March 3, 1987, at 7:00 p.m. in the Council Chambers of the
Munic ipa 1 Comp lex, 1400 Live Oak Road, Scher t z, Texa s . The
following me.bers were present: Mayor Earl W. Sawyer, presiding;
ChatlesB~ Sh~rpe, ~al Baldwin, Ray~tanhope; Adolph Aguilar ahd
Ken Greenwa ld. Planning and Zoning Commis s ion Member s pre sen t :
Thomas Yarling, Chairman; Bob Andrews; Merwin Willman; Ty
Brisgill; Keith Van Dine. Staff present were City Manager Jimmy
G. Gilmore, Planning Coordinator Steve Simonson and Deputy City
Secretary Alice Austin.
PUBLIC HEARIIG: Mayor Sawyer opened the public hearing
and turned the meeting over to Thomas Yarling. Mr. Yarling
advised that the public hearing was being held to receive input
from the public on the proposed rezoning of t~e frontage of IH-10
from Weichold Road to F.M. 1518 for a depth' of 750 fe,et, from
pre-deve lopment to Genera I Bus ines s. M'r. Yar I ing asked Steve
Simonson to brief the meeting on reason for rezoning.
Mr. Simonson advised that General Business was the proper zoning
for the area as there were already businesses located in this
area. He advised that 52 letters had been sent and he had
received answers from 6 property owners (5 in favor of zoning and
1 against).

Mr. Yarling asked if there were any citizens who wished to speak
for or against the rezoning. Mr. Bob McIntyre advised that he
wa s repre sent ing Mr. Char Ie s Banks and tha t Mr. Banks wa s in
favor of the rezoning from predevelopment to general business.
Mrs. Irene Rappmund advised that she felt this was not the proper
zoning for her property. Her concern was that development would
c rea te an add it iona I dra inage prob lem for the land she and her
children own along IH 10.
Mayor Sawyer advised that there were laws governing drainage from
new developments.
Mr. Yarling closed the public hearing at 7:27 p.m.
Ma yor Sawyer reconvened the Regu la r Meet ing at 7: 35 p.m. and
presented a proclamation to Mr. Sharpe and Henry Guiterrez
designating March 20 to April 18 as Spring Spruce Up Month.

11 APPROVAL OF HIBUTES: Mr. Sharpe made a motion to
approve the minutes of the Regular Meeting of February 3, 1987
and the Special Meeting of February 11, 1987. Mr. Stanhope
seconded the motion which carried with the following vote:
AYES: Councilmember Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#2 HEARIRG OF RESIDERTS: Mayor Sawyer asked if there
were any residents who who wished to speak on items which were
not on the agenda. Bobbie Vonada, 422 River Road asked to be
heard. Mrs. Vonada played a tape recording of a dog ye lping
continuously. She advised that this had been going on since
December and she had been attempting to get some relief but to no
avail. She advised that she had talked to the owner,
representatives of the Animal Control Department, other
representatives of the City and had filed charge with the court
but she was still having the problem.
Mr. Harris, City Attorney advised that this was a grey area of
the law because it was difficult to prove what was too loud. He
also advised that he would check into getting copies of
ordinances which had already been tried in the courts.

Mrs. Vonada said she tried everything to correct the situation
and was now begging Council to do something.
Council requested that this be placed on the next workshop agenda
for further study.

#3 BID AVARD: A. Mayor Sawyer introduced for {ill) .{;
consideration the awarding of bid for construction of Crest Oak
Drainage structure. Mr. Gilmore advised that Ford Engineering ! S_-:J
was recommending the bid by Hugh Johnson Construction who was low
bidder. Mr. Greenwald mad the motion to accept the bid of
$65,660 from Hugh Johnson Construction. Mr. Baldwin seconded the
motion which carried with the following vote:
AYES: Councilmember Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald
NAYS: None
B. Mayor Sawyer introduced for consideration the awarding
of bid for Striping Machine. Mr. Gilmore advised that staff was
recommending bid submitted by Saf-T-Mark Supply Company.
Although three bids had been received, two did not meet specs.
Mr. Stanhope mad the mot ion to accept the bid by Saf-T-Mark
Supply Company of $4390.00. Mr. Greenwald seconded the motion
which carried with the following vote:
AYES: Councilmember Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald
NAYS: None

#4 O.DI.A~CB: Mayor Sawyer introduced an ordinance and
read the caption as follows:

AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, AMENDING ORDINANCE NO. 78-F-15 INCREASING
THE FRANCHISE FEE PAID BY ROGERS CABLE SYSTEMS OF
THE SOUTHWEST, INCORPORATED FROM 3% TO 5%.
Mr. Sharpe made the motion to approve on first reading the
ordinance amending Ordinance No. 78-f-15 increasing the Franchise
fee paid by Rogers Cablesystems. Mr. Aguilar seconded the
motion.
Mr. Baldwin asked if we had taken a look at the added revenues
that would be generated. Advised that he did not understand why
this was being done at this time. He advised that he felt they
shou ld look at th i s dur ing budge t time if added revenue s were
needed.
Mayor Sawyer called for vote which carried with the following
vote:

#5 FIB.B TB.UCI: Mayor Sawyer introduced for consideration
for approval of fire' truck purchase. Mr. GilMore advised that Ed
Melton, Fire Chief had located a pumper that was only 2 years old
which was for sell. New the pumper costs $80,000 and the seller
is asking $45,000. Mr. Baldwin made the motion to approve the
purchase of the f ire truck. Mr. Stanhop~ seconded the mot ion
which carried with the following vote:
AYES: CouncilmeMber Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#6 LBTTBB. O~ SUPPORT: Mayor Sawyer read a letter to Ron
Freeman, Executive -Director of the Schertz Housiug Authority
pledging the City's support and waiving permit fees for their
remodeling of housing project. Mr. Greenwald made the motion for
the Mayor to sign letter of support for Housing Authority. Mr.
Sharpe seconded the motion which carried with the following vote:

property located on FM 3009 for a 90 to 120 day period. Mr.
Sharpe made the motion to approve the variance requested by Waste
Management of San Antonio. Mr. Greenwald seconded the motion.
,Mr. Aguilar requested that a date be established limiting time of
Ivariance. The motion was amended to allow the variance until
iJuly 31, 1987. The motion carried with the following vote:
AYES: Councilmember Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.

i #8 PAVILIOR ADDITIOR: Mayor Sawyer presented for
japprova I a request by the Scher tz Volunteer Fire Department to
ladd a 24 x 16 foot building on the north sid,e of the large
iPavilion in Pickrell Park. Mr. Gilmore advised that they would
make the building 'look like their existing building. The new
!building would be used for the sale of beer. Mr. Stanhope made
ithe motion to approve the plans for a building at the large
ipavilion. Mr. Baldwin seconded the motion which carried with the
ifollowing vote:

I 19 CITY MARAGER'S IEPOB.T: Mr. Gilmore advised that the
iHerald Newspaper would lik~ to know if the city was interested in 7
['participating in the publication of a monthly newsletter. The
newsletter would be inserted into the papers for this area. The
Ipaper would sell advertising space to defray cost. The insert
Iwould contain 12 pages including advertisements. The City would
be responsible for furnishing the information for the newsletter.
A consensus of Council was that they had no problem with the
city's participation. Mr. Sharpe requested that the item be
placed on the next workshop for further discussion.
IIO ITEMS BY COURCIL: Mr. Sharpe advised that he had
attended a meeting of the Guadalupe County Appraisal Board and
had reiterated that a timely accurate appraisal was needed. He
advised that they would be close to mailing out appraisals in
May. Mr. Sharpe advised that he had attended a meeting of the
Austin/San Antonio Corridor Economic Task Force.
Mr. Baldwin advised that he wished to clarify his stand on the
increase in Franchise fee for Rogers Cable. He said that Council
must look ottt for the citizens ~elfare and he felt that now was
not the time to increase the franchise fee.

Mr. Aguilar advised that the Library and Humane Society had had a /r,/',~C(
successful auction/dance. They had raised approximately $l400 (;
each. He said he would like to thank all those who participated,
the volunteers and those who came. He advised that Mr. Lanier,
the auctioneer had been very helpful and although he is not from
Schertz had volunteered to help anytime.

Mr. Agu i lar a Iso advi sed tha t peop Ie were reque st ing tha t the
Library be open on Sunday and that the Library would like to add
on to their existing building. They have SOMe money but would
need the city's help.
Mr. Greenwald advised that he had attended BVYA Board meeting on
April II. He had received an updated listing of officers and
field maintenance director. He advised that in listening to the
figures on both boys and girls programs, it appears they will
have to combine with some other league to be eligible.
#11 ITEMS BY MAYOB.: M'ayor Sawyer advised that he would
be out of town for the next workshop Meeting. He advised that he
had rece ived a let ter from Repre senta t ive KeMp Ie who sa id he
enj~ysworking with us. He wants to Meet to start talking about
planning phase of IH 35.
Mr. Sharpe advised that the County Commissioners Court had voted
to terminate their contract with Seguin EMS. He advised that
letter in Seguin paper was very biased. ComMissioner Brannon
needs information on number of people served in the County as
well as the City by Safes AMbulance.

Mr. Stanhope advised that there were to bills proposed in Austin
one concerning riding in the back of pickup and the other
concerning the bUMper size and height from ground.
#12 ADJOUB.BMEBT: On a Motion by Mr. Aguilar and second
by Mr. Greenwald and unanimous approval the Meeting was 'adjourned
at 8:32 p.m.
