SPECIAL MEETING OF THE CITY COUNCIL
MARCH 25, 1987
The Schertz City Council convened in Special Workshop Session,
wednesday, March 25, 1987, at 7 :00 p.m. in the Council Chambers
of the Municipal Complex, 1400 Live Oak Road, Schertz, Texas.
The following members were present: Mayor Earl W. Sawyer,
presiding; Charles B. Sharpe; Hal Baldwin; Ray Stanhope, Adolph
Aguilar and Ken Greenwald. Staff present were City Manager Jimmy
G. Gilmore and City Secretary June G. Krause.
#1' IlEARING OF RESIDENTS: ., None
#2 BID OPENING: Opening of bids in award of bonds.
Mr. Torn Anderlitch said he had a few good words for Council.
While the rest of the State has been going down in their bond
rating, Schertz did a reversal and went up. Moody upgraded the
City's rating on General Obligation bonds from B aa to a Baal;
and raised Utility System Revenue rating from a Baa to A. This
is the r~sttlts of good management. We are starting off the year
extremely well from a financial basis.

Mr. Anderlitch then introduced his assistants Dr. Chuck Hall and
Ms. Rita Johnson.
He said there were four bids received on the Revenue Bonds and
seven received for the General Obligation Bonds.
Mr. Anderlitch then opened the bids for the Revenue Bonds first
as follows:

The low bid shows that the City will save from $3,000 to $5,000 a
year on the debt service.
Mr. Anderlitch said it will be their recommendation to Council to
accept the low bid of Dean Witter Reynolds, Inc. at 7.117339.
Mr. Anderli tch then opened the bids for the General Obligation

Mr. Anderlitch said they would also ,recommend the low bidder,
Lovett Mitchell Webb & Carrison, Inc. be awarded this bid.
#3 ORDINANCE: Mr. Greenwald moved to award to the low
bidder Lovett' Mitchell Webb & Carrison, Inc. and authorizing
issuance of GO bonds and declaring an emergency. Mr. Baldwin
seconded the motion, which carried with the following vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.

#4 ORDINANCE: Mr. Baldwin moved to accept the low bid of
Dean Witter' Reynolds, Inc. at a 7.117339 interest rate and
authorize issuance of Revenue Bonds and declaring an emergency.
Mr. Stanhope seconded the motion, which carried as followed:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
Mayor Sawyer said the City has done well on the bids and our bond
rating is excellent thanks to our staff. He then called a recess
at 7:23 p.m. in order for the papers to be signed.
The Special Meeting was reconvened at 8:05 p.m.
#5 Consideration of P&Z recommendation on defining limits

Mayor Sawyer said he felt we need to do this as it was never
officialy named.
Mr. Greenwald said this has caused some problems on the overlay
limits and how far,back they go.
Mayor Sawyer said if Council had no problem with this, it would
be se~ '.up for' agenda.

A. Discussion of first reading of an ordinance on the annexation
of 60.911 acres of land, which is the Eckhart Road property.

B. Discussion of first reading of an ordinance on the annexation
of 107.63 acres of land, the Lower Seguin Road property.

Mayor Sawyer said he thought some Councilmembers had problems
with this annexation, but was assured that this is not the one.
Mr. Gilmore advised that Lower Seguin Road is paved and only one
small area that would be a problem at all. The rest is fairly
newly done. In answer to Mr. Aguilar's question, Mr. Gilmore
said there is only the one road in the proposed annexation~
Mr. Gilmore referred to the gentleman that had asked about water.
The 2 inch line is now at capacity, in order to stay within our
ordinance, we would have to run a 6 inch line 9100 to 9200 linear
feet, at a cost of $65,00 to $75,000. In an emergency, we could
run an emergency line on top of the ground within 24 tiours.
Mr. Aguilar said that the gentlemen does have a concern and we
should tell him about our priorities and that eventually we do
intend to extend the line to this area. He wants us to do it
immed;i.at~ly. " ,
Mr. Gilmore said the only thing we could promise him would be in
case of a dire emergency, we could furnish him water within 24
hours for drinking and the bare necessities. Otherwise he will
have to wait his turn just like Schirmerville.

Mr. Gilmore said we could not extend the 2 inch line because it
would put us in jeopardy with the State laws.
Mr. Aguilar mentioned that those near the landfill will not get
off scot free and the problem is not going to go away if we do or
not annex.
Mr. Sharpe reminded that the City has annexed a lot of areas and
have plans to serve all with water and this property will just
have to fit into the plans.

#7 CITY MANAGER'S REPORT: A.: The,Ghurch of Good Shepherd
is having their annual festival on May' 3 and are asking
permission to put up banners and signs two weeks in advance of
the festival just as they have in the past.
Mayor said we have let them do it before and have had no
problems.

B. Mr. Gilmore said you each have a copy of HB 133 which refers
to Cable TV. It is proposed in the manner that our resolution
requested. TML supports it. If the bill is passed, the sales
and use tax will go to the place where the service is given.
C. We are now at 93.59% in tax collections.
D. You have a copy of an ordinance amending the ordinance
creating the Planning & Zoning Commission. This is just a work
copy to show what P&Z is recommending.
E. Got a letter this afternoon from Moodys telling us that it is
upgrading our bond ratings. They will request current and
updated information on finances. We will do everything possible
to maintain our upgraded ratIng'. '
F. In reference to the Boeck homestead annexation, we met with
'Kent 'Meyer"of. Converse. '-'M:~~' :,$harp~ was','at the meeting. It is my
understanding that they' will not contes't the' annexation but would
like to work on an agreement for the future that we will not
interfere with their negotiations with San Antonio in further
annexations. They are wanting to work up a Letter of Agreement
setting boundaries at a later date.
Mr. Sharpe said 'interfere' is not the right word.

Mayor Sawyer suggested saying that we will not annex anyone that
does not ask to be annexed.
Mrs. Fenner said she had talked with Mayor Friesenhahn and they
do want something in writing since they feel that Schertz
reneged.
Mayor Sawyer said since they want this for the 2nd of April and
we will not have another meeting before that date, Council can
call another meeting.
Mr. Sharpe suggested writing a letter saying we have no intention
of annexing other than the Boeck property.
Mayor Sawy~r instructed the City M~nager to write a letter and
C6uncil~emb~rs should~o by and 'look' at it before Friday
afternoon, when he will come in and sign'it.
#8 ITmIS BY COOHCIL: Mr. Sharpe said he had given Mr.
Gilmore some'forms from'the Appraisal District and anyone who has
not rendered their property, have until April 1 to do so.
Mr. Sharpe said Council needs to start looking at Schertz
Parkway. We need to change the signs, get with the Post Office
and set out when it will be changed so that we can notify the
people. Maybe when we have the change-over date, we could have a
ribbon cutting or something.

Mr. Stanhope said he thought Council renamed East Live Oak Road.
Mr. Sharpe said it was discussed with the joint Cibolo CommitteecZ'''
but did not change. Mr. Gilmore said the part east of FM 3009
belongs to Cibolo and we cannot change that name.

Mr. Stanhope said that during his campaigning, he got some!; I' I ~~ \
feedback saying he was cutting back on the Animal Control budget v I < I

May. There will be a proclamation honoring one of our seniors.

Mr. Greenwald said there are two excellent books that would
benefit Planning & Zoning: but they only have $100 left in their
budget for publications. Mayor Sawyer said he saw nothing wrong
with transferring $100 from Council to Planning & Zoning budget.

One of the P&Z members brought up about the dog kennels and /' ,1, (',\
junked cars and trash in the Shirmerville area. This needs to be !(,. "
checked out.
Reminded Councilmembers to read and check out the changes that /,\ ?~ 1~.
are being recommended in the ordinance amending the creation of .,( Iii :'
the Planning & Zoning Commission.
There were two variances denied at P&Z and both of them were from
churches. Both were informed they could appeal to the Board of
Adjustment.

#9 ITEMS BY MAYOR: Mayor Sawyer said he received a letter
from CPS saying they do not plan to give up any of their area to
GVEC. We plan on GVEC continuing to try to take over this area
so that we will only have to deal with one electric company.

The Texas Civil Justice has asked us to support the Tort Reform.
Mayor Sawyer said he replied that we do support the Tort Reform.
Mr. Sharpe said the Spring Spruce Up is doing well, wi th the
dumpsters being emptied, people are trimming trees and that fills
up the dumpsters very quickly. In the future, we might consider
renting a chopper and going around chopping up these limbs.
Mr. Sharpe said that in Savannah Square where the water comes
down the street and rushes through, there is no banister at the
sidewalk. We have the same problem as before. We should look at
the ordinance and make it mandatory that these be put in.
