SPECIAL MEETING OF THE CITY COUNCIL
JULY 15, 1987
The Schertz City Council convened in Special Workshop Session,
Wednesday, July 15, 1987, at 7:00 p.m. in the Conference Room of
the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas. The
following members were present: Mayor Earl W. Sawyer, presiding:
Hal Baldwin, Ray Stanhope: Adolph Aguilar and Ken Greenwald.
Staff present were City Manager Jimmy G. Gilmore and City
Secretary June G. Krause.

#2 Representative of Ford Engineering to discuss Water
Storage Tank.
Mr. Ford had not arrived so Mayor Sawyer asked Jerry Graham to
brief Council on the bids for road building equipment.
Mr. Graham said that after checking all three bids received for
the motor grader, it was found that all three have areas where
they do not meet the specifications as written. He said his
original recommendation to Mr. Gilmore was to take a good look at
the Mitsubishi MG 300 because he thought that was the best for
what staff thought they would be doing at that time. Mr. Graham
said his department has gone out and looked at what needs to be
done and he agrees with the Mayor that this equipment is really
too big for what is needed.

Mr. Graham suggested rejecting all three bids and go out for new
bids, using the generic bid specifications he had written after
discussing this with the State monitor. He said the first
specifications had minute details and there were suppliers that
could not meet those specifications.
Mr. Gilmore said that he is now asking that the bids all be
rejected and we go out again for bids.
Mr. Graham said that anyone of the bid items would do anything
that Council wants to have done. One of them could be used to
just about build a road.
Mr. Gilmore said that the problem is that going with the
specifications, all three machines did not completely meet the
specs. Since all three met the specs to some extent, we cannot
go with any but the low bid according to legal advise.
Mr. Aguilar asked what Mr. Graham wanted the equipment for. Mr.
Graham replied that it would be to maintain the roads and keep
them, in good driving condition.

Mr. Aguilar then asked if the low bid machine would do what is
wanted and Mr. Graham replied that it would.

Mr. Baldwin asked the life expectancy of this machine. Mr.
Graham said as much or more than the State said, which would be
twenty-five years.

Answering questions of Council, Mr. Graham said he has two men in
his department qualified to use the heavy equipment, one of them
is a graduate of the A&M Heavy Duty Operators course. They both
have field experience.
Mayor Sawyer asked which roads Mr. Graham would have to rebuild.
Mr. Graham said Eckhart Road and those in the Schirmerville area.
He considers it maintenance even though it would be almost
rebuilding a road. Mr. Graham went on to say that he would like
to have equipment that could clean the drainage ditches, the bar
ditches to maintain proper water flow - a multi-use vehicle. He
said the reason they at firs t recommended the Mi tsubishi was
because of its weight. They have had all of these machines plus
others on loan and some are too light weight to clean the
drainage and bar ditches.
Mr. Gilmore said that Mr. Harris had put his legal experts on
this and the only way you could award to any but the low bidder
is if you can prove that a higher one is the best bid.
Mr. Gilmore said he strongly reconnnended rejecting all bids,
saying we are not satisfied with the bids, and go out again with
the generic specifications.

MR. FORD ARRIVED AT 7:59 P.M.
Mr. Ford projected two locations for water storage tanks - one on
East Live Oak Road. The reason for selecting this location is
because it is central to the demand source. He had cost
estimates for a one million gallon, a 1-1/2 million gallon and a
two million gallon storage tank. Mr. Ford said there is also a
dire need in the southern part of the city for storage and they
have looked for a location in the Schirmerville area. It would
be a lot more economical to have storage in the area of demand.
The 2 million gallon tank would cost about $444,226, the 1.5
million gallon tank approximately $384,226 and the 1 million
gallons storage tank about $284,226. The 1/2 million gallon tank
would be approximately $185,226. This is for ground storage
tanks.
Mr. Ford said the East Live Oak Road facility would be a little
lower elevation than the Universal City tank. The top of the
proposed tank would be close to the elevation of the U.C. tank
bottom. Mr. Ford highly recommended a 1/2 million~allon storage
tank in the south part of the city in the Schaefer Road area.
There is very little elevation difference in Schertz proper and
the area all the way to I 10. The proposal is ,for a 30 foot high 0
tank and it would not interfere with the clear zone. Mr. Ford
said that having the three storage areas will equalize the system

and will reduce the size needed for water lines. The land size
could be as little as 150 foot x 150 foot and have adequate land
for the ground storage tank.
The Council agreed the best way to go would be with a 1-1/2
million gallon storage tank on East Live Oak Road and a 1/2
million gallon storage tank in the Schaefer area.
#3 Discussion of Flood Study of Dietz Creek.
Mayor Sawyer then asked Mr. Ford to go over the Dietz Creek Flood
Plain Study.
Pointing to the plat, Mr. Ford explained the flood plain area
wi th the ultimate growth in the water shed area which includes
from Selma and Universal City. Mr. Ford said one of the things
they are looking at is the extension of Schertz Parkway and they
are working with the Highway Department on the FM 3009 area. He
said they had evaluated the existing conditions and the ultimate
development, to come up with this study. The area shaded in blue
on the map illustrates the boundaries of the flood flow through
the Dietz Creek area. There are 250 plus acres that are non-
developable. As noted on the map, the flood plain will affect a
lot of area, including residential areas. Mr. Ford said the only
way to control this water is to gather it and channel it. He
said we are talking about a massive structure going in. This
report shows that we want the developers to participate in this
channel. It sets the criteria and tells anywhere along the
channel what has to be done.
Mayor Sawyer asked if this study should be a
ordinance. Mr. Gilmore suggested making it a
subdivision ordinance. Mayor Sawyer asked that

#4 Discussion of P&Z recommendation on Specific Use Permit
request by Texas Construction Systems for the Knight of Columbus.
Mayor Sawyer reiterated that a public hearing had been held and
Planning & Zoning has recommended approval. Mr. Sawyer said he
asked Mr. Gilmore to find out if the people on Council who are
members of the Knights of Columbus could vote without it being a
conflict of interest.
Mr. Gilmore had checked with Richard Harris, who said there would
be no problem with Council voting because there is no monetary
gains involved.
Mr. Baldwin said he would like to see the City designate Pheil
Street No Parking and one way traffic. Council agreed. Mr.

Mr. Aguilar, referring to the P&Z recommendation, asked if the #3
item stating that upon completion of phase I there is a six-month
time limit to start construction on Phase II (Day Care Center) if
it is not already started.

Mr. Willman (of the P&Z Commission) stated that the ordinance
says that construction must be started with six months or
abandoned.
#5 Discussion of out-of-city water rates.
Mayor Sawyer said that when the bonds were passed, Council raised
the in-city rates but did not raise the out-of-city water rates.
Mr. Gilmore had a chart showing what specific accounts would be
if the rates were increased to 200%, 250% and 300% times ci ty
rates.
Mr. Greenwald said he was a strong advocate of not giving away
water to non-city residents.
Mr. Baldwin said we charge 150% of city rates now and they also
get ambulance, fire and some pOlice service free.
Council decision was to go with the 200% of in-city rates.
Mr. Gilmore said that Tom Funk and Ed Melton had gone to Bexar 01'
County to discuss ambulance service and fire service for this
area. Bexar County said it is their responsibility and they will
take care of it. The Mayor has written to Commissioner Bob Lee
suggesting that if the City of Schertz is to continue servicing
this area, we must have financial support from Bexar County.
However, if the Commissioners Court desires that the area be
served by Bexar County EMS, it is requested that the County
notify the citizens as to how they are to receive the service.
Mr. Gilmore said they way we have been doing it puts both the
City of Schertz and Bexar County in jeopardy. Bexar County said
they will take care of ambulance but we still want Bob Lee to
notify the people involved.
Mr. Gilmore said that Tom Funk of SAFES feels if a call comes in,
they will respond and treat but let Bexar County transQort. If
the Fire Department gets a call, then SAFES will respond because
it could be one of our firemen.

#7 Budget Workshop: Mayor Sawyer said he felt starting on
the budget at 10~00 p.m was too late. He said he has asked Mr.
Gilmore to set up some strictly budget workshops. He then asked
what day Council would want.

After discussion, it was decided the next budget workshop would
be from 6:00 p.m to 9:00 p.m on Monday July 20, 1987.

street people involved early in the discussions. The City needs
to know what their obligations are and what time frame is
involved.
Mr. Gilmore said he would suggest having a commi ttee to set a
theme, and ~et it out six to eight months ahead of time so floats
could be maae. They could make arrange for a viewing stand and
numerous items that could be taken care of in advance. It will
not work with us telling the Business Club, it has got to be a
communi ty effort on both sides. Mayor Sawyer said he had
requested the City Manager to arrange for vehlcles for Council
next year. Mr. Graham said he would 1 ike to work wi th the
committee, which was okay with Council.
B. Mr. Gilmore asked if Council had any objection to the Police
Department putting bumper stickers, concerning reward, on the
City cars. Council did not object.

D. Mr. Gilmore reported that he went to court on Monday on the
Mangum case and they are attempting to bring in some other
parties but the court denied it and placed heavy restrictions to
produce discovery. The court also did not extend the trial date.
Tuesday we deposed witnesses and the witness was so good that the
pipe people are thinking about bringing him in as an expert
witness. Mangum is looking at filing a suit against the city for
defamation of character. That will let us go after him
personally, also his wife and mother. It is looking good for us
right now.
E. July 22nd we go to Federal Court to discuss any agreement 161 <S ~()
with Green Valley to come out with a division of land. On July ; J
23rd we go to the Texas Water Board in Austin to present the same
thing.

#9 ITEMS BY COUNCIL: Mr. Aguilar asked about the public ~11
hearing on the flood plain. Mr. Gilmore said we are in the t6'1 1
process of completing our grant application for the park. In ) I
order to present it we have to have this public hearing on the
flood plain in that area.

Zoning. They are to be on the next agenda.

Mr. Greenwald announced the BVYA Tournament dinner was Friday
night at 6:00 and the opening ceremonies would 'be at 3:00 p-.m. on
Friday.
#10 ITEMS BY MAYOR: Mayor Sawyer asked if there was
anything new on the sewer permit and was told there was not.
#11 ADJOORHMBNT: Mayor Sawyer declared the meeting to be
adjourned at '10:27 p~m.
