SPECIAL MEETING OF THE CITY COUNCIL
JANUARY 14, 1987
The Schert z City Counc i 1 convened in Spec ia 1 Workshop Se s s ion,
Wednesday, January 14, 1987, at 7:00 p.m. in the Conference Room
,of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope; Adolph
Aguilar and Ken Greenwald. Staff present were City Manager Jimmy
~. Gilmore and City Secretary June G. Krause.
~ayor Sawyer opened the meeting and welcomed everyone, especially
~r. Charles Forbes and Mr. Paul Brown.

#4 Mr. Forbes and Mr. Brown to discuss land improvements.
ir. Gilmore said the, City has approached New Braunfels in an
ffort to get sewer to the area of Mr. Forbes property. New
, raunfe 1& seems very int ere sted in the propo sit ion and Mr. Bob
$olms is preparing a letter of understanding. It should be
received in a few weeks. The big thing is that they cannot put
,ewage in someone else's ci~y. One proposition was that New
~raunfels run the sewer to Schwab Road and it was discussed that
Schertz give up that portion from Schwab Road back. That would
*llow three or four collection points on that sewer and establish

an amount we would be allowed to pump through the sewer on their
rates. This would not only serve the Forbes property but some
other areas. It would open up the whole area from FM 1103 North Q",'
of I-35 to the city limits. ,It will be a long time before any of
this land opens up unless there is sewer available. 'The loss of
land mass will be offset by growth in that area. This would be
the most economical as well as most feasible. New Braunfels has
the capaci,ty.
Mr. Aguilar asked'if we give up this finger ,of land, then would
they will extend the sewer line. Mr. Gilmore said yes - that
they will not build a sewer line in another city limits. Mr.
Aguilar suggested that we tell them they can have North of I-35
and Schertz will keep South of I-35.
Mr. Stanhope asked how much it would cost for Schertz to build
the line. Mr. Gilmore said he did not have exact figures but
about one million dollars. The line would be about 3/4 to one
mile. If we built the sewer line, we would still have to have
New Braunfels permission to tie in.
After further discussion, Mr. Aguilar suggested holding this in
abeyance until we get their letter of understanding.

Mr. Sharpe asked how long it would be to get the City's discharge
permit. Mr. Gilmore explained that he had just received a letter
asking for additional information.
Mayor Sawyer said the last thing the City wants to do is get in
the sewer business. He said the next best step i~ to get a lift
station up there and pump back over the hill. Mr. Gilmore said
w~ have that planning going but the most economical way is to go
with New Braunfels.

Mr. Greenwald said that if we give up about a mile of 1-35 and
only pump 200,000 a day, it would not be worth it. Mr. Gilmore
said the sewer plant under discussion was for 500,000 gallons a
day. Mr. Solms thinks it would handle everything back to FM 1103
and would allow for development. Mr. Solms also said they have
no immediate need for sewer in that area. They will have to
furnish Solms sometime in the future and to accommodate that
area, they will have to oversize the lines. Mr. Gilmore said
that with what they are offering, the benefits would more than
outweigh what we would have to give up.
Mr. Forbes said he appreciated the Council putting them on the
agenda, giving them time.

Mayor Sawyer informed the City Manager Counci 1 agreed to bring
his salary up to $36,500 per year.

Mr. Aguilar called attention to a possible illegal sign on 135
and Mr. Sharpe asked that something be done about the pile of
dirt in the same area that needs to be taken care of.
E. Mr. Gilmore called attention to the recommended Mobile Home
Ordinance in Council packets. He said this will be going to
Planning and Zoning for their recommendation. He only gave
Council a copy so they could be studying it. Mr. Gilmore said
that hopefully staff has covered problems we have had in other
parks. The ordinance has been sent to Richard Harris for review.

F. Concerning the letter sent to the railroad about ,taking c.re
of the right of way on FM 78. they sent us a proposal th.t we pay
them $120 a year and assuMe all responsibility and liability for
right of way Mowing etc. Mr. Stanhope said he felt that the
upkeep of the right of way was Our responsibility and we should
do it. Mr. Baldwin asked if the City could treat them like any
other property owner in the City and send theM a weed letter and
if they do not cut it, we cut it and send them a bill.

G. Mr. Gi l~ore said that concerning - hea I to inspec t ions, we ,4lre
sti 11 having prob lems with Mr. Parker. The new prob leMs have
been sent to the attorney because Mr. Parker is Challenging every
ordinance of the city.
H. We have gone back to Green Valley and tried to ~egoti~te some
kind of deal with them. Which every way the Federal Court _~ules,
we are going to have an - appeal which would take two to three
years.

anything from -our lett-er Offering to buy Green Valley's systeM.
Mayor Sawyer said our attorney told us not'to send the letter or
sign anything.
Mr. Greenwald said it was brought up at- P&'Z Meeting that the City
should at least ket SOMe of our staff people to l~ok at problems
involved if the Pope's Open Mass is held at RetaMa. There should
be some plans for it.

Mr. Greenwald asked staff to check if any of Our aMbUlances have
a Ford chassis since there have been SOMe recalls on the 1984-85
mode 1&.
Also Mr. Greenwa ld asked if Garden Ridge is on our SAFES area.
Mr. GilMore said he will check but that Tom Funk said th~ .rticle
and said that he will not bid.
Mr. Greenwald asked if when the Schertz Parkway
completed, if it would be sent to Planning & Zoning.

Mr. Ba ldwin announced tha t the Ca tho 1 ic church had agreed to
allow the City to use the Parish Hall on the second Saturday in
May for the Senior Citizen Day. He also reminded CouncilMeMbers
that there will be a need for prizes, etc.
Mr. Sharpe said he noticed that in Windy Meadows, the contractor
was taking out 5 or 6 fire plugs because they were about 12
inChes out of the ground. He asked if our inspectors check
things like that before it is done. Mr. GII.ore said he will
check but normally it is the responsibility of their design
engineer.

Mr. Sharpe also mentioned that the entrance to Windy Meadows
street is already deteriorating.

Mr. Sharpe asked if the City had to make an annual designation of rJ\~:3'f;
a newspaper. Mr. Gilmore said there is no time limit and we can "/O?J
change the designation any time Council desires.
Mr. Aguilar said he noticed that the Mayor wrote a letter
thanking the people for voting in our recent bond election. He
thought it would be nice to send a letter to those businesses
that advertised for us. Mayor Sawyer suggested presenting
plaques to Mr. Burton of Dairy Queen, Dr. Harborth and Walter
Schertz for their allowing us to advertise on their property.
Mr. Aguilar said that when we have high water, we have a big mess
on the Cibolo Creek. Who clean this up? Mr. Gilmore said if
anything is done, it is done by us.
Mr. Aguilar also asked who cleans the one at Oak Forest on the
south. Mr. Gilmore said we do even though technically it belongs
to the State we end up doing it.
Mr. Aguilar said that he did not know what the Housing Authority
has in mind but we should not let anyone else use the space set
aside for welfare.

~ime. Mr. Gilmore said he would try to have Mr. Anderlitch at

Mayor Sawyer advised that he, feels Univ~rsal City is about ready
to get rid of their in-house engineer as it is costing them all 0'\',
kinds of money.
Mr. Agui lar asked if we have quest ioned rais ing our Cab Ie TV
franchise. Mr. Gilmore said he has called Rogers Cable System
and has talked with Mr. Harris. He said he is still working on
this.
Mr. Sharpe sugge.sted Council s_hould be looking at the 'enhanced
911 systeM since they have a better systeMs now.
