SPECIAL MEETING OF THE CITY COUNCIL
JUNE 10, 1987
The Schertz Ci ty Council convened in Special Workshop Session,
Wednesday, June 10, 1987, at 7:00 p.m. in the Council Chambers of
the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding:
Charles B. Sharpe: Hal Baldwin: Ray Stanhope: Adolph Aguilar and
Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.

#1 HEARING OF RESIDENTS: There were approximately 42
people in attendance at this meeting. The majority of them were
present to discuss the proposed annexation of the Schaefer Road
area. Seven of them came to the podium and were recognized to
speak with several others giving comments from the audience.
Those speaking were Joan Harris, Mr. Harris, Richard Hammel,
George Gillihan, Junior Rumpf, Pat Marbach and Rene Tandy. Mr.
Malford Ackermann reserved time to speak on agenda item #4.
Their concerns centered around the question "What will we get by
the annexation that we don't already have?". They contended they
had sufficient water, good pOlice protection in Bexar County,
good fire protection and did not have any auto dumps to worry
about. They were also concerned about why the City was not also
annexing the Lakewood Acres area, since those are the people that
need help most. They repeatedly brought up about the proposed
garbage dump in the area, with Council advising that the City of
Schertz has absolutely nothing to do with that.

Mr. Sharpe had to leave for another meeting at 8:50 p.m
Mayor Sawyer thanked everyone for coming to the meeting and
making their feelings known. He advised that another public
hearing on this proposed annexation was to be held on June 16 and
invited everyone back.
Mayor Sawyer then called a recess at 8: 10 p.m. to allow the
Council to move to the Conference Room for the remainder of the
Workshop meeting.
The Special Workshop Meeting was reconvened at 8:19 p.m. in the
Conference Room.

#2 Discussion of Security policy for the Cnnnmmity Center ~'l, ~
and Park. 'J..!.;/
Mayor Sawyer said that Mr. Baldwin had asked about securi ty at
the last meeting. Council had a copy of the Communi ty Center
policy in their packet. Mayor Sawyer read section 14 - Lessee's
Responsibility, saying this clearly lets the people know before
they rent that they must have sufficient police.

Mr. Baldwin said he did not see anything to say that they have to
have security if they have beer. Mayor Sawyer said there has to
be some standard set so the Chief does not seem arbitrary.

Mr. Aguilar asked who is the best person to determine if they
need securi ty. Mr. Baldwin admitted probably the Chief of
Police. Mr. Aguilar said that it does not say that the people
cannot discuss it with the Chief, they can.
Mr. Stanhope said he would be insulted if he was there with some
business men for a meeting and was told that he had to have
security.
Mr. Aguilar said Council has to accept the fact that the Chief is
honest and fair or they have the wrong Chief.
Mr. Baldwin brought up that a family reunion in the middle of the
afternoon was told they had to have security.
Mr. Greenwald said Council is not trying to say just because of
booze but also because of the protection of ci ty property,
security is needed.
Mr. Baldwin said he did not see anything wrong with the
ordinance. He ~ust wanted to know if any parties had been booked
into the Communlty Center that did not have to have security. He
even agreed that the Chief should make the decision.

Mr. Gilmore said that 99 out of 100 bookings would be required to IUI
have securi ty because if they were not and something happened,
the Chief is going to be asked why not.
Mayor Sawyer suggested asking the City Manager to rewrite this
section so that it is a little easier for the Chief to make his
determination. This should also be discussed at next workshop.
Mr. Greenwald also suggested looking at the rates as they have
not been changed since 1980.
'Mr. Gilmore was instructed to find out what would cover some of
the costs for next workshop.
#3 Discussion of official city newspaper.
Mayor Sawyer said that recently Mr. Greenwald and Mr. Sharpe had
both brought up about the city newspaper. We need to determine
if both papers distribute to the entire City.
Mr. Baldwin said from the last discussion on this, the law says
that legal notices must be in a paper that has subscriptions.
#4 Discussion of an ordinance amending the Zoning

Mayor Sawyer said that there had been requests from some people
in Schirmerville for some zoning that would provide for
agriculture and residential zoning.
Mr. Ackermann asked if property is rezoned, could the City take
away their present use. Mayor Sawyer told him no.
Mr. Greenwald explained that we do not presently have this RA
Single Family Residence-Agricul ture District zoning. The
Planning & Zoning Commission will consider some of the prime
I areas that should have this type zoning and make a
recommendation.
Mr. Ackermann said that a man on 1-35 told him the City had taken
away his agriculture use. Mayor SaWyer said if the land is no
Ilonger used for agricul ture purposes, then it would be taken
I away.
Mr. Baldwin asked if the only property that would be involved in
this zoning would be pre-development zoned. Mayor Sawyer said
yes unless someone came in and requested this type zoning and
went through the public hearing process. Mayor Sawyer said the
reason the City came up with this type zoning was at the request
of some of the Schirmerville residents.

Discussion of annexations.

Mayor Sawyer said he felt Council had discussed this topic during
the hearing of residents. He went on to say that Mr. Baldwin had
brought up a good point on the high maintenance of Schaefer Road.
Mr. Aguilar said he would like to know before hand the rationale
behind any proposed annexation - how it might affect the police,
fire, streets and parks departments, etc. - these things should
be discussed.
Mayor Sawyer said what brought this particular proposal up was
that a couple of people in the area had asked for it.
There was some discussion about the Rittimann Addition and Mayor
Sawyer said the reason Council doesn't consider that area now is
that they are in the process of getting a grant and if we annexed
them, they would not get it.
Mr. Sawyer said Council can drop annexation proceedings at any
time they wish.
#6 Discussion of contract between Guadalupe County and
Schertz for road construction.

r- Mr. Gilmore said from what he has been told, the County is going
I to do the entire portion of Eckhart Road in the County and the

~ cost to do the part in Schertz city limits would be $10,000. To
do it ourselves would be about $28,000 to $30,000.

Mr,. Greenwald said Mr. Brannon told him this road was in the
county budget before it was annexed.
Mayor Sawyer said he assumed that bond money could be used for
this.
Mr. Baldwin said he felt it would be controversial since the
people on Weiderstein road have been in the city much longer and
their road needs repairs also.
#7 CITY MANAGER'S REPORT:
A. AACOG is having their grant review for Schirmerville on the
16th of June, then on the 24th the Executive Committee will vote
on it. Mr. Gilmore and Steve Simonson will attend both meetings.
# 8 ITEMS BY COUHCn.:
Mr. Aguilar asked for the pOlice to look at the stop sign at
Wright and Lindberg, as you cannot see the sign.
Mr. Gilmore advised that we have had damage to the sewer line
near CCMA and had to get a contractor to repair. This will about
deplete our contingency fund.
Mr. Stanhope asked the status of the striping machine. Mr.
Gilmore said the machine is still in the package after we turned
it down and they will not come and get it.
#9 ITEMS BY MAYOR: Mayor Sawyer said we should get another
striper or get the rig~t parts for this one.
#10 ADJOURNMENT: There being no further business, Mayor
Sawyer declared the meeting to be adjourned at 9:16 p.m.
