ccswks 12-09-1987 296 ~?o 40, ~'l \ ~~\ ~0, \?\ SPECIAL MEETING OF THE CITY COUNCIL DECEMBER 9, 1981 o The Schertz City Council convened in Special Workshop Session, Wednesday, December 9, 1987 at 7:88 p.m. in the Conference Room of the Municipal Complex, 1488 Schertz Parkway, Schertz, Texas. The following members were present: Mayor Earl W. Sawyer, presiding1 Charles B. Sharpe1 Hal Baldwin1 Ray Stanhope 1 Adolph Aguilar and Ken Greenwald. Staff present were Jimmy G. Gilmore, City Manager and June G. Krause, City Secretary. .1 IlBARIRG OF RESIDEftS: None .2 Mr. Sohns of Rev Braunfels Utilities to discuss surface water/sewer with Council. Mr. Sohns passed out copies of the Final Engineering Feasibility Report for Wastewater Collection and Treatment in the Dry Comal Creek Drainage Area. Mr. Sohns said they had found a need, due to needing a water line in the Solms area, to provide sanitary sewer in Solms. At about that time, Schertz had also decided on a need for water/wastewater in this same area. At one of the meetings with Mr. Gilmore, Mayor Sawyer and Councilman Sharpe, Mr. Sohns advised that they were planning to provide the sewer main but had to get their funding first. GBRA decided this report was not in their best interest and decided to go ahead with their own plans. In September, New Braunfels got their funding and are ready to get started in this area. Schertz would be facing the cost of a plant and continuing maintenance costs of a wastewater treatment plant. If something could be worked out together we both could avoid some of these costs. NBU completed their North plant in 1985 and have a south plant, which they will be increasing and will be br inging their Gruene plant up to date. Part of their expansion plans is to take a line to New Braunfels ETJ and provide a long term solution to Schertz' problem in that area. o Mr. Sam McKenzie explained that the Feasibility Report was compiled from information gathered from GBRA, representing Northcliffe, Schertz engineer Ed Ford and himself, representing New Braunfels. It consists of an analysis of what costs might be for each to put in their own plant and what it would be if they all went together. Page 12 of the report shows the 18 year plan for the City of Schertz as costing approximately $2,211,225. Mr. McKenzie then showed on the map the locations of all treatment plant lines and lift stations to accommodate the combined flows. Mr. Sohns said Schertz and New Braunfels need to be realistic with one another. He said he reports to the Board of Trustees. He handed out a proposal, which sets out a memorandum of understanding as discussed between Mr. Sohns and Mr. Gilmore. There will be two major points of connection agreeable by the 0 City of Schertz and New Braunfels Utilities. Those two connections will have a meter to register the amount of sewerage going into their city. (' 297 r-- The cost would be broken into three basic parts as follows: a. Up-front aid-to-construction based on an over-s~z~ng of system for the accommodation of Schertz. Could be paid as a yearly facility cost for up to 19 years. b. Operating and Maintenance Cost - based on yearly cost- ~ of-service analysis agreed on by City of Schertz and New Braunfels Utilities. Presently this cost is $.39/1999 gallons of treated sewage. c. A Central Facility cost paid by connecting customers at time of connection in accordance with NBU's current policy. The City of Schertz would be responsible for all systems above NBU service. Sewage strength would conform to NBU standards and be within specified PH and chemical limits. City of Schertz would revise generally the center line south with the City of New Braunfels I north of such center line. their present ETJ boundary to of Schwab Road at Interstate 35 being granted the ETJ boundary Mr. Sohns said that they hope that this effort in cooperation between our two communities might result in other areas of mutual benefits. Mr. Ford asked if NBU has an affluent control ordinance because that ordinance would become a part of the City of Schertz requirements. Mr. Baldwin asked ab~ut moving the COS ETJ. Mr. Gilmore said it would move our ETJ back about one mile and NBU would run the line that extra mile. Mr. Sohns agreed that one of the benefits would be that they would gain an additional mile of interstate. Mr. Sohns also said that this is an area where they are certified for electric service. It would be attractive to NBU and does save the City of Schertz considerable amount of money from building a plant and the operation costs. Mr. Gilmore said the discussions of moving the ETJ goes back several years, discussion had between the New Braunfels City Council and our Mayor. Mr. Sharpe asked if this is contingent on the City of Schertz moving their ETJ. Mr. Sohns said probably not, we want to take our line out to Solms and we don't want them to put in a sewer plant. Mr. Sharpe asked if Mr. Sohns saw any basic changes from the way he had calculated his costs because of the Impact Bill. Mr. 298 Sohns said he did not at this point until they would start to make changes. We are going to build this line - we have the money in the bank. Mr. Sohns said they would like to have D Schertz with them - he said he thought it could be made to work. i The attorneys could get together and draw up a long-term contract. C69.q~l- \~~ Mr. Sohns said he wanted to talk just a little about water. This has been a concern for several years - concern not just about quantity but that something big would pollute the Edwards; or because of drought, the overall balance of the Edwards would be affected. We have taken an initial step and are going to build a treatment plant. Then suddenly comes a report out of the blue from GBRA of which NBU were not a part. GBRA had gotten the cities of San Marcos, Buda, Marion, Lockhart, etc. in which they were proposing a central surface water treatment system. Their cost for procurement of water seems a little high, ranging from $1.29 to $6.99 per 1999 gallons. Mr. Sohns said his plan was for the procurement of water from Canyon Lake. He said for their present needs they would need 3,999 acre feet and with expansion, they might need 6,999 acre feet. He said we have an opportunity of a group between San Antonio and Austin, particularly San Marcos and Schertz, for the purchase of and use of additional water from Canyon Lake. With New Braunfels being in the middle, they feel they can supply water in both directions. Mr. Sohns said what he is asking is does Schertz want to be a part of this. He said they did not have all year to make up their minds and D they do want to move ahead. The engineers of each entity will be getting together to come up with something to look at to see if it makes sense - then there will be another meeting hopefully in January. Mr. Sohns said they are going to build a plant and are asking if Schertz wants to be a part of it. Mr. Ford asked if, .they had run into any kind of governmental funds that could help with this project. Mr. Sohns said the only thing might be a low interest rate loan but they had not investigated the possibility of a grant because of the time involved in that. Mr. Sohns said they wanted to get the line in and would like to go out for bids sometime next Spring or early summer so would like to have a commitment in January or February. Mayor Sawyer thanked Mr. Sohns and Mr. McKenzie for coming, saying he appreciated their time and effort. Mayor Sawyer then called for a short recess at 8:39 p.m. The Workshop session reconvened at 8:49 p.m. .3 EXECUTIVE SBSSIOR: Mayor Sawyer called an Executive Session at 8:49 p.m. under -Article 6252-17 Vernon's Texas Civil Statutes, Section 2 (g) to discuss, with the City's attorney, personnel legal matters. Attorney Paul Sexton advised that this policy was at the request of the Department of Justice, who suggested Schertz have such a policy. Mr. Gilmore said we were also asked by the FBI if we had such a policy. Council discussed various sections of the policy, with Mr. Baldwin suggesting that if there is a paragraph saying the City will do everything possible to protect the rights of the police officer, then there should be something in there saying we will do everything possible to protect the rights of the complainant. ::[t was also suggested that items 6 and 8 under Investigation should be combined. After further discussion, Council agreed with the policy as modified. #5 Discussion of bids for heavy-duty tractor/hydraulic Wing Mover. Mr. Greenwald advised that the first bids were for a shaft drive and these bids are for hydraulic drive. The Streets/Parks Department recommends the Torgerson bid be accepted. #6 CITY IlAllAGER'S REPORT: A. There is a summary of Dr. Hall's report on his GUADCO briefing. B. GVEC will be present on December 15 concerning their ~equest for a rate increase. C. Have started the procedures for tak ing control of Schertz Parkway - bids go out on the 17th and the money will be in Escrow on that date. This has all been worked out between the two attorneys. D. It is a cumulative effort for the entire county. Mr. Greenwald: A. BVYA contract is coming up for renewal. They have no changes to make. B. Spoke with Mrs. Richards and she said if the City could get someone that can professionally trim the Christmas tree, to go ahead and do it. C. The timer on the traffic light at First Street and F.M. 78 barely gives time for one car to get through. .8 I~BRS BY MAYOR: Mr. Sawyer mentioned that the Christmas Party for the children was real nice and Mr. Contreras did well as Santa.
