his attention that the Council
needs a liaison between the Housing Authority and the Council and
Mr. Baldwin has agreed to serve.

Mayor Sawyer said he will be appointing a gentleman named Keen to ~1, qo~

Mr. Sharpe said he concurred with the appointment of Mr. Baldwin
to this board and then asked Mr. Baldwin if he would get a copy
of the Housing Authority's long and short range plans.
Mr. Agui lar brought up the P&Z recommendat ion of checking the
legality of the Council sitting as the Board of Adju&tment. Mr.
Gilmore said he had checked and it is legal and would require a
~harter amendment to cbang~.
Mayor Sawyer said this was changed because there was a city board
that could override the decisions of the Council and he did not
think any board should be able to override the elec~ed Council.
