REGULAR MEETING OF THE CITY COUNCIL
JULY 21, 1987
The Schertz City Council convened in Regular Session Tuesday,
July 21, 1987, at 7 :00 p.m. in the CouncilChamhers of the
MuniciJ?al Complex, 1400 Schertz Parkway, Schertz, Texas. The
followlng memoers were present: Mayor EarlW. Sawyer, presiding:
Charles B. Sharpe: Hal Baldwin: Ray Stanhope: Adolph Aguilar and
Ken Greenwald. Staff present were City Manager Jimmy G. Gilmore
and City Secretary June G. Krause.
I-UBLIC BEARING:
After welcoming everyone to the meeting, Mayor Sawyer opened the
public hearing, giving the purpose to seek public response on the
proposed City park improvements within a flood plain area.

Mr. Gilmore advised staff has prepared an application for public
park assistance. One of the requirements is that we hold this
public hearing.
There being no citizens wishing to speak on this subject nor any
comments from Council, Mayor Sawyer declared the public hearing
closed at 7:03 p.m.

Mr. Greenwald moved to forward the request for park improvements
application to the State Parks and Wildlife. Mr. Stanhope
seconded the motion, which carried with the fOllowing vote:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#1 APPROVAL OF MINUTES: A. Special Meeting of July 1, and
B. Regular Meeting- of July 7, 1987.
Mr. Baldwin referred to the minutes of July 1st, under item #4
City Manager Report, item F - second paragraph, second sentence
should read as follows: "Richard Harris said the agreement was
not valid because Servtex was not contiguous to Garden Ridge
Extraterritorial Jurisdiction."
On the same item, Mr. Sharpe asked that paragraph 5 be corrected
to read: "Mr. Sharpe asked if the City could get a map that
shows both our city limits and ETJ.
Mr. Greenwald referred to the minutes of July 7th, the 7th
paragraph under BOARD OF ADJUSTMENT be corrected as follows:
"Mr. Sharpe said Mr. Edwards is just replacing a mobile home that
burned."
:- Mr. Stanhope moved to approve the minutes of the Special Meeting
of July 1 and Regular Meeting of July 7, 1987 as amended. Mr.
Greenwald seconded the motion, which carried as follows:

#2 BEARING OF RBSIDEN'l'S: None
#3 BID AWARD: Consideration of awarding bids for a Motor
Grader~
Mr. Sharpe moved to award bid for a motor grader to Anderson
Machinery for a Fiatalliss primarily because it has a two-year
warranty where as the others do not and it has a 1 it tIe more
weight and a little more horsepower.
Mr. Baldwin interjected that if none of these three bids meet the
specifications, Council is compelled to take the low bid, is that
correct? Mr~ Gilmore said that is the information he was given,
unless we can show good justification.
Mr. Sharpe said of the warranty - if Council were to go out and
buy another year's warranty, they would probably spend that much
or, more if it was available.
Mayor Sawyer asked if there was a second to the motion before
Council. There was not a second put forth. Motion died for lack
of second.

Mr. Greenwald moved to reject all bids on the motor grader and go
back out again for bids. Mr. Stanhope seconded the motion.
Mr. Sharpe said he was not sure that the Street people know what
they are looking for. If they have gone out twice and no one met
the specs, he said he was not sure where they were getting their
specifications. The things that they are asking for, Mr. Sharpe
was not sure they are important.
Mr. Baldwin said he was not an expert on motor graders so he had
to rely on what Mr. Graham had explained at the workshop. Mr.
Graham said he had checked with the State and had gotten generic
bid specifications and that is what he is going to use.
Mr. Sharpe wanted to know if Mr. Graham had tried all three
machines. Mr. Gilmore said Mr. Graham had indicated that he had.
Mayor Sawyer called for a vote on the motion and the motion
carried with the following vote:
AYES: Councilmen Baldwin, Stanhope, Aguilar and Greenwald.
NAYS: Councilman Sharpe.
Mr. Baldwin said he felt that if Mr. Graham gets three bids then 0
he should try all three graders.

#4 SPECIFIC USE PERMIT: Consideration of a request for a
Specif ic Use permi t by the Knights of Columbus for a 3-phase
development on Schertz Parkway.

Mayor Sawyer said Council has had a public hearing on this
request by the Knights of Columbus and are now ready for a vote.
Mr. Sharpe moved to approve the Knights of Columbus request for a
Specific Use Permit to build a development on Schertz Parkway as
recommended by Planning and Zoning. Mr. Greenwald seconded the
motion.
Mr. Baldwin asked about the time limit on phase
Greenwald said that according to ordinance phase
started within six months or the zoning reverts.

#5 P&Z RECOMMENDATIONS: A. Consideration of appointing a
new member to the P&Z' COIIIIlission.

Mr. Greenwald moved to approve the P&Z recommendation and appoint
Mr. Randy Grossman of 2517 Kline Circle to the P&Z Commission.
Mr. Stanhope seconded the motion.
Mr. Baldwin asked if Kline Circle was in Woodland Oaks, since
that would make two people on the Commission frOm that area.
Mr. Greenwald said there were only four applicants that showed ~p
at the meeting and the one selected just happened to be from
Woodland Oaks.
Mayor Sawyer then called for a vote, which carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None

Mr. Aguilar moved to appoint Mr. Ty Brisgill as Vice-Chairman of
the Planning & Zoning Commission. Mr. Baldwin seconded the
motion, which carried with the following vote:

#6 ORDIRARCE: Mayor Sawyer introduced an ordinance and
read the caption as follows:,

Mr. Greenwald moved to approve this ordinance amending ordinance

87-S-11 BY ADDING EXHIBIT "D'" - FLOOD STUDY
OF DIETZ CREEK.
Mr. Aguilar moved to approve the first reading of and ordinance
amending the subdivision ordinance No. 87-S-11 by adding Exhibit
"D". Mr. Greenwald seconded the motion.
Mr. Sharpe asked when someone comes in for a development, how
does that person know what the numbers in this exhibit say. Mr.
Gilmore explained that their engineer would be the one to get the
exhibit, and it is written in engineering terms.
Mayor Sawyer then called for a vote, motion carried as follows:
AYES: Councilmen Sharpe, Baldwin, Stanhope, Aguilar and
Greenwald.
NAYS: None
#8 CITY MANAGER'S REPORT: A. The visit of the Costa Rican
interns will be - coming to the area from August 1st to August
13th. Although we do not have a host family, it is our
understanding that the Federal Government will put them up in a
hotel. We now need to schedule an agenda. For exampl e, San
Antonio has them scheduled for sight seeing ,etc. as well as

spending one day in each department and attending a Council
meeting.

B. There will be a public meeting August 11th at 9:00 a.m. at
the Community Center on the proposed landfill. It has been
requested that the Mayor present the resolution passed by Council
supporting the landfill at the meeting.
C. Mr. Gilmore said he had talked with Bob Solm in New Braunfels
and they will be selling bonds the 3rd of August this year. The
project has been through the Water Board and City Council. In
their project they extend their sewer line to the ETJ on I 35.
They expect to have construction underway by the first of the
year. On our permit, they are sending us something to run in the
paper for thirty days, and if no comments are recelved, they will
issue the permit. It has to be in the paper in the county of
location, so it will have to appear in the New Braunfels papers.

D. Mr. Gilmore said it is his under standing that Council has ~$.:3
given him permission to remove the wall between his office and ~?I ?-.
the small conference room. The work will be done in-house. (I
Council agreed.
E. Mr. Willman is in the hospital but we don't know the extent
of his surgery as yet. He is recovering and will be taken to the
ward the next day.

#9 ITEMS BY COUNCIL: Mr. Sharpe mentioned that in one of
the recent' meetings Mr Gilmore had said he would be going to
Austin to talk about Green Valley. Mr. Gilmore said yes the
meeting is still scheduled, we have been talking about an
agreement for service so that we will not be dually certified in
the same areas. They are talking about the same map that was
presented over a year ago. And of course it still has to come
back to Council.
Mr. Sharpe said he thought Council made it clear that Mr. Gilmore
would come back to Council before going to Austin. Mr. Gilmore
said it still has to come to Council before being passed, and he
will have the attorney out for a briefing.
Mr. Sharpe asked if it was Council decision not to consider again
the Cable Franchise tax this budget year. Mayor Sawyer said
Council can consider that and the Southwestern Bell tax.
Mr. Baldwin referred to a telephone call he had received from
Dickie George about using the City's PA system. Mayor Sawyer
advised that Mrs. Krause had advised her that most all hotels
furnish PA systems to those using their conference rooms. She
wanted the system from the 20th of July through the 4th of August
and that is a very long time for our system to be out of the
city.

Mr. Stanhope asked if Council could get the monthly reports with
their workshop packets so they could be discussed at that
meeting.
Mr. Aguilar asked if Council will be loaning our PA system even
for one day. Mr. Greenwald suggested discussing the pros and
cons of loaning the PA system and upgrading it at the next
workshop.
Mr. Aguilar asked who is responsible for cleaning the drain pipes
at the Cibolo Creek low water crossing. Mr. Gilmore said it was
his understanding that Universal City was responsible.
Mr. Greenwald announced that there was an excellent turnout for
the softball tournament.
