#2 Discussion of Schertz Par~way drdinance and letter of
agreement.
Mayor Sawyer suggested that our lawyers study these documents as
there seem to be some things included that are~a$ainst the law.
Mr. Sawyer said Counc i I shou Id ask, Mr. Gi lmore to wr ite theM a
letter and tell them what changes Council wants.
Mr. Gilmore said that in the first paragraph of the agreeMent it
refers to property owned by the owners. There is a street in
Live Oak Hills that is not owned by the owners but situated
within the property of the owners. It also states the completion 0
of our portion within two years of signed contract. If Council
will remember, there was a letter of agreeMent back in October of
1985 that said comp lete our port ion in 1988. Two year s is not
what we agreed to originally.
Mr. Stanhope said that he and Mr. Greenwald were meMbers of the
group and only met about two times. Mr. Gilmore said the g~~up
could not meet in the evenings and the Councilmembers could not
meet during the day.
Concerning paragraph two, Mr. Gilmore said that in the original
agreement, we were to extend the water line to the road - from
Mobile Villa down to Schertz Parkway. There seems to be no
prob lem with paragraph 2, except the Mayor brought out that it
does not identify the mobile home by naMe.
Mr. Sharpe asked the price of extending this line. Mr. GilMore
said he did not have the exact figures but probably from five to
ten thousand for the 12 inch line.
Mayor Sawyer said that in paragraph 3 where it says "a platting
program applicable to all property within the city" this
statement 1S way out of line. Mr. GilMore agreed, saying it'
would have to refer to property along and within 500 feet of the
property.

~r. Gilmore said the 1-35 Partnership would like for the Council
~o get an agreement worked out by the 15th of January. Mr.
Filmore said he would rewrite this agreement using Council
!suggestions and working with the group and then would come back
to Council for review again. Mr. Gilmore said we have the Live
Oak Hills property and,the agreement is that they would build the
road through Live Oak Hills and all the City would do is the
lower end.

Mr. Aguilar said' he disagreed with the word "promptly" in the
first paragraph and asked that it be removed. Mr. Sharpe and Mr.
!Baldwin said they did not agree with the statement in paragraph 5
'that "the street is being constructed long before it is needed".
lt should say that the road is needed and will benefit the land
owners of the City.
IMr. Sharpe asked if Mr. Gilmore had talked with Universal City
because you can drive down Coronado Boulevard and there are
Istretches where no homes are being built all the way to 1-35.
~r. Gilmore said he did talk with Mr. Tanner and he said the
~evel~per built the road himself and they had agreed to some type
bf reimbursement for the water line.
~ayor Sawyer said that regarding the proposed ordinance, it is
~lose to the one on FM 3009 but more restrictive. We will need
'to have a public hearing on this before considering passage.
Council went over the ordinance, making suggested changes, which
!will be taken into consideration. Both the agreement and the
ordinance will need to be studied by our attorney before going
'further.
#3 C i t Y Manager's report: Mr. Gi lmore reported that the
~ity will have two new police officer coming on January lst and
~hat we may be loosing two of our present officers - one to the
aighway Patrol and one may go to Universal City.

15 Items by Mayor: Mayor Sawyer said that he had written a
ilet ter to the Hera ld newspaper regarding the Bond elect ion and
~hey have said they will also write an editorial for us. There

need for the bonds.

Mayor Sawyer said that SOMeone had mentioned to him that they
would like to start a newspaper to compete with the Herald. Mr.
Sharpe said if they want' to' start a paper, it should be because 0
there is a need and not just to compete. Mr. Greenwald expressed
his opinion that there is not enough advertising on this side of .
the Cibolo creek.

Sawyer declared the Meeting to be adjourned at 8:50 p.m.
