SPECIAL MEETING OF THE CITY COUNCIL
JULY 1,1987
The Schertz City Cou'ncil, convened<"in. :Speci:al Workshop ~ssion,
Wednesday, July 1, 1987, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding:
Charles B. Sharpe: Hal Baldwin: Ray Stanhope: Adolph Aguilar and
Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
#1 HEARING OF RESIDENTS: Mr. Ron Smi th, representing
Kuentsler Machinery was pre-sent to hand out brochures on the
motor grader he was presenting for bid. Mr. Smith answered
questions of Council concerning the availability of parts, saying
they were readily available from their stock and they do take
care of all maintenance.

Mr. Gilmore explained that the specifications were changed to
make the bids more general. Answering Mr. Aguilar, Mr. Gilmore
said the equipment would be used in the Schirmerville area, Aztex
Lane, Wiederstein Road, Eckhart Road, etc. It also can be used
in drainage ditches. This is the number one priori ty for the
Streets Department.

Mayor Sawyer reminded Council that they were not
at this meeting and before accepting anything but
they would have to check with the legal advisor.

Mrs. Coralee Fenner and Cindy Boeck were present and said that ~tJ,5l()
San Antonio planned to discontinue the Boeck property from their /?q
city limits on Sunday September 5th and it would be ready for
annexation by the City of Schertz.
Mr. Gilmore said that since this is a one-owner property, they
did not have to go through the entire petition publishing
process. However, we have not received anythlng from San Antonio
officially as yet.
Mayor "Sawyer asked that annexation proceedings be commenced as
soon as possible.
Mrs. Fenner and Mrs. Boeck presented Mr. Sharpe with a token gift
for all his help in their behalf.

#2 Discussion of July 7th public hearing on the r~est
Texas Construction System Inc. on behalf of the Knights
Columbus for a Specific Use Permit for a 3-phase development
Schertz Parkway.

Mr. Greenwald said they were leaving the frontage on Schertz
Parkway as general business and are trying to promote businesses
in the area. They plan to build their meeting hall in the middle
with a 30 foot street right of way along one side. This will be
almost directly across from the Fire Station. Mr. Greenwald said
one of the objections years ago when Mr. Riedel was looking to
build on his property is that he did not want a through street.

Mr. Baldwin asked if they were only asking for the Specific Use
permit for R-2 zoning and Mr. Greenwald said y~s.
Mayor Sawyer said a Specific Use was the best way to go because
the City then can regulate the use of the property.
Mr. Sharpe asked if they would be dedicating the street. Mr.
Greenwald said they would and that they almost have to do it this
way to get water and sewer to the back of the property. Mr.
Greenwald went on to say that with a 24 foot wide street, you
could have parking and whoever builds on the opposite side of
this street could be required to have parking also.
Mayor Sawyer advised that the public hearing on this item would
be on the next agenda.
#3 Discussion of BOA hearing to be held on July 7th on a
request by'Hoover Edwards for a variance to allow a mobile home
on the old Starlight Theater property.

Mr. Gilmore explained that Mr. Edwards had moved in a mobile home
to replace the one that burned without notifying the City.
Mayor Sawyer reminded Council that also in the packet were
letters from area businessmen saying they were in favor of having
the mobile home there for security reasons.
Mr. Aguilar asked if we could set a time limit with a renewable
clause. Mr. Gilmore said that Council could set their own
limits.
Mr. Stanhope asked where the first trailer was. Mr. Gilmore said
it was right near the projection booth and that mobile home
burned. Mr. Stanhope then asked what they would do for sewer.
Mr. Gilmore said they would be using the existing septic tank and
if it goes bad, then the heal th inspector would handle the
problem.
Mayor Sawyer sugges ted hav ing our heal th inspec tor check the
septic tank now. When Mr. Stanhope asked if Council could ask
him to take down the old screen, Mayor Sawyer said for him to
bring it up at the hearing.
#4 CITY MANAGER' S REPORT: A. We have a contract signed by
Guadalupe County' Commissioners for EMS service with SAFES for the

coming year. They agreed to pay $2833 per month or $34,000 per
year. This is $2,000 less than we asked for: however, it will
get us ,in their budget. We have ,been succeSs-ful' in g~tting
Seguin away from the percentage. Once we get on their budget,
then we have something to discuss with them.
Mr. Baldwin asked what the $34,000 is based on. Mr. Gilmore said
it really is not based on anythihg. Mr. Gilmore said it works
out to a little more than if we had based it on per capita, but
less than Seguin.
Mayor Sawyer said he was going to approach Commission Lee about
t:-.the .\.J.~in~orporated parts of Bexar County that SAFES covers.
Mr. Baldwin said Gordon Blake years ago went to Bexar County
Commissioners Court and asked that that area be released. They
did release it but did not agree to pay for us servicing it.
Mayor Sawyer said there has got to be a way to charge people who
are getting the service free.
Mr. Sharpe asked to get SAFES to show Bexar County residents

B. Have received a letter from Guadalupe Valley Electric
Cooperative, along with three volumes of data. They are wanting
to increase rates. They will present this data to the Texas
Utility Commission and are requesting permission, at a later
date, to be put on our agenda.
C. Planning and Zoning has sent City Council a letter requesting
consideration of placing a moratorium on portable signs until the
federal appeals court rules on San Antonio's case. Our legal
advisors says this is okay. We can continue to enforce the sign
ordinance but the problem is that San Antonio's sign ordinance is
being tried in court now.
Mayor Sawyer suggested continuing to enforce the ordinance until
someone comes in and threatens to sue, then we can pu t on a
moratorium.
D. Dave Allen has submitted his resignation from the Planning
and Zoning Commission. It has not been presented to P&Z as yet
so we have no recommendation from them.
Mayor Sawyer suggested sending Mr. Allen a letter thanking him
for his service to the City. Mr. Stanhope asked that he be given
a plaque.

E. Had the computer bid opening on June 29th. The opening was a
posted and dealers were contacted. Once they found out it had to ~~~ lu

looking at all possibilities, the committee said let's look at
the administrative portion. The Committee looked at all types
and if went with Tandy for instance, we would have to have all

Enterprises of Texas. The last being for Data Point Computer
equipment for $24,452.

F. Mr. Gilmore said the City may be going to court with Garden
Ridge over the area of Servtex. Back in 1974 when the city strip
annexed, Garden Ridge rushed out and had Servtex sign an
agreement to be in their ETJ - this being between the first and
second reading of our ordinance to annex. Richard Harris says
this is illegal. Servtex paid taxes last year and this year they
sent the tax statement to their Dallas office, who said we have
an agreement with Garden Ridge.
Mr. Baldwin said at the time of annexation, the City knew they 011"
. were, taking in some of Servtex property. Richard Harris said the
agreement was not valid because Servtex was not contiguous to
Garden Ridge city limits.
Mr. Gilmore said Mr. Ivy of Servtex came in and Servtex is going
to pay the bill if have to go to ,court..: He, wants it settled now.
Mr. Baldwin said he agreed and as soon as we get it cleared up,
we should go in and annex Servtex.
Mr. Sharpe asked if the City could get a map that shows both out
city limits and our ETJ.
Mr. Aguilar asked why can't we use the overhead projector in the,
Council Chambers. Mr. Gilmore said we will try again.
G. September 2 we go to court with Ackermann and Bindseil. July
23 go to Austin on the Green Valley Case. We are working now on
the depositions for the Mangum case. Mr. Gilmore said as for the
Ackermann/Bindseil case, we can take possession of the land for
the road now by putting money in escrow. Council said to go
ahead and do it.
Mr. Sharpe asked if the appraised value from the County would be
presentable in this case. Mr. Gilmore said yes, we are going to 0,'
use that, the value of the acre we bought and the price that
others in the area are asking, which is well below what they were

awarded. Mr. Gilmore said we are trying to get the drainage
situation taken care of. He said he was meeting with the group
next week. He said we will tell them there are two ways to go -
we can go with one bridge and Ackermann and Bindseil will have no
access or they can go in with the Ci ty and have access. Give
them ten days to make their decision.
Mr. Gilmore said the Texas Water Board 'has found out that we are
negotiating with Green Valley. They have a meeting on July 23rd
and we are to go to them ana tell chern what negotlations we are
making with Green Valley. Our attorneys have just about gotten
it ready. .
H. The City Council had asked for a salary survey information.
Mr. Gilmore handed out the survey.
#5 ITEMS BY COUNCIL: Mr. Aguilar reported that he and Mr.
Sharpe had gone to AACOG and they approved the one and hal f
million dollar grant request for water for Schirmerville.
Mr. Gilmore said that since it appeared in the San Antonio papers
that the Boeck property was being deannexed, we have had calls
from other people on Grey town Road who wanted to know how they
did it.
Mr. Aguilar asked about the accident where our ambulance was
r- involved. Mr. Gilmore said we had received payment for that.
.Mr. Aguilar mentioned something that bothered him was that the
Ci:b()lo Creek took a long time to clear the low water crossing.
He asked who we would have to contact to clean up stream or are
I we responsible for clearing the creek. Mayor Sawyer said that is
private property and we cannot spend tax money on private
property. Mayor Sawyer said the low water crossing is holding
some of the water back. -He also said there might be some springs
opening up as the acquifer has not been this high in years.
Mr. Stanhope asked why we could not get the Corp. of Engineers to
clear the creek. Mr. Gilmore reminded him they spent over one
million dollars on a study and did not do anything.

Mr. Sharpe said he had mentioned to Mr. Gilmore about the new
Immigration and Naturalization laws. Mrs~ Krause advised that
she had received the law and paper work from them and was already
getting ,the forms filled out.
Mr. Sharpe asked if the City accepted the Oak Forest bridge. Mr.
Gilmore said the contract is finished. The question is do you
want a grand opening. Mayor Sawyer said it might be good to have
one to show the people that the City did something for them. Mr.
Sharpe suggested getting the Street Department people to put in
some grass seed. He said we might put that in the Schertz
Parkway contract.

Mr. Stanhope asked about the striping machine. Mr. Gilmore said
it had been sent back but we have not gotten another One yet.

Mr. Stanhope asked the status of the sewer plant on 1-35. Mr.

Mr. Solns of New Braunfels Utilities said they are going out for
a bond election in September and within the package is money to
extend their sewer to that area. There is a good chance that we
can get a package sewer plant that has only been used six to
eight months if we get out permit and have to put in our own
plant.
Mr. Stanhope asked if the Council could pass a resolution saying
they approve a sports stadium providing it is put at Rotama.
Mayor Sawyer asked that one be prepared for the next meeting.
Mr. Baldwin asked the City Manager if the City had done anything
to appease the people on 1-35 that had called him. Mr. Gilmore,
referring to the lady at the Canvass Shop, said her father had
some chickens stolen awhile back and one of his gripes is that
the pOlice did not take pictures of the tire tracks - and they
were his tire tracks. He has a suspicion of who took the
chickens but will not give us the name. The lady at the Canvass
Shop said our pOlice never came out there. Since we received the
complaint, we have sent MacSorley and the Police Chief out there
to talk with them. We think she is mad about the new appraisals
ana. e'ame.'in on everything she could think of.

Mr. Sharpe said he went out there to look at the road and saw our
pOlice in the area and they were checking vehicles that they did
not know.
Mr. Gilmore said he did not know what else we can do. The lady
is mad because we annexed her. Three of our pol ice personnel
have purchase canvass from her for tents.
Mr. Baldwin said he thought the City Manager had done what he
could. Mr. Baldwin said he would go out and talk with them.
Mr. Baldwin asked when was the last time GVEC has asked for an
increase. Mr. Gilmore he thought it was three years ago. Mr.
'Bal~win asked if it would be worth it to the tax payers to hire a
person to analyze their request.
Mr. Baldwin asked if the City Manager felt we would have a short
fall in the budget. Mr. Gilmore said if we do it will not be
very big. We will have a carry over but not as great as in the
past.
Mr. Greenwald asked if Ford Engineering is checking the drainage
in Woodland Oaks. . He needs' to spot check the construction
because at one point it has almost a 90 degree curve. If
something is wrong, it needs to be checked now. Mr. Gilmore said
he would double check.

Mr. Greenwald reported some locations where stop signs are down
or covered by tree limbs: Exchange and Randolph, Wright and
Lindberg, Beck and Schertz Parkway.

Mr. Greenwald announced the softball tournament for July 17-19
with the banquet at the VFW on July 16th. Every manager and
president of the leagues that have a team participating should be
at the banquet. Mr. Greenwald also suggested a proclamation
declaring the week of July 14th as Pony Softball Week. Mayor
Sawyer suggested Mr. Greenwald get the information and give it to
Mrs. Krause.

Mr. Aguilar brought up about the Schertz newsletter insert, /./

#7 ITEMS BY MAYOR: Mayor Sawyer said he received a letter
from Mr. Kuempel, who said if we want copies of any bills just
ask and he will see that we get them.
There are several garage sale signs on telephone poles. The
police, water/waste water or inspection employees should get out
and tear them down when poticed.

Mayor Sawyer reported that a young man got a ticket and his
motorcycle was impounded. It would have been good public
relations to have called his father and let the father plck up
the cycle instead of having to pay an impound fee. If the father
gives then any trouble, arrest the father too. Council will back
them up.
