REGULAR MEETING OF THE CITY COUNCIL
DECEMBER 2, 1986
The Schertz City Council convened in Regular Session, Tuesday,
December 2, 1986, at 7:00 p.m. in the Council Chambers of the
Municipal Complex, 1400 Live Oak Road, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding;
Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph Aguilar and
!Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.

12 SPECIFIC USE PERMIT: Ma yor Sawyer sa id t his is
consideration of a request for a Specific Use Permit by the New
Creation Christian Fellowship.
Mr. Baldwin moved to deny this Specific Use Permit as requested
by the New Creation Christian Church. Mr. Aguilar seconded the
motion.

Mr. Baldwin said he did not have any complaints about the church
in Oak Forest if it had been just a church; but in his opinion,
what they were requesting was more than what a Specific Use
Permit should be. Mr. Baldwin told the representatives of the
Church that he would welcome them to the community but not in the
last R-I subdivision in the city.
Mr. Aguilar said that in regards to the location, they
selected an area with more traffic entrances to it.

Mayor Sawyer then called for a vote on the motion before Council.
Said motion carried with the following vote:

NAYS: None

#l EXECUTIVE SESSIOB: Mayor Sawyer ca lIed an execut ive
session at 7:10 p.m. to dis~uss court action with City attorneys.
Mr. Aguilar and Mr. Stanhope left the meeting prior to the
Council returning from executive session.
The Regular Meeting was reconvened at 7:35 p.m. with Mayor Sawyer
explaining that Council had just had an update from attorneys
Harris and Becker on the Parker Suit and the Mangum Suit.
#3 APPROVAL OF HIBUTES: Mr. Greenwald moved to table item
13 on the approval of1l1inutes of November 12th. Mr. Sharpe
seconded the motion, which carried with the following vote:

Mr. Greenwald moved to approve the resolution of noncompliance
Schertz Modular Park, Unit I. Mr. Sharpe seconded the motion.
Mr. Baldwin said the resolution says "the road appears to be in
the 100 year flood plain". Should the word "appears" be in
there? Mr. Greenwald said from all the maps we have, it appears
to be in the flood plain. Mayor Sawyer then called for a vote on
the motion before Council, and the motion carried with the
following vote:

#6 ORDIBARCE: Mayor Sawyer introduced and read the caption

AN ORDINANCE PROVIDING FOR THE EXTENSION OF
THE BOUNDARY LINES OF THE CITY OF SCHERTZ,
TEXAS, BY THE ANNEXATION OF A TRACT OF LAND
CONTAINING 121.906 ACRES MORE OR LESS, OUT OF
COMAL COUNTY.

17 ORDIRABCE: Mayor Sawyer introduced an ordinance
~egulating coin-operated machines. He then asked Mr. Young, who
pad reserved time, to come forward and speak on this item.
kr. Steve Young of Goofy Golf on Oak Street, said he had a
tremendous loss of revenues this past year because the State had
~ncreased their fees and this additional charge would just about
r- do him in. He said they try to run a family type business and
this would be just another thorn for them. He said they
represent from 50 to 60% of the game machines in Schertz and they
pave not presented any problems to the City. He said so many of
the people have gone out of this type business. Business is not
8ood, the State doubled their fees and now this. He said he had
.bout 40 machines in Schertz. The State charges about $30 per
~achine and then there is the $500 annual fee.
~ayor Sawyer thanked Mr. Young for his comments saying he was
familiar with Mr. Young's operation.
~r. Sharpe moved to table this ordinance and bring it up at some
future workshop for further consideration. Mr. Baldwin seconded
the motion, which carried with the following vote:

19 CITY KABAGER'S REPORT: A. Mr. Gilmore said he had a
copy of the work ~rder for -the manhole in Lone Oak, dated
November 11. The work should be started this date.

B. Have received a newspaper clipping from the San Antonio Light
regarding the Rittimann Addition improvements~ It has been
narrowed down to four organizations doing work out there.
Mayor Sawyer said this is the area we told Bexar County
Commissioners we would annex if they straightened it out.
C. Mr. Gilmore announced the Christmas Tree Lighting and program
for December 4th at 6:00 p.m. and the Ground Breaking for the VFW
this same morning at 11:00 a.m.
D. We do have the stop signs up in Woodland Oaks. The major
drainage problem should be taken care of -with the presentation of
Unit 4.
#10 ITEHS BY COUBCIL: Mr. Sharpe: A. Schertz Business
Club will have their Christmas party Friday night at 7:00 at the
Kountry Kitchen. Call in your reservations and take a small gift
to exchange.
B. Mr. Ken White wi th the Corr idor Report is present. We were
notified that they would be doing an issue on Schertz and there
was some discussion of them editorializing in the report.

Mr. Gilmore said the letter stating this did not get mailed to
them. Mayor Sawyer sa id Counc i 1 had discussed about ed i tor ia I

and we objected.
Mr. Greenwald said he wanted to congratulate the Clemens Buffalos
for a fantastic season even if they did not go all the way, they
had a great season.
#11 ITEHS BY KAYOB.: Mr. Stanhope and Mr. Aguilar asked the
Mayor to give their apologies for having to leave early.
The Library and Humane Society are discussing the annual dance
and auction. This is the only fund raising event they have and
we do need to help and need the support of our citizens on this.
Mayor Sawyer sa id he ta lked wi th Mr. Kruet ler and he sa id he
would be willing to serve on the Appraisal Board.
Last night Mayor Sawyer appointed Mrs. Ann Vick to the Housing
Authority Board. She has been a resident of this city for years.
She is replacing Jerry Bortel, who had to leave for health
reasons. Mr. Warren was reappointed to the Board. Mrs. Stanhope 0
is now Chairman of the Housing Authority Board as of last night.
