REGULAR MEETING OF THE CITY COUNCIL MAY 5, 1987 r--, I ( The Schertz City Council convened in Regular Session, Tuesday, U May 5, 1987, at 7:00 p.m. in the Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The following members were present: Mayor EarlW. Sawyer, presiding: Charles B. Sharpe: Hal Baldwin: Ray Stanhope: Adolph Aguilar: and Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore and City Secretary June G. Krause. #1 APPROVAL OF MINUTES: Mr. Stanhope moved to approve the minutes of the Regular Meeting of April 7, 1987 and the Special Meeting of April 15, 1987. Mr. Baldwin seconded the motion. Mr. Baldwin requested that the second sentence of the second paragraph under item #9 be changed to read as follows: "Also when Mr. Simonson makes comments that are his own thoughts, they should be identified as such and not as coming from Staff." Mayor Sawyer then called for a vote on the motion before Council and the motion passed with the following vote: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None #2 HEARING OF RESIDENTS: A. Pat Woodruff of 945 East Live Oak Road said that she had a petition signed by 118 people with regards to putting a water tower on the property next to hers. They are requesting the tower be placed in another location where it would not be so visible, as this would be too high and too close to the road. o B. Lee Woordruff said they felt this tower would actually be degrading to the area and would depreciate not only the property it is to be located on but also the surrounding property for future development. He said if the tank ruptures, it would endanger the area residents. C. Jack Hinson spoke as representative of the Alamo Light Aircraft, saying the U.S. Ultralight Championship Competition would be held May 23, 24 and 25 at their location behind Garden Ridge Pottery. The three day event will feature top pilots from across the country vying for the Title of" National Champion. They would have manufacturer's displays, seminars, aerobatic air shows, static aircraft displays, introductory flight lessons, ultralight airshows, parachutists, remote control demonstrations. They anticipate thousands of spectators to the event, benefiting not only the local economy, but also will be a major fund-raiser for Boysville and other charitable organizations supported by the Kiwanis. o ~t~~!. .~'!U 8"l ~,~, '1 l:ji5:~:.~'-" ;.:i;...!S.,'. ( 115 r i Mr. Hinson then solicited the aid of the City, saying the FAA requires the presence of an ambulance with EMS personnel, and a fire truck with personnel on hand during the airshow portion of the event. They also requested the presence of one or two EMS volunteers from 10 am until 7 pm Saturday, Sunday and Monday. They have an air conditioned first-aid station available and if a fire truck could be on hand throughout the day, it would be gr'eatly appreciated They also were asking for aid from the police department for safe and orderly traffic flow from FM 3009 - FM 2252 onto their property. They asked the Mayor to open the event in a spirit of cooperation between the City and business community. In answering questions from Council, Mr. Hinson said there will be a gate admission of $3, with $1 off for military and children under 12 free. They do have a 50 acre field for parking. D. Barbara Fehr of 125 Richardson asked Council to choose another site for the water tower as she felt the tower would cause the value of their property to go down. Mr. Stanhope seconded the motion, which carried with the following vote: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None #4 ORDlRARCE: Mayor Sawyer introduced an ordinance and read the caption as follows: AN ORDINANCE o CREATING THE SCHERTZ CITY PLANNING AND ZONING COMMISSION, PRESCRIBING THE . DUTIES . AND QUALIFICATIONS OF IT'S MEMBERS AND 'THEIR TERM OF OFFICE, PROVIDING FOR THE APPOINTMENT OF IT'S' MEMBERS, 'THE' METHOD OF FILLING VACANCIES, MAKING DEPARTMENT HEADS AND OFFICIALS AVAILABLE TO CITY PLANNING AND ZONING COMMISSION, PRESCRIBING POWERS AND DUTIES OF THE CITY PLANNING AND ZONING COMMISSION, PROVIDING FOR ADOPTION OF RULES AND REGULATIONS AND, BY-LAWS, REPEALING ALL ORDINANCES OR 'PARTS . OF ORDINANCES INCONSISTENT OR CONTRARY HERETO. Mr. Baldwin moved to accept the first reading of an ordinance 0 amending the ordinance creating a Planning and Zoning Commission. Mr. Greenwald seconded the motion. Mr. Aguilar questioned the use of the alternate members referred to in Section 2 of this ordinance. He questioned the wording of the ordinance, which implies that all alternates would have to be at each meeting but would have no vot~. After further discussion by Council, Mayor Sawyer requested this item be placed on the next workshop agenda for clarification. He then called for a vote on the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Stanhope, and Greenwald NAYS: Councilman Aguilar #5 LARD PURCHASE: Mayor Sawyer said the School Board offered 12 acres on East Live Oak Road and another party had offered 1 acre just off East Live Oak Road. Mr. Sharpe moved to purchase the one acre for $10,000 for the purpose of installing a water tower. Mr. Greenwald seconded the motion. Mr. Sharpe said one of the things the entire ci ty voted on 0 recently was bonds to improve the water system for Schertz. The ( 117 r-- ) problem is where to put the tank. Obviously people don't want it in their back yard. He said the City Manager has looked around and found these two parcels that would be suitable. If it was put in a valley, it would cost twice as much to build. With regards to the water tower in Deer Haven, according to the Appraisal District the ones near the water tower are the most expensive homes in Schertz and have not devalued at all. It behooves the Ci ty Council to locate the tank where it is most economical for the City. The Council will take into consideration those that signed the petition but Mr. Sharpe said he could not conceive that the water tower would devalue the property that much. Mr. Gilmore said the lower part of Schertz is a low-pressure zone and this tank is needed to help this zone. At 32 feet high, it will look very similar to the one on Pat Booker Road. This tank, during the peak water demand, will become the primary for lower Schertz. If we don't build on this land, the only other site available is right in back of City Hall. We are very limited to the land that we could place the tank on. Right now it requires a 20 inch line to transport water to Schertz. If the tank is placed in this location, the line can be reduced to a 16 inch line. This would be money saved and there is no other location that would serve lower part of Schertz. Also this will provide a means of looping our system to serve the lower part of Schertz. r-- :. Mr. Gilmore said if the City puts in a one million gallon tank, it would be 32 feet high ground storage tank. If a 2 million tank, it would be 104 feet diameter and 32 feet high. If you use a standpipe, it would be 170 feet high and 56 feet diameter. Either alternative, we still need a tank in this area. Mr. Baldwin said this tank has been in the Master Plan for years and two engineers have picked this area and the offer is so good, it behooves the Council to take this lady up on her offer. Mayor Sawyer called for a vote on the motion, which carried as follows: AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and Greenwald. NAYS: None Mayor Sawyer said the Council has been planning on this tank for years and the engineer has said that site was the ideal place for this tank. ~~ /11 (9 Ie' I #6 EXECUTIVE SESSION: Mayor Sawyer said he would like a motion to table this item in order to get the right wording from our legal advisors. r-- i Mr. Greenwald moved to table item #6 on Executive Session. Mr. Gilmore said staff has been working on 'the water tower and have plans but there is something he would like to address at the next workshop. B. Have prepared a suggested Letter of Agreement or contract with the County for SAFES. They feel they need a contract. It has' been given to the County and will come before Council at Workshop. C'. ' Mr ~ Gilmore said he has met several times with the Highway Department and RandOlph AFB and the members of the RandOlph Transportation Committee 'on FM 78 and the proposed loop. Randolph is in the middle of preparing capitol plans for RandOlph and this can be included in those plans. o #8 ITEMS BY COUNCIL: Mr. Stanhope asked, about the sign that was made for the Animal Control Shelter. Mr. Gilmore said the sign was taken down because it needs some word changes and then will go back up. If you call it a shelter, it creates problems in that people think it is a place where they can just get rid of unwanted pets, regardless of where they live. Mr. Stanhope said for years there was no sign, and Bill Neller [')1 was asked to make a sign and now it has been taken down.' Mr. Neller has been very active in this community for years and the sign should be put back up. Council agreed. Mr. Stanhope also called attention to the speeding on Oak Street. It is getting to be a real problem. Mr. Stanhope had to leave the meeting at 7:55 p.m. Mr. Sharpe had a handout from the Guadalupe County Appraisal District. He said they are coming along according to schedule and will try to meet the dates on the handout. On June 1st they will be mailing notices to people of evaluations. Mr. Sharpe said that the State will have about $47 million under the Urban Road System. He suggested getting a bid in for some of the city roads ~ The money will be prorated among cities that have 5,000 or more population. Mr. Baldwin announced that Saturday will be Senior Citizen Appreciation Day. He asked for volunteers to help set up on Frlday night. Mr. Baldwin said that Council had talked at least meeting about putting something in the VFW time capsule. If the City is going to do that'it needs to be gotten to them soon. 2oi.:~ ~;:. o ( 119 r- i i .. Mayor Sawyer said he would be attending a County meeting on MaYA1~ 7th.
