SPECIAL MEETING OF THE CITY COUNCIL
APRIL 29, 1987

The Schertz City Council convened in Special Workshop Meeting on
Wednesday, April 29, 1987, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Pro Tem Ra'y': Stanho:Qe,
presiding: Charles B. Sharpe: Hal Baldwin: Adolph Agullar and Ken
Greenwald. Absent: Mayor Earl W. Sawyer. Staff present were
City Manager Jimmy G. Gilmore and City Secretary June G. Krause.
#1 BEARING OF RESIDENTS: Mr. and Mrs. woodruff of 1409 {3t,~
East Live Oak Road were pr'esent to express their obj ection to a 4 ?..L.e !
water tank being constructed on East Llve Oak Road, especially if I
on the lot next to their property. They indicated they would be I
more receptive if it was on the School Property. 3ti;1

Mr. Gilmore referred to a

Mr. Sharpe said he would not have any problem with a 5% increase
but had trouble equating the landfill increase to residential
billing.
Mr. Gutierrez of Waste Management said the present rate of $5.40
per residential customer is not a break even rate, as their net
per home wOuld be only $4.60.
There followed some discussion on the contract and when and for
how much Waste Management could ask for. Mayor Pro Tern Stanhope
suggested this item be placed on the next workshop agenda when
the contract could be available for further discussion.
#4 Consideration of P&Z recommendation of amending Zoning
Ordinance by adding a new Agriculture District.

Mr. Gilmore said this designation was specifically for the
Schirmerville area.

Mr. Greenwald added that although it is based on the
Schirrnerville area if will affect some other areas such as on 1-
35. He added that this will come up at the joint public hearing

for all the changes that have been recommended to the zoning
ordinance.

#5 Consideration of proposed annexation of Schaefer Road
from FM 1518 to Cibolo Creek.
Mr. Gilmore showed on the plat the area under discussion, saying
that the City is getting complaints about what people are trying
to build'in Lost Meadows. Tnere are about 15 to 18 homes in this
area. We only have to publish the public hearing in the paper
but if Co~ncil so desires, letters can be sent to these
individual owners.
Mayor Pro Tem Stanhope said it would be a courtesy to the people
and he felt letters should be sent. He then asked Council if
they were ready to put this up for public hearing and they agreed
they were.
Mr. Baldwin said the only thing that bothers him about this
annexation is the road and heavy traffic involved with the
'~1Proposed landfill.
#6 Discussion of the Mobile Home Ordinance.
Mr. Gilmore reminded Council that this has been up for first
reading and was placed on this agenda if Council has any
additional information they would like before final passage.

There being no questions, Mayor Pro Tem Stanhope asked that this
be on the next agenda for final consideration.
#7 Discussion of the proposed sub-division ordinance
amendmentS.
Mr. Gilmore said this sub-division ordinance has been rewritten
and will also have to go to public hearing.
Mr. Sharpe had several questions regarding the proposed ordinance
changes, one being on page 4 where its ta tes .. tha tit shall be
unlawful for the County clerk of any county in which such land
lies to receive or record any such plan, p-lat or re~lat, unless
and until the same shall have been approvea by the Clty Planning
Commission." and referred to Article 974a V.T.C.S.
Mr. Gilmore said that each county is well aware of Article 974a
of Vernon's and they know they cannot approve plats unless
approved first by the City.
Mr. Gilmore said that this was submitted tonight so that Council
will have time to review before going to public hearing.
Mr. Greenwald says the first page shows all the changes that are 0
being made to the ordinance.

Mayor Pro Tem asked Council to finish studying this proposed
ordinance and have it on the workshop of May 27th.
#8 EXECUTIVE SESSION: Mayor Pro Tem Stanhope called an ' 31.5
executive session under Article 6252-17 V.A.C.T. Section 3 (f) to b~
'discuss poss ible land purchase at 8: 07 p.m. -q . ' .
The workshop session was reconvened at 8:47 p.m. with Mayor Pro
Tem Stanhope saying there was nothing decided but this would be
an agenda item for the next regular meeting.
#9 CITY MANAGER' S REPORT: A. We did send a letter
inviting.the Cibolo City Council to the next workshop meeting to
discuss ETJ and any other subject.
B. The Herald did publish the Schertz Newsletter but left out
seven of the_ submi tted items, two of which were cri tical - the
Senior Citizen Day and Swimming Pool passes. We talked with them
and they advised that the two articles would be in the next
paper.
C. Regarding the sewer permit, we got a letter from the
Environmental Protection Agency, saying the application has been
received and is administratively complete.

Mr. SharPe asked if we had received a proposal from New
Braunfels. Mr. Gilmore said no but he did talk to Mr. Solms last
week and they are in the process of drawing plans. Mr. Gilmore
said he felt we should have something from him in the next month
or so. Mr. Sharpe said he did not think that was good enough
because he had talked with Mr. Solms and he promised something on
the 9th of April, which was not received. Mr. Sharpe felt we
should go direct to the City Council in New Braunfels.
D. The Council has approved the fire department building at the 35~
large pavilion in the park. There is a very small stand sitting /1?1,,3"-
next to the building that needs to come down. with Council '0 ~
permission, Mr. Gilmore said he would have it taken down. Mr.
Greenwald suggested keeping an eye out for a flat bed advertised
in the State surplus.
E. We should have some drawings in the not too distant future on
the Schertz Parkway and are working wi th the land owners to
possibly st.art the drainage from Gutierrez down to the Street.

G. Also have the schematics of 1-35, which shows FM 3n09/Schertz
Parkway. It also shows exit ramps moved down.

H. The people at the Mobile Home park are working with us on the
well site.
#10 I"l'BIIS BY COOIICIL:
Mr. Aguilar: Announced the rodeo at the Blue Bonnet would be
Saturday the 2nd of May and the Library, Humane Society, Lions
Club etc. will have booths there.
Mr. Sharpe advised that Texas Lutheran College is about to do a
survey of Schertz on shopping centers etc. maybe during their
fall term.' They have just completed one for S~guin. With
Council permission, Mr. Sharpe said he would continue working
with them on this.
Mr. Baldwin briefly explained a meeting he attended at East
Central School District concerning landfills. The State says
that if a landfill is in the city limits, the City has control.
If the landfill is in the extraterritorial jurisdiction of a
city, the State Department of Health has control and if in the
county, then the county has control. East Central School
District is fighting with BFI and are working with' their
Representative to take the control out of the State hands and put
in control of the ci ties. San Antonio is looking for a new
landfill and in studies that have been made, they have found
there is a strip from Converse through Schertz to Seguin that is
between two acquifers. Mr. Baldwin suggested Schertz should
support H.B. 30 and S.B. 551. There is a delegation going to
Austin April 30 and everyone is welcome. Mr. Baldwin said San
Antonio is also looking at burning and that in the future all
cities should contract with them.

Mr. Baldwin asked if any Councilman would take
responsibility of the morning coffee and donuts for
Citizen Appreciation Day - Mr. Stanhope volunteered.

Mr. Greenwald reported he had attended the Guadalupe County Fair
Association meeting and said it was not what he thought it would
be. They are not asking for money but support. The Fair will be
October 7-11 and they assured they would advertise in this area
this year. .
Mr. Greenwald asked if there was some reason why 'the police are
working the South gate of RandOlph every morning and not working
FM 78. Mr. Gilmore said they were working out there at the
reql.le~ t of the Mayor. . Mr. ,Greenwald sugges ted varying the
poslt~ons.
Mr. Greenwald asked if there was any particular reason why our
pOlice ticketed 50 students for loitering across the street from
the school. Mr. Gilmore said we have had complaints.

Mr. Greenwald reported that at the P&Z meeting the previous night, ~.~~
there were about five businessmen there complaining about the'l?t0
sign ordinance. There P&Z is recommending that we hold off on
the portable signs because of a law suit pending. Also one
member feels there is selective enforcement on the flashing signs .,
as only SAS can have one. , :~<I Ii)
The Business Club did discuss the Spring Clean Up and are going q~L~ .
to award plaques for each area of the city and want to do this at
the Regular Meeting on May 19th.

Mr. Aguilar said he felt P&Z should really look at the sign ('}(I / I I
ordinance because he sees nothing wrong with a sign like SAS has. ~I.!~'
Signs do need to be controlled but should reevaluate that portion
of the ordinance.
